[P.U. (A) 142/2014], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam subperaturan 10(2)—

Jadual Pertama kepada Peraturan-Peraturan ibu dipinda—

(a)

dalam butiran A—

(i)

dalam subbutiran

“Borang 24, Borang 44 dan Borang 49 Akta Syarikat 1965 yang terkini” dengan perkataan “profil syarikat yang dijana daripada sistem yang disediakan oleh Suruhanjaya Syarikat Malaysia di bawah Akta Syarikat 2016 [Akta 777]”; dan

(ii)

dengan menggantikan subbutiran

(e)

dengan subbutiran yang berikut:

“(e)

sesalinan terperaku persetujuan bertulis semua pengarah syarikat di bawah seksyen 201 Akta Syarikat 2016;”; dan

(b)

dalam butiran B—

(i)

dalam subbutiran

“Borang 24, Borang 44 dan Borang 49 Akta Syarikat 1965 yang terkini” dengan perkataan “profil syarikat yang dijana daripada sistem yang disediakan oleh Suruhanjaya Syarikat Malaysia di bawah Akta Syarikat 2016”; dan

dengan menggantikan subbutiran

(d)

dengan subbutiran yang berikut:

“(d)

sesalinan terperaku persetujuan bertulis semua pengarah syarikat di bawah seksyen 201 Akta Syarikat 2016;”.

Pindaan Jadual Kedua 4.

Jadual Kedua kepada Peraturan-Peraturan ibu dipinda dalam butiran 4, dalam ruang KADAR (RM), dengan memotong perkataan “had maksimum RM100,000.00

dan”.

Kecualian 5.

Walau apa pun subperaturan 1(2), apa-apa dokumen yang telah dikemukakan di bawah Jadual Pertama, butiran A, subbutiran (d) atau (e) berhubung dengan permohonan pendaftaran, atau Jadual Pertama, butiran B, subbutiran (c) atau (d)

berhubung dengan permohonan pembaharuan perakuan pendaftaran di bawah

Peraturan-Peraturan ibu bagi tempoh 31 Januari 2017 hingga 31 Oktober 2021

hendaklah, pada tarikh permulaan kuat kuasa Peraturan-Peraturan ini, disifatkan telah dikemukakan di bawah Jadual Pertama, butiran A, subbutiran (d) atau (e), atau Jadual Pertama, butiran B, subbutiran (c) atau (d) Peraturan-Peraturan ibu sebagaimana yang dipinda oleh Peraturan-Peraturan ini.

CREDIT REPORTING AGENCIES

(REGISTRATION) (AMENDMENT) REGULATIONS 2021

IN exercise of the powers conferred by paragraph 72(2)(a)

of the

Credit

Reporting

Agencies

Act 2010

[Act 710], the

Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Credit Reporting Agencies

(Registration) (Amendment) Regulations 2021.

(2)

These Regulations come into operation on 1 November 2021.

Amendment of regulation 10 2.

The

Credit

Reporting

Agencies

(Registration)

Regulations 2014

[P.U. (A) 142/2014], which are referred to as the “principal Regulations” in these

Regulations, are amended in subregulation 10(2)—

(a)

by deleting the word “or” at the end of paragraph (b);

(b)

by substituting for the full stop at the end of paragraph (c) the words “; or”;

and

(c)

by inserting after paragraph (c) the following paragraph:

“(d)

direct any other matters as the Registrar thinks necessary or expedient in the interest of the credit reporting industry.”.

Amendment of First Schedule 3.

The First Schedule to the principal Regulations is amended—

(a)

in item A—

(i)

in subitem (d), by substituting for the words “the latest Form 24,

Form 44 and Form 49 of the Companies Act 1965” the words

“company’s profile generated from the system provided by the

Companies

Commission of

Malaysia under the

Companies Act 2016 [Act 777]”; and

(ii)

by substituting for subitem (e) the following subitem:

“(e)

a certified copy of written consent of all directors under section 201 of the Companies Act 2016;”; and

(b)

in item B—

(i)

in subitem (c), by substituting for the words “the latest Form 24,

Form 44 and Form 49 of the Companies Act 1965” the words

“company’s profile generated from the system provided by the

Companies

Commission of

Malaysia under the

Companies Act 2016”; and

(ii)

by substituting for subitem (d) the following subitem:

“(d)

a certified copy of written consent of all directors under section 201 of the Companies Act 2016;”.

Amendment of Second Schedule 4.

The Second Schedule to the principal Regulations is amended in item 4, in column RATE (RM), by deleting the words “maximum limit of RM100,000.00 and”.

Savings 5.

Notwithstanding subregulation 1(2), any document submitted under the

First Schedule, item A, subitem (d) or (e) in relation to an application for registration, or the First Schedule, item B, subitem (c) or (d) in relation to an application for renewal of certificate of registration under the principal Regulations for the period of 31 January 2017 to 31 October 2021 shall, on the coming into operation of these

Regulations, be deemed to have been submitted under the First Schedule, item A, subitem (d) or (e), or the First Schedule, item B, subitem (c) or (d) of the principal

Regulations as amended by these Regulations.
