“Pengeksportan dan pengeksportan semula rokok dari Malaysia 21A. (1) Tiada rokok boleh dieksport atau dieksport semula melalui laut atau udara dari Malaysia ke tempat lain di luar Malaysia melainkan rokok itu dieksport atau dieksport semula dalam kontena yang mengikut piawaian

Pertubuhan Penstandardan Antarabangsa.

CUSTOMS ACT 1967

CUSTOMS (AMENDMENT) (NO. 2) REGULATIONS 2020

IN exercise of the powers conferred by section 142

of the

Customs Act 2014 [Act 235], the Minister makes the following regulations:

Citation and commencement 1.

Regulations 2020.

Amendment of regulation 6 2.

The Customs Regulations 2019 [P. U. (A) 397/2019], which is referred to as the

“principal Regulations” in these Regulations, are amended in regulation 6 by inserting after subregulation (2) the following subregulation:

“(3) Notwithstanding subregulation (1), where a goods in the course of transhipment by the sea are cigarettes, the customs ports of the goods shall be—

(a)

at all wharves and jetties of The Port Klang Authority on the west bank of Pulau lndah between Sungai Chandong Besar on the northern west port limit at latitude 02° 55' 48" N longitude 101° 20' 24.5" E and

Sungai Lurus on the southern west limit at latitude 02° 54' 05" N longitude 101° 17' 10"E, Port Klang;

(b)

at all wharves and jetties of the Port Klang Port Authority on the east bank of the Klang Straits between Sungei Tiga and Sungei Puloh,

Port Klang;

(c)

at the left bank of Sungai Pulai at latitude 01° 22' 27.885" U longitude 103° 32' 37. 0024" T to latitude 01° 21' 20.4208" U longitude 103° 32' 56.7317" T, Tanjung Pelepas Port, Johor Bahru;

(d)

at the Kuching Port Authority's wharf at Kampung Senari with a length of 635

metres and width of 45

metres located at latitude 01° 37.01' 0" N longitude 110° 26.89' 0" E, Senari Port,

Kuching;

(e)

at all wharves and jetties of the Sabah Port Authority, Sandakan.”.

Amendment of regulation 9 3.

Regulation 9 of the principal Regulations is amended—

(a)

in subregulation (3)—

(i)

by deleting the word “and” at the end of paragraph (a);

(ii)

by substituting for the full stop at the end of the paragraph (b) the words “; and”; and

(iii)

by inserting after paragraph (b) the following paragraph:

“(c) shall not be warehoused except with the approval of the

Director

General, subject to any conditions as the

Director General may impose in any customs warehouse, licensed warehouse or any place approved by the

Director General.”; and

(b)

by inserting after subregulation (3) with the following subregulation:

“(3A) Permission in paragraph (3)(b) shall not apply to cigarettes.”.

Amendment of regulation 17 4.

Subregulation 17(1) of the Principal regulations is amended by substituting for the words “Where any goods” the words “For the purpose of paragraph 9(3)(c), where any goods”.

New regulation 21A

The principal Regulations is amended by inserting after regulation 21 the following regulation:

“Exportation and re-exportation of cigarette from Malaysia 21A. (1) No cigarette may be exported or re-exported by sea or air from Malaysia to another place outside Malaysia unless that cigarette be exported or re-exported in containers that conforms to the specifications by the International Organisation for Standardization.

Amendment of regulation 43 6.

Regulation 43 of the principal Regulations is amended—

(a)

in subregulation (1), by inserting after the words “as the Director General may determine” the words “at least ninety days before the importation”; and

(b)

in subregulation (2), by substituting for the words “two thousand four hundred ringgit” the words “four thousand eight hundred ringgit”.

Amendment of regulation 56 7.

Regulation 56 of the principal Regulations is amended—

(b)

by inserting after the renumbered subregulation

(1)

the following subregulation:

“(2) Subject to subregulation (1), where the drawback under section 93 of the Act is in relation to exportation and re-exportation of cigarettes, that cigarettes shall be exported or re-exported by sea or air from free zones.”.

Amendment of Second Schedule 8.

The Second Schedule to the principal Regulations is amended, in relation to Part I, in respect of Pahang, by inserting after item Kg. Lalang, Pulau Tioman and the particulars relating to it the following item and particulars:
