Opening note

Preamble

BAHAWASANYA, melalui Pemberitahuan No. 8433/1933 yang disiarkan dalam Warta Kerajaan Negeri-Negeri Melayu Bersekutu pada 15 November 1933, pada menjalankan kuasa yang diberikan oleh seksyen 3 dan seksyen 12 Enakmen Hutan 1918 [En. 34 Tahun 1918], Residen Selangor, dengan kebenaran Majlis Negeri, telah mengisytiharkan bahawa tanah yang diperihalkan dalam Jadual dan ditandakan dalam pelan berdaftar No. 94-A, yang disimpan di Pejabat Penguasa Hasil Ukur, Selangor, menjadi suatu hutan simpanan dalam tambahan dan membentuk sebahagian Hutan Simpan Bukit Sungei Puteh: DAN BAHAWASANYA, didapati suai manfaat sekarang supaya sebahagian kawasan tanah daripada Hutan Simpan Bukit Sungei Puteh dikeluarkan daripada hutan simpanan kekal: MAKA OLEH YANG DEMIKIAN, Menteri, pada menjalankan kuasa yang diberikan oleh perenggan 11(b) dan subseksyen 13(1) Akta Perhutanan Negara 1984 [Akta 313], sebagaimana yang diubah suai bagi Wilayah Persekutuan Kuala Lumpur di bawah seksyen 114 Akta dan menurut Jadual Kelima kepada Akta, mengisytiharkan bahawa kawasan tanah yang dinyatakan dalam Jadual tidak lagi menjadi hutan simpanan kekal mulai tarikh Pemberitahuan ini disiarkan dalam Warta.

NATIONAL FORESTRY ACT 1984

NOTIFICATION OF EXCISION OF LAND AREA

FROM THE PERMANENT RESERVED FOREST

WHEREAS, by Notification No. 8433/1933 published in the Gazette of the

Federated Malay States Government on 15 November 1933, in exercise of the powers conferred by section 3 and section 12 of the Forest Enactment 1918 [En. 34 of 1918], the Resident of Selangor, with the approval of the State Council, has proclaimed that the land described in the Schedule and delineated in the registered plan No. 94-A, deposited in the Office of the Superintendent of Revenue Surveys, Selangor, to be a reserved forest in extension and forming part of the Bukit Sungei Puteh Forest Reserve:

AND WHEREAS, it now appears expedient that part of the land area of the

Bukit Sungei Puteh Forest Reserve be excised from the permanent reserved forest:

NOW THEREFORE, the Minister, in exercise of the powers conferred by paragraph 11(b) and subsection 13(1) of the National Forestry Act 1984 [Act 313], as modified for the Federal Territory of Kuala Lumpur under section 114 of the Act and pursuant to the Fifth Schedule to the Act, declares that the land area specified in the Schedule shall cease to be a permanent reserved forest from the date of publication of this Notification in the Gazette.
