Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan
Kawalan Hasil Tembakau (Pindaan) 2013.
Kecuali peraturan 15, 16, 16A dan 21A, Peraturan-Peraturan ini mula berkuat kuasa pada 15 Jun 2013.

Pindaan peraturan 2
Peraturan-Peraturan Kawalan Hasil Tembakau 2004 [P.U. (A) 324/2004], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam peraturan 2, dalam takrif “karton”, dengan menggantikan perkataan “dua atau lebih”
dengan perkataan “sepuluh”.
Peraturan baru 5A
peraturan yang berikut:
mempromosikan penjualan apa-apa hasil tembakau secara langsung atau tidak langsung; atau

menggunakan mana-mana orang sama ada melalui apa-apa kontrak, perjanjian, persefahaman atau persetujuan, sama ada terikat di sisi undang-undang atau selainnya, mempromosikan jualan apa-apa hasil tembakau secara langsung atau tidak langsung.
Mana-mana orang yang melanggar subperaturan (1) melakukan suatu kesalahan dan apabila disabitkan boleh didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.”.

Pengilang atau pengimport itu hendaklah mengemukakan permohonan secara bertulis kepada Pengarah pada tiap-tiap kali berlakunya suatu perubahan kepada harga jualan runcit apa-apa hasil tembakau yang disebut dalam subperaturan (1) disebabkan oleh apa-apa kenaikan harga jualan runcit suatu hasil tembakau itu.”; dan

mana-mana kawasan sesuatu premis adalah merujuk kepada keseluruhan kawasan premis itu, termasuk mana-mana kawasan di dalam bangunan dan kawasan sekitar bangunan itu yang berada di dalam lingkungan sempadan pagar atau tanah lot premis itu;
mana-mana kawasan dalam suatu bangunan adalah merujuk kepada mana-mana kawasan di dalam bangunan itu dan termasuklah kawasan kaki lima bangunan di dalam sempadan kawasan litupan bumbung kekal kawasan bangunan itu, dan juga termasuklah kawasan yang dilitupi oleh apa-apa bumbung kekal tambahan yang bersambungan dengan bangunan utama itu; dan
mulai 1 Januari 2014, mana-mana kawasan dalam suatu bangunan adalah merujuk kepada mana-mana kawasan di dalam bangunan itu dan termasuklah kawasan kaki lima dan di dalam lingkungan jarak tiga meter daripada garisan bangunan itu, dan termasuklah kawasan litupan apa-apa bumbung kekal tambahan yang bersambungan dengan bangunan utama itu.”.

Peraturan 15 Peraturan-Peraturan ibu dipinda―
dalam subperenggan (a)(ii), dengan menggantikan perkataan

Tiada seorang pun boleh menjual atau menawarkan untuk menjual, membeli atau berada dalam milikannya apa-apa paket rokok atau karton rokok yang tidak dicetak dengan set teks dan imej amaran kesihatan sebagaimana yang dinyatakan dalam Jadual Kelima.”.

Peraturan-Peraturan ibu dipinda dengan menggantikan peraturan 16 dengan peraturan yang berikut:
“Pembungkusan rokok 16.
Pengilang hendaklah membungkus rokok di dalam suatu paket yang mengandungi hanya dua puluh batang rokok atau di dalam suatu karton yang mengandungi hanya sepuluh paket rokok.
Mana-mana orang yang dalam menjalankan apa-apa perniagaan atau urus niaga membekalkan atau menawarkan untuk membekal apa-apa rokok di dalam mana-mana paket atau karton hendaklah mematuhi subperaturan (1), peraturan 15, 15A, 15B, 15C dan 16A .
Mana-mana orang yang melanggar subperaturan (1) atau (2)
melakukan suatu kesalahan dan apabila disabitkan boleh didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.”.

Peraturan 16A Peraturan-Peraturan ibu dipinda dengan menggantikan subperaturan (2) dengan subperaturan yang berikut:

larangan termasuklah, tetapi tidak terhad kepada penggunaan apa-apa istilah, perkataan atau perihalan seperti “light”, “ultra light”,
“mild”, “cool”, “extra”, “low tar”, “special”, “full flavour”, “premium”,
“rich”, “famous”, “slim”, “gred A” atau apa-apa istilah, perkataan, atau perihalan atau perkataan lain yang sama erti dengannya yang secara langsung atau tidak langsung mewujudkan tanggapan yang salah atau palsu bahawa sesuatu hasil tembakau itu adalah kurang berbahaya daripada suatu hasil tembakau yang lain; dan
larangan juga termasuk apa-apa istilah, perkataan, perihalan, tuntutan, representasi atau grafik yang menyatakan penggredan, kualiti atau keunggulan hasil tembakau itu atau yang menarik atau yang tiada kaitan dengan ciri-ciri fizikal hasil tembakau itu atau apa-apa perkataan yang mempunyai maksud bagi tujuan mempromosikan penjualan atau pelupusan suatu hasil tembakau secara langsung atau tidak langsung.”.
Pindaan peraturan 21A
Bagi maksud subperaturan (1)―
dalam subperaturan (1) dengan memasukkan selepas perkataan “tar”
perkataan “atau karbon monoksida”; dan
dengan menggantikan subperaturan (2) dengan subperaturan yang berikut:
“(2)
Bagi maksud subperaturan (1)―
paras maksimum yang dibenarkan bagi nikotina adalah 1.3 mg bagi sebatang rokok, paras maksimum yang

dibenarkan bagi tar adalah 15 mg bagi sebatang rokok dan paras maksimum bagi karbon monoksida adalah 15 mg bagi sebatang rokok; dan
mulai 1 Jun 2015, paras maksimum yang dibenarkan bagi nikotina adalah 1.0 mg bagi sebatang rokok, paras maksimum yang dibenarkan bagi tar adalah 10 mg bagi sebatang rokok dan paras maksimum bagi karbon monoksida adalah 10 mg bagi sebatang rokok.”.

Subperaturan 23(1) Peraturan-Peraturan ibu dipinda dengan memasukkan selepas perkataan “14(1)” perkataan “15(4A)”, dan selepas perkataan “21(2)”, perkataan “22(2)”.

CONTROL OF TOBACCO PRODUCT (AMENDMENT) REGULATIONS 2013
Opening note
These regulations may be cited as the Control of Tobacco Product
(Amendment) Regulations 2013.
Except for regulations 15, 16, 16A and 21A, these Regulations come into operation on 15 June 2013.
Subregulations 15, 16, 16A and 21A come into operation on 1 January 2014.
Amendment of regulation 2 2.
The Control of Tobacco Product Regulations 2004 [P.U. (A) 324/2004], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 2, in the definition for “carton”, by substituting for the words “two or more”
the word “ten”.
New regulation 5A
The principal Regulations are amended by inserting after regulation 5 the following regulation:
“Prohibition on sale of tobacco product by promotion
No person shall―
promote the sale of any tobacco product directly or indirectly; or

engage any person whether by way of contract, agreement, understanding or undertaking, whether binding or otherwise, promote the sale of any tobacco product directly or indirectly.
Any person who contravenes subregulation (1) commits an offence and shall on conviction be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding two years or to both.”.
Amendment of regulation 8 4.
Subregulation 8(2) of the principal Regulations is amended by inserting after the word “years” the words “or to both”.
Amendment of regulation 8A
Regulation 8A of the principal Regulations is amended―
by substituting for subregulation (2) the following subregulation:
“(2) The manufacturer or importer shall submit an application in writing to the Director every time there is a change to the retail selling price of any tobacco product referred to in subregulation (1) due to any increase in the retail selling price of the tobacco products.”; and
Regulation 8C of the principal Regulations is amended by substituting for subregulation (1) the following subregulation:
“(1) The minimum cigarette price for each packet of twenty sticks cigarettes shall be RM 7.00.”.

Amendment of regulation 8D
Subregulation 8D(1) of the principal Regulations is amended by substituting for the words “for that packet of cigarettes as specified in the Ninth Schedule” the words “as specified in subregulation 8C(1)”.
Amendment of regulation 9 8.
Subregulation 9(1) of the principal Regulations is amended―
by inserting the word “only” before the word “twenty”.
Amendment of regulation 11 9.
Subregulation 11(1) of the principal Regulations is amended―
in paragraphs (b), (h) and (q), by inserting after the word “any” the words
“area of a”;
in paragraph (i), by inserting after the words “or residential building” the words “or in any public place”;
in paragraphs (j), (k), (o), (p), (r) , (s) and (t), by substituting for the word
“in” appearing after the word “area” the word “of”;
in paragraph (n), by substituting for the word “in” appearing after the word “area” the word “of”; and
by inserting after subregulation (1), the following subregulation:
“(1A) For the purpose of subregulation (1)—
any area of a premises refers to the whole area of the premises including any area inside the building and the

surrounding area of the building which is within the borders of the fence or the land lot of the premises;
any area in a building refers to any area inside the building and includes the five-foot way within the border of the permanent roof covered area of the building, and also includes the area covered by any additional permanent roof that is connected to the main building; and
beginning 1 January 2014, any area in a building refers to any area inside the building and includes the five-foot way and within three meters from the distance of the building line, and also includes the area covered by any additional permanent roof that is connected to the main building.”.
Amendment of regulation 15 10.
Regulation 15 of the principal Regulations is amended―
in subparagraph (a)(ii), by substituting for the word “forty” the word “fifty”; and
in subparagraph (b)(ii), by substituting for the word “forty” the word “fifty”; and
by inserting after subregulation (4) the following subregulation:
“(4A) No person shall sell or offer for sale, buy or has in his possession any packet or carton of cigarette that is not printed with the texts set and health warning images as specified in the Fifth Schedule.”.

Amendment of regulation 16 11.
The principal Regulations are amended by substituting for regulation 16 the following regulation:
“Packaging of cigarette 16.
The manufacturer shall pack the cigarette in a packet containing only twenty sticks of cigarette or in a carton containing only ten packets of cigarette.
Any person who in the course of any trade or business supplies or offers to supply any cigarette in any packet or carton shall comply with subregulation (1), regulations 15, 15A, 15B, 15C and 16A.
Any person who contravenes subregulation (1) or (2) commits an offence and shall on conviction be liable to a fine not exceeding ten thousand ringgit or to imprisonment for term not exceeding two years or to both.”.
Amendment of regulation 16A
Regulation 16A of the principal Regulations is amended by substituting for subregulation (2) the following subregulation:
“(2)
the prohibition includes, but not limited to the use of any term, word or descriptor such as “light”, “ultra light”, “mild”, “cool”,
“extra”, “low tar”, “special”, “full flavour”, “premium”, “rich”,
“famous”, “slim”, “grade A” or any term, word or descriptor or any other words of similar meaning that directly or indirectly create an erroneous or false impression that a particular tobacco product is less harmful than the other tobacco products; and
the prohibition also includes any term, word, description, claim, representation or graphic that states the grading, quality or

supremacy of the product or is fanciful or that is not relevant to the physical characteristics of the tobacco product or any other words that is meant for the purpose of promoting directly or indirectly the sale or disposal of the tobacco product.”.
Amendment of regulation 21A
For the purpose of subregulation (1)—
in subregulation (1), by inserting after the word “tar” the words “or carbon monoxide”; and
by substituting for subregulation (2) the following subregulation:
“(2)
For the purpose of subregulation (1)—
the maximum allowable level for nicotine shall be 1.3 mg per cigarette, the maximum allowable level for tar shall be 15 mg per cigarette and the maximum allowable level for carbon monoxide shall be 15 mg per cigarette; and
beginning 1 June 2015, the maximum allowable level for nicotine shall be 1.0 mg per cigarette, the maximum allowable level for tar shall be 10 mg per cigarette and the maximum allowable level for carbon monoxide shall be 10 mg per cigarette. ”.
Amendment of regulation 23 14.
Subregulation 23(1) of the principal Regulations is amended by inserting after the words “14(1)” the words “15(4A)”, and after the words “21(2),” the words “22(2)”.
Amendment of Fifth Schedule 15.
The principal Regulations are amended in the Fifth Schedule by inserting after health warning 6 the following health warnings:
