BAHAWASANYA, melalui P.U. (B) 162/2005 yang disiarkan dalam Warta Kerajaan Persekutuan pada 5 Mei 2005, pada menjalankan kuasa yang diberikan kepada Kerajaan Persekutuan oleh subseksyen 28(1) Ordinan Tanah Sabah [Sabah Bab 68] sebagaimana yang diubahsuaikan oleh Perintah Wilayah Persekutuan Labuan (Pengubahsuaian Ordinan Tanah) 1984 [P.U. (A) 291/1984], Menteri yang bertanggungjawab bagi perkara-perkara yang berhubungan dengan tanah di Wilayah Persekutuan Labuan telah merizabkan tanah yang diperihalkan dalam Jadual bagi maksud awam, iaitu suatu tapak untuk landskap dan taman rekreasi awam dan telah menetapkan bahawa Perbadanan Labuan hendaklah mempunyai kawalan terhadap tanah rizab itu: DAN BAHAWASANYA, melalui P.U. (B) 242/2010 yang disiarkan dalam Warta Kerajaan Persekutuan pada 10 Mei 2010, Kerajaan Persekutuan telah mewakilkan penjalanan kuasanya di bawah seksyen 64 Kanun Tanah Negara kepada Jawatankuasa Kerja Tanah Wilayah Persekutuan Labuan: DAN BAHAWASANYA, didapati suai manfaat sekarang oleh Jawatankuasa Kerja Tanah Wilayah Persekutuan Labuan supaya keseluruhan perizaban yang disebut terdahulu itu dibatalkan: DAN

BAHAWASANYA, notis mengenai cadangan untuk membatalkan keseluruhan perizaban yang disebut terdahulu itu yang diperihalkan dalam Jadual bersama dengan butir-butir mengenai masa dan tempat di mana suatu siasatan akan diadakan oleh Pentadbir Tanah Wilayah Persekutuan Labuan di Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan Labuan, untuk mendengar mana-mana orang yang berhasrat untuk membantah terhadap pembatalan itu telah ditampalkan mengikut seksyen 433 Kanun Tanah Negara dan juga telah disiarkan dalam Warta Kerajaan Persekutuan sebagai P.U. (B) 59/2016 pada 15 Februari 2016: 3 DAN BAHAWASANYA, tiada apa-apa bantahan diterima terhadap cadangan untuk membatalkan keseluruhan perizaban yang disebut terdahulu itu yang diperihalkan dalam Jadual: MAKA OLEH YANG DEMIKIAN, Jawatankuasa Kerja Tanah Wilayah Persekutuan Labuan, pada menjalankan kuasa di bawah seksyen 64 Kanun Tanah Negara yang diberikan kepada Kerajaan Persekutuan dan diwakilkan kepadanya sebagaimana yang disebut terdahulu, membatalkan perizaban tanah yang diperihalkan dalam Jadual:

NATIONAL LAND CODE

REVOCATION OF RESERVATION OF LAND FOR PUBLIC PURPOSE

WHEREAS, by P.U. (B) 162/2005 published in the Gazette of the Government of the Federation on 5 May 2005, in exercise of the powers conferred upon the Government of the Federation by subsection 28(1) of the Land Ordinance Sabah [Sabah Cap. 68]

as modified by the Federal Territory of Labuan (Modification of Land Ordinance)

Order 1984 [P.U. (A) 291/1984], the Minister responsible for matters relating to land in the Federal Territory of Labuan has reserved the land described in the Schedule for a public purpose, to wit a site for landscape and public recreation ground and has designated that Perbadanan Labuan shall have control of that reserved land:

AND WHEREAS, by P.U. (B) 242/2010 published in the Gazette of the

Government of the Federation on 10 May 2010, the Government of the Federation has delegated the exercise of its powers under section 64 of the National Land Code to the

Land Executive Committee of the Federal Territory of Labuan:

AND WHEREAS, it now appears expedient to the Land Executive Committee of the Federal Territory of Labuan that the whole of the aforesaid reservation be revoked:

AND WHEREAS, notice of the proposal to revoke the whole of the aforesaid reservation as described in the Schedule together with details of the time and place at which an enquiry would be held by the Land Administrator of the Federal Territory of

Labuan at the Office of Director of Lands and Mines of the Federal Territory of Labuan, to hear any person desiring to object to such revocation was affixed in accordance with section 433 of the National Land Code and was also published in the Gazette of the

Government of the Federation as P.U. (B) 59/2016 on 15 February 2016:

AND WHEREAS, no objection to the proposal to revoke the whole of the aforesaid reservation as described in the Schedule was received:

NOW THEREFORE, the Land Executive Committee of the Federal Territory of

Labuan, in exercise of the powers under section 64 of the National Land Code conferred upon the Government of the Federation and delegated to it as aforesaid, revokes the reservation of the land described in the Schedule:
