PADA menjalankan kuasa yang diberikan oleh subseksyen 2A(2) Akta Pemberi Pinjam Wang 1951 [Akta 400], Menteri mengecualikan SDE Solutions Sdn. Bhd. daripada semua peruntukan Akta bagi tempoh tiga puluh lima tahun berkuat kuasa mulai tarikh penyiaran Pemberitahuan ini dalam Warta dengan syarat bahawa—

(a)

pinjaman hanya diberikan kepada Senai-Desaru Expressway Berhad

(No. Syarikat: 612633-A);

(b)

faedah bagi pinjamannya tidak boleh melebihi 12% setahun dan faedah ini tidak boleh pada bila-bila masa dipungut oleh SDE Solutions Sdn. Bhd.

(No. Syarikat: 1071486-X) akan suatu jumlah yang melebihi jumlah pinjaman pokok yang kena dibayar;

(c)

satu salinan perjanjian pemberian pinjaman wang dengan Senai-Desaru

Expressway Berhad (No. Syarikat: 612633-A) yang telah disetem dengan sewajarnya hendaklah dikemukakan kepada Menteri; dan

(d)

suatu penyata kewangan tahunannya yang telah diaudit hendaklah dikemukakan kepada Menteri tidak lewat daripada tiga bulan selepas berakhir suatu tahun kewangannya.

EXEMPTION UNDER SUBSECTION 2A(2)

Opening note

Preamble

IN exercise of the powers conferred by subsection 2A(2) of the Moneylenders Act 1951 [Act 400], the Minister exempts SDE Solutions Sdn. Bhd. from all of the provisions of the Act for a period of thirty five years with effect from the date of publication of this Notification in the Gazette provided that—

(a)

its loan is given only to

Senai-Desaru

Expressway

Berhad

(Company No.: 612633-A);

(b)

the interest for its loan shall not exceed 12% per annum and the interest shall not at any time be collected by SDE Solutions Sdn. Bhd.

(Company No.: 1071486-X) of an amount in excess of the sum then due as principal;

(c)

a copy of its duly stamped agreement with Senai-Desaru Expressway

Berhad (Company No.: 612633-A) shall be submitted to the Minister; and

(d)

its audited yearly financial statement shall be submitted to the Minister not later than three months after the end of its financial year.
