Preamble
- Bahawasanya, melalui Perintah Koperasi (Pengambilalihan Kawalan) (Pelantikan) 2016 [P.U. (A) 25/2016] yang disiarkan dalam Warta pada 2 Februari 2016, Suruhanjaya Koperasi Malaysia telah melantik Kastian bin Hj. Dula untuk mengambil alih kawalan semua harta, urusan, aktiviti dan hal ehwal Koperasi Sakilan Sandakan Berhad, dan menjalankan kesemua urusan, aktiviti dan hal ehwalnya berkuat kuasa mulai 17 November 2015 hingga 16 November 2017 atau sehingga suatu Lembaga dipilih di bawah undang-undang kecil Koperasi itu, mengikut mana-mana yang terdahulu: Dan bahawasanya, melalui Perintah Koperasi (Pengambilalihan Kawalan Koperasi Sakilan Sandakan Berhad) (Pelantikan Semula) 2020 [P.U. (A) 124/2020] yang disiarkan dalam Warta pada 24 April 2020, Suruhanjaya Koperasi Malaysia telah melantik semula Kastian bin Hj. Dula untuk mengambil alih kawalan semua harta, urusan, aktiviti dan hal ehwal Koperasi Sakilan Sandakan Berhad, dan menjalankan kesemua urusan, aktiviti dan hal ehwalnya berkuat kuasa mulai 17 November 2017 hingga 27 Oktober 2018: Dan bahawasanya, Suruhanjaya Koperasi Malaysia telah mengadakan mesyuarat agung khas Koperasi Sakilan Sandakan Berhad pada 27 Oktober 2018 dan sembilan anggota Lembaga baharu telah dipilih dengan sewajarnya pada mesyuarat agung khas itu:2460
- Maka oleh yang demikian, Suruhanjaya Koperasi Malaysia memberikan notis di bawah subseksyen 69d(4) Akta Koperasi 1993 [Akta 502] bahawa pengambilalihan kawalan semua harta, urusan, aktiviti dan hal ehwal Koperasi Sakilan Sandakan Berhad yang dibuat di bawah subseksyen 69(2) dan 69a(2) Akta telah ditamatkan pada 27 Oktober 2018, dan Suruhanjaya Koperasi Malaysia menyerahkan semua harta, urusan, aktiviti dan hal ehwal Koperasi Sakilan Sandakan Berhad kepada Lembaga baharu yang dipilih. Preamble
- Whereas, by the Co-operative Societies (Assumption of Control) (Appointment) Order 2016 [P.U. (A) 25/2016] published in the Gazette on 2 February 2016, the Malaysia Co-operative Societies Commission has appointed Kastian bin Hj. Dula to assume control of the whole of the property, business, activities and affairs of the Koperasi Sakilan Sandakan Berhad, and carry on the whole of its business, activities and affairs with effect from 17 November 2015 to 16 November 2017 or until a Board is elected under the by-laws of the Co-operative Society, whichever is earlier: And whereas, by the Co-operative Societies (Assumption of Control of Koperasi Sakilan Sandakan Berhad) (Reappointment) Order 2020 [P.U. (A) 124/ 2020] published in the Gazette on 24 April 2020, the Malaysia Co-operative Societies Commission has reappointed Kastian bin Hj. Dula to assume control of the whole of the property, business, activities and affairs of the Koperasi Sakilan Sandakan Berhad, and carry on the whole of its business, activities and affairs with effect from 17 November 2017 to 27 October 2018: And whereas, the Malaysia Co-operative Societies Commission has held a special general meeting of the Koperasi Sakilan Sandakan Berhad on 27 October 2018 and nine new Board members have been duly elected at the special general meeting: P.U. - Now therefore, the Malaysia Co-operative Societies Commission gives notice under subsection 69d(4) of the Co-operative Societies Act 1993 [Act 502] that the assumption of control of the whole of the property, business, activities and affairs of the Koperasi Sakilan Sandakan Berhad made under subsections 69(2) and 69a(2) of the Act has been terminated on 27 October 2018, and the Malaysia Co-operative Societies Commission submits the whole of the property, business, activities and affairs of the Koperasi Sakilan Sandakan Berhad to the newly elected Board.
