“Akta” ertinya Akta Juruanalisis Makanan 2011 [Akta 727];
“Majlis” ertinya Majlis Juruanalisis Makanan Malaysia yang ditubuhkan di bawah seksyen 4 Akta;
“Pengerusi” ertinya Pengerusi Jawatankuasa Tatatertib; dan
“Jawatankuasa Tatatertib” ertinya Jawatankuasa Tatatertib yang ditubuhkan di bawah Akta.

Bahagian II
Permohonan bagi pendaftaran
Mana-mana orang yang berhasrat untuk didaftarkan sebagai juruanalisis makanan hendaklah membuat permohonan kepada Majlis dalam
Borang A.
Jika pemohon ialah suatu pertubuhan perbadanan, permohonan hendaklah disempurnakan dan ditandatangani oleh seseorang atau orang yang diberi kuasa dengan sewajarnya bagi maksud itu oleh pertubuhan perbadanan itu.
Apabila permohonan oleh pemohon itu dikemukakan, Majlis boleh dengan budi bicaranya menerima atau menolak permohonan itu.
Pendaftar hendaklah memberitahu pemohon itu akan keputusan
Majlis berhubung dengan permohonan yang dibuat oleh pemohon itu.

Pendaftaran
Apabila suatu permohonan bagi pendaftaran sebagai juruanalisis makanan diluluskan oleh Majlis, juruanalisis makanan hendaklah didaftarkan dalam
Daftar sebagaimana yang dinyatakan dalam Borang B.
Apabila seseorang didaftarkan di bawah Akta ini, Majlis hendaklah mengeluarkan kepada orang itu suatu perakuan pendaftaran sebagaimana yang dinyatakan dalam Borang C.
Majlis boleh mengenakan apa-apa syarat sebagaimana yang difikirkannya patut bagi pengeluaran perakuan pendaftaran dan boleh, dari semasa ke semasa, mengubah, menambah, membatalkan atau meminda syarat yang dikenakan pada perakuan pendaftaran yang dikeluarkan.
Majlis hendaklah menyatakan bidang analisis makanan yang diamalkan oleh juruanalisis makanan berdaftar dalam perakuan pendaftaran itu.
Salinan yang diperakui sah perakuan pendaftaran

hendaklah mempunyai kesan yang sama dengan perakuan yang asal.
Permohonan bagi perakuan amalan tahunan 6.
Jika pemohon ialah suatu pertubuhan perbadanan, permohonan hendaklah disempurnakan dan ditandatangani oleh seseorang atau orang yang diberi kuasa dengan sewajarnya bagi maksud itu oleh pertubuhan perbadanan itu.
Apabila suatu permohonan bagi perakuan amalan tahunan diluluskan,
Pendaftar hendaklah mengeluarkan suatu perakuan amalan tahunan di bawah subseksyen 20(2) Akta sebagaimana yang dinyatakan dalam Borang E.

Pendaftar boleh mengenakan apa-apa syarat yang difikirkannya patut bagi pengeluaran perakuan amalan tahunan dan boleh, dari semasa ke semasa, mengubah, menambah, membatalkan atau meminda syarat-syarat yang dikenakan pada perakuan yang dikeluarkan itu.
Pembaharuan perakuan amalan tahunan 7.
Mana-mana juruanalisis makanan berdaftar yang berniat untuk meneruskan amalan tetapi gagal membuat pembaharuan permohonan sebelum habis tempoh perakuan amalan tahunan itu boleh membuat suatu permohonan kepada Pendaftar dalam Borang G dan hendaklah disertai dengan fi pembaharuan sebagaimana yang dinyatakan dalam Jadual.
Salinan yang diperakui sah perakuan amalan tahunan

hendaklah mempunyai kesan yang sama dengan perakuan yang asal.
Pameran perakuan amalan tahunan, dsb.
Menjalankan amalan selain bidang analisis makanan yang diluluskan
Penyenggaraan dan pengemukaan rekod, dsb.

Bahagian III
Jawatankuasa Tatatertib
Majlis boleh melantik mana-mana orang menjadi anggota
Jawatankuasa Tatatertib.
Jawatankuasa Tatatertib hendaklah terdiri daripada tiga orang anggota dan salah seorang daripada mereka hendaklah dilantik oleh Majlis sebagai
Pengerusi.
tertakluk kepada subperaturan (2), menambah bilangan anggota Jawatankuasa Tatatertib.
Tiada apa-apa perbuatan yang dilakukan atau prosiding yang diambil di bawah peraturan ini boleh dipersoalkan atas alasan mana-mana kekosongan keanggotaan dalam Jawatankuasa Tatatertib itu.

Jawatankuasa Tatatertib.
Jawatankuasa Tatatertib hendaklah bermesyuarat pada apa-apa tarikh dan di mana-mana tempat dan masa yang ditentukan oleh Pengerusi.
Tatatertib hendaklah diputuskan melalui majoriti undi dan sekiranya berlaku bilangan undi yang sama banyak, Pengerusi hendaklah mempunyai undi pemutus.
Jawatankuasa Tatatertib hendaklah mematuhi tatacara
Tatatertib hendaklah mematuhi tatacara yang dinyatakan dalam Peraturan-Peraturan ini.
Jawatankuasa Tatatertib boleh menghendaki suatu penyiasatan

Aduan terhadap juruanalisis makanan berdaftar
Penolakan terus aduan
bahawa walaupun fakta itu adalah benar, fakta itu tidak menjadi suatu perkara tatatertib; atau
bagi sebab yang mesti direkodkan, bahawa terdapat sebab untuk meragui kebenaran aduan itu.
Tatacara siasatan
melalui perintah secara bertulis menghendaki kehadiran pengadu atau mana-mana orang yang didapati mempunyai pengetahuan tentang keadaan itu, di hadapan Jawatankuasa
Tatatertib, pada tarikh dan masa dan di tempat yang akan ditentukan dalam perintah itu; dan

memberitahu juruanalisis makanan berdaftar yang kepadanya pengataan dibuat, kandungan aduan, tarikh, masa dan tempat di mana siasatan aduan itu hendak dibuat, dan haknya untuk hadir bersama atau tanpa peguam, untuk memeriksa balas mana-mana orang yang boleh dipanggil semasa siasatan itu.
jika ia mendapati bahawa tidak ada alasan yang mencukupi untuk menyokong pengataan itu, mengesyorkan kepada Majlis bahawa tiada tindakan perlu diambil; atau
jika ia mendapati bahawa pernyataan itu menyokong pengataan itu, membentuk suatu pertuduhan dan menjelaskan kepada juruanalisis makanan berdaftar bahawa dia bebas menyatakan pembelaannya atas tuduhan yang dibentuk terhadapnya.

Jawatankuasa
Tatatertib hendaklah menentukan perkara mengikut subperaturan (7).
Jika juruanalisis makanan berdaftar memilih untuk membuat pembelaan di hadapan Jawatankuasa Tatatertib, Jawatankuasa Tatatertib hendaklah merekodkan pernyataannya setakat yang boleh, perkataan demi perkataan.
Jawatankuasa Tatatertib hendaklah—
Rekod siasatan hendaklah dikemukakan kepada Majlis 18.
Rekod mana-mana siasatan permulaan oleh Jawatankuasa Tatatertib hendaklah disediakan dan dikemukakan kepada Majlis dalam masa tiga puluh hari selepas selesai apa-apa siasatan itu.
Pengendorsan Majlis 19.
Majlis hendaklah, setelah pendengaran apa-apa rayuan meringankan hukuman, menjalankan mana-mana kuasa tatatertibnya untuk mengenakan apa-apa hukuman di bawah seksyen 25 Akta.

IN exercise of the powers conferred by section 47 of the Food Analysts Act 2011
[Act 727], the Minister, after consultation with the Council makes the following regulations:
PART I
PRELIMINARY
Citation and commencement 1.
(2)
These Regulations come into operation on 15 March 2014.
Interpretation 2.
In these Regulations, unless the context otherwise requires –
“Act” means the Food Analysts Act 2011 [Act 727];
“Council” means the Malaysian Food Analysts Council established under section 4 of the Act;
“Chairman” means Chairman of the Disciplinary Committee; and
“Disciplinary Committee” means a Disciplinary Committee established under the Act.

PART II
REGISTRATION OF FOOD ANALYST
Application for registration 3.
(1)
Any person who is desirous of being registered as a food analyst shall make an application to the Council in Form A.
(2)
Every application for registration as a food analyst shall be accompanied with―
(a)
the registration fee as specified in the Schedule;
(b)
the evidence of qualifications provided in subsection 18(1) of the Act;
(c)
two copies of recent passport size photograph;
(d)
supporting evidence of analysis field; and
(e)
any other information as the Council may require.
(3)
Where the applicant is a body corporate, the application shall be completed and signed by a person or persons duly authorized in that behalf by the body corporate.
(4)
Upon the submission of the application by the applicant, the Council may at its discretion accept or reject the application.
(5)
The Registrar shall notify the applicant the decision of the Council in relation to the application made by the applicant.

Registration 4.
(1)
Upon an application for registration as a food analyst being approved by the Council, a food analyst shall be registered in the Register as specified in
Form B.
(2)
Where a person is registered under this Act, the Council shall issue to him a certificate of registration as specified in Form C.
(3)
The Council may impose any conditions as it thinks fit for the issuance of the certificate of registration and may, from time to time, alter, add, cancel or amend the conditions imposed on the certificate of registration issued.
(4)
The Council shall specify the field of food analysis practised by the registered food analyst in the certificate of registration.
Certified true copy of certificate of registration 5.
(1)
A holder of a certificate of registration may apply in writing to the
Council for a certified true copy of a certificate of registration if the certificate is lost, damaged or mutilated.
(2)
An application under subregulation (1) shall be accompanied with—
(a)
the fee as specified in the Schedule; and
(b)
a copy of a statutory declaration made by the holder of the certificate to the effect that the certificate issued to him is lost, damaged or mutilated.

(3)
The Council may issue a certified true copy of the certificate of registration to the holder of the certificate of registration if the Council is satisfied that the original certificate is lost, damaged or mutilated.
(4)
The copy of the original certificate issued under subregulation (3)
shall have the same effect as the original certificate.
Application for annual practising certificate 6.
(1)
Any registered food analyst who intends to practise as a food analyst shall make an application to the Registrar for an annual practising certificate as specified in Form D.
(2)
Every application for an annual practising certificate shall be accompanied with―
(b)
a copy of the certificate of registration; and
(c)
any other information as the Registrar may require.
(3)
Where the applicant is a body corporate, the application shall be completed and signed by a person or persons duly authorized in that behalf by the body corporate.
(4)
Upon an application for annual practising certificate being approved, the Registrar shall issue an annual practising certificate under subsection 20(2) of the Act as specified in Form E.
(5)
The Registrar may impose any conditions as it thinks fit for the issuance of the annual practising certificate and may, from time to time, alter, add, cancel or amend the conditions imposed on the certificate issued.

Renewal of annual practising certificate
7.
(1)
An annual practising certificate may be renewed upon application being made to the Registrar in Form F and shall be accompanied with the renewal fee as specified in the Schedule not less than thirty days before the expiration of such certificate.
(2)
Any registered food analyst who intends to continue the practice but fails to make renewal application before the expiration of the annual practising certificate may make an application to the Registrar in Form G and shall be accompanied with the renewal fee as specified in the Schedule.
(3)
The Registrar may, when approving the renewal of the annual practising certificate, impose any conditions as he thinks fit.
Certified true copy of annual practising certificate
A holder of an annual practising certificate may apply in writing to the
Registrar for a certified true copy of an annual practising certificate if the certificate is lost, damaged or mutilated.
(2)
An application under subregulation (1) shall be accompanied by—

The Registrar may issue a certified true copy of the annual practising certificate to the holder of the annual practising certificate if the
Registrar is satisfied that the original certificate is lost, damaged or mutilated.

(4)
The copy of the original certificate issued under subregulation (3)
shall have the same effect as the original certificate.
Display of annual practising certificate, etc.
Practising other than a field of food analysis approved 10.
A registered food analyst who practises as food analyst in a field other than the field of food analysis approved by the Council and specified in the certificate of registration and annual practising certificate may be imposed with a disciplinary action.
Maintenance and production of records, etc.

PART III
DISCIPLINARY INQUIRIES
Disciplinary Committee 12.
Disciplinary Commitee.
(2)
The Disciplinary Committee shall consist of three members and one of them as the Chairman who shall be appointed by the Council.
(3)
The Council may at any time–
(a)
revoke the appointment of any member of the Disciplinary
Committee;
(b)
remove any member of the Disciplinary Committee;
(c)
fill any vacancy in the Disciplinary Committee; or
(d)
subject to subregulation (2), increase the number of the
Disciplinary Committee members.
(4)
No act done or proceeding taken under this regulation shall be questioned on the ground of any vacancy of the membership in the Disciplinary
Committee.
(5)
The Chairman shall preside at all meetings of the Disciplinary
Committee.

(6)
The Disciplinary Committee shall meet on such date and at such place and time as the Chairman may determine.
(7)
The quorum of the Disciplinary Committee shall be two.
(8)
All questions raised at meetings of the Disciplinary Committee shall be decided by a majority of votes and in the event of an equality of votes the Chairman shall have a casting vote.

(a)
that the name and address of the complainant is unknown or untraceable;
(b)
that even if the facts were true, the facts do not constitute a disciplinary matter; or
(c)
for reasons which must be recorded, that there is reason to doubt the truth of the complaint.
(2)
The Disciplinary Committee may before making any decision require the complainant to make a statutory declaration of the facts alleged by him.
Procedure of inquiry
17.
(1)
Where the Disciplinary Committee has reason to believe that the complaint is probably true, it shall—
(a)
by order in writing require the attendance of the complainant or any person appears to be acquainted with the circumstances, before the Disciplinary Committee, on a date and time and at a place to be specified therein; and
(b)
inform the registered food analyst whom the allegations are made, the substance of the complaint, the date, time and place at which the inquiry into the complaint shall be made, and of his rights to be present with or without a counsel, to cross-examine such persons who may be called at the inquiry.
(2)
The Disciplinary Committee shall convene on the date, time and place specified in the order and shall proceed to inquire into the allegation made against the registered food analyst.

(3)
The Disciplinary Committee shall examine the complainant or the persons in support of the allegation, who may in turn be cross-examined by the registered food analyst and if necessary reexamined and shall reduce into writing the statement made by the complainant or such persons examined.
(4)
After taking the statements of the complainant or the persons in support of the allegation, the Disciplinary Committee shall—
(a)
if it finds that there are no sufficient grounds to support the allegation, recommend to the Council that no action need to be taken; or
(b)
if it finds that the statement supports the allegation, frame a charge and explain to the registered food analyst that he is at liberty to state his defence on the charge framed against him.
(5)
If the registered food analyst after being informed of his right under subregulation (4) elects not to make a statement, the Disciplinary Committee shall determine the matter in accordance to subregulation (7).
(6)
If the registered food analyst elects to make his defence before the
Disciplinary Committee, the Disciplinary Committee shall record his statement as far as possible, word for word.
(a)
if it finds that there are no sufficient grounds to support the charge, recommend to the Council that no action need to be taken; or

(b)
if it finds that there are grounds to support the charge, recommend to the Council the form of punishment to be imposed on the registered food analyst.

The Council shall, after hearing any plea in mitigation, exercise its disciplinary authority to impose any punishment under section 25 of the Act.
Members who are disqualified from any meeting of the Council inquiring into any disciplinary matter
(a)

(c)
he has appeared before the Disciplinary Committee for the purpose of making any statement;
(d)
he was a member of the committee making preliminary investigation into the complaint; or
