Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 36 Akta Makanan 1983 [Akta 281], Menteri membuat peraturan-peraturan yang berikut: Nama
Seksyen 2
Pindaan subperaturan 11(1)
Peraturan-Peraturan Kawalan Hasil Tembakau 2004 [P.U. (A) 324/2004], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam subperaturan 11(1) dengan memotong perenggan (f).
Pindaan peraturan 12
Seksyen 3
Peraturan 12 Peraturan-Peraturan ibu dipinda—
(i)
dengan memasukkan selepas perkataan “peraturan 11” perkataan “atau tuan punya atau penghuni mana-mana bangunan, premis atau tempat yang diisytiharkan oleh Menteri melalui pemberitahuan dalam Warta di bawah peraturan 22”;
(ii)
dalam perenggan (a), dengan memasukkan selepas perkataan
“kenderaan” perkataan "atau bangunan atau di mana-mana laluan masuk tempat”;
(iii)
dalam perenggan (b), dengan memasukkan selepas perkataan
“kenderaan” perkataan "atau dalam bangunan atau tempat”; dan
(i)
dengan memasukkan selepas perkataan “penghuni premis,” perkataan
“bangunan atau tempat,”; dan 3
(ii)
dengan memasukkan selepas perkataan “di dalam premis” perkataan
“, bangunan atau tempat”.
Seksyen 4
Pindaan peraturan 21
Peraturan 21 Peraturan-Peraturan ibu dipinda dengan memasukkan selepas subperaturan (3) subperaturan yang berikut:
“(4) Walau apa pun subperaturan (1), peraturan ini hendaklah tidak terpakai kepada mana-mana bangunan atau premis atau tempat yang diisytiharkan oleh Menteri melalui pemberitahuan dalam Warta di bawah peraturan 22.”.

Pindaan peraturan 22
Peraturan-Peraturan ibu dipinda dengan menggantikan peraturan 22 dengan peraturan yang berikut:
“Menteri boleh melarang merokok dalam sesuatu bangunan ,premis atau tempat

(1)
Walau apa pun subperaturan 11(1), Menteri boleh, melalui pemberitahuan dalam Warta dan tertakluk kepada apa-apa syarat yang difikirkannya patut, mengisytiharkan mana-mana bangunan atau premis, atau bahagian bangunan atau premis itu, atau sesuatu tempat atau bahagian tempat itu, yang orang awam mempunyai akses sebagai kawasan atau tempat yang dilarang merokok.
(2)
Tiada seorang pun boleh merokok di dalam mana-mana bangunan, premis atau tempat yang disytiharkan oleh Menteri di bawah subperaturan (1).
(3)
Mana-mana orang yang melanggar subperaturan (2) melakukan suatu kesalahan dan apabila disabitkan boleh didenda tidak melebihi sepuluh ribu ringgit atau dipenjara selama tempoh tidak melebihi dua tahun.”.
Pindaan Jadual Ketiga
Seksyen 6
Peraturan-Peraturan ibu dipinda dengan menggantikan Jadual Ketiga dengan
Jadual yang berikut:

Suatu bulatan tebal dan tanda palang tebal berwarna merah yang menindih rokok berwarna hitam yang dinyalakan hendaklah digunakan sebagai ilustrasi pada papan tanda. Papan tanda itu hendaklah mempunyai latar belakang berwarna putih.

MEROKOK”
hendaklah ditulis pada papan tanda itu.
Huruf pesanan hendaklah berwarna hitam dan jenis huruf ialah Arial.

CONTROL OF TOBACCO PRODUCT (AMENDMENT) REGULATIONS 2012
Opening note
Preamble
- IN exercise of the powers conferred by section 36 of the Food Act 1983 [Act 281], the Minister makes the following regulations: Citation 1. These regulations may be cited as the Control of Tobacco Product (Amendment) Regulations 2012. Amendment of subregulation 11(1)
Seksyen 2
The Control of Tobacco Product Regulations 2004 [P.U. (A) 324/2004], which are referred to as the “principal Regulations” in these Regulations, are amended in subregulation 11(1) by deleting paragraph (f).
Amendment of regulation 12 3.
Regulation 12 of the principal Regulations is amended—
(i)
by inserting after the words “regulation 11” the words “or the proprietor or occupier of any building, premise or place declared by the Minister by notification in the Gazette under regulation 22”;
(ii)
in paragraph (a), by inserting after the word “vehicle” the words
“or the building or at any entrance to the place”;
(iii)
in paragraph (b), by inserting after the word “vehicle” the words
“or in the building or the place”; and
(i)
by inserting after the words “occupier of the premise,” the words
“building or place,”; and

(ii)
by inserting after the words “in the premise” the words “, building or the place”.
Amendment of regulation 21
Seksyen 4
Regulation 21 of the principal Regulations is amended by inserting after subregulation (3) the following subregulation:
“(4)
Notwithstanding subregulation (1), this regulation shall not apply to any building or premise or place declared by the Minister by notification in the Gazette under regulation 22.”.
Amendment of regulation 22 5.
The principal Regulations are amended by substituting for regulation 22 the following regulation:
“Minister may prohibit smoking in a building, premise or place

(1)
Notwithstanding subregulation 11(1), the Minister may, by notification in the Gazette and subject to any conditions as he deems fit, declare any building or premise, or part of the building or premise, or a place or part of the place, where public have access as an area or place where smoking is prohibited.
(2)
No person shall smoke in any building, premise or place declared by the Minister under subregulation (1).
(3)
Any person who contravenes subregulation (2) commits an offence and shall on conviction be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding two years.”.
Amendment of Third Schedule 6.
The principal Regulations are amended by substituting for Third Schedule the following Schedule:

The signboard shall have a white background.
The message

MEROKOK” shall be written on the signboard.
The lettering of the message shall be black in colour and the type of lettering shall be Arial.
