- PADA menjalankan kuasa yang diberikan oleh seksyen 36 Akta Makanan 1983 [Akta 281], Menteri membuat peraturan-peraturan yang berikut: Nama

Pindaan peraturan 2
Peraturan-Peraturan Kawalan Hasil Tembakau 2004 [P.U. (A) 324/2004], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam peraturan 2—
(a)
dengan memasukkan sebelum takrif “harga jualan runcit” takrif yang berikut:
‘ “cerut” ertinya suatu gulung tembakau yang dibungkus dalam daun tembakau atau dalam bahan yang mengandungi tembakau;’;
(i)
dengan menggantikan perkataan “segi empat tepat” dengan perkataan “kuboid”; dan
(c)
dengan menggantikan takrif “paket” dengan takrif yang berikut:
‘ “paket” ertinya suatu pek yang berbentuk kuboid bagi rokok, atau suatu pek yang berbentuk silinder, kuboid atau bungkusan bagi hasil tembakau selain rokok, mengikut mana-mana yang berkenaan;’; dan

(d)
dalam takrif “rokok”, dengan menggantikan perkataan “yang digulung di dalam pembalut kertas tunggal atau lebih, dan yang boleh digunakan dengan serta-merta untuk merokok” dengan perkataan “yang digulung dalam apa-apa pembalut, dan yang digunakan untuk merokok”.

Seksyen 3
Peraturan 8A Peraturan-Peraturan ibu dipinda—
(a)
dalam subperaturan (5A), dengan memasukkan selepas perkataan
“subperaturan 8C(2)” perkataan “dan 8F(2)”; dan
(b)
dalam subperaturan (5B), dengan menggantikan perkataan “rokok dan karton” dengan perkataan “atau karton hasil tembakau”.
Pindaan peraturan 8C
Seksyen 4
Peraturan 8C
Peraturan-Peraturan ibu dipinda dengan menggantikan subperaturan (1) dengan subperaturan yang berikut:
“(1) Tiada seorang pun boleh menjual atau menawarkan untuk jualan apa-apa paket dua puluh batang rokok di bawah harga minimum dua belas ringgit. ”.
Seksyen 5
Peraturan baharu 8F
Peraturan-Peraturan ibu dipinda dengan memasukkan selepas peraturan 8E peraturan yang berikut:
“Harga minimum cerut
Seksyen 8F
(1)
Tiada seorang pun boleh menjual atau menawarkan untuk jualan apa-apa cerut di bawah harga minimum dua belas ringgit bagi setiap paket.
(2)
Bagi maksud subperaturan (1)—
(a)
apa-apa cerut dengan harga jualan runcit yang telah diluluskan kurang daripada harga minimum yang dinyatakan dalam

subperaturan (1), hendaklah dijual dengan harga minimum jualan runcit itu; dan
(b)
apa-apa cerut dengan harga jualan runcit yang telah diluluskan sama dengan atau lebih daripada harga minimum yang dinyatakan dalam subperaturan (1), hendaklah dijual dengan harga jualan runcit yang diluluskan.
(3)
Mana-mana orang yang melanggar peraturan ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi dua tahun atau kedua-duanya.”.

CONTROL OF TOBACCO PRODUCT REGULATIONS (AMENDMENT) 2020
Opening note
Preamble
- IN exercise of the powers conferred by section 36 the Food Act 1983 [Act 281], the Minister makes the following regulations: Citation 1. These regulations may be cited as the Control of Tobacco Product (Amendment) Regulations 2020. Amendment of regulation 2 2. The Control of Tobacco Product Regulations 2004 [P.U. (A) 324/2004], which are referred to as the “principal Regulations" in these Regulations, are amended in regulation 2—
(a)
by inserting before the definition of “retail selling price” the following definition:
‘ “cigar” means a roll of tobacco wrapped in a leaf tobacco or in a substance that contains a tobacco;’;
(i)
by substituting for the word “rectangular” the word “cuboid”; and
(c)
by substituting for the definition of “packet” with the following definition:
‘ “packet” means a pack which is cuboid in shape for cigarette, or a pack which is cylindrical, cuboid or package in shape for tobacco product other than cigarette, as the case may be;’; and

(d)
in the definition of “cigarette”, by substituting for the words “rolled up in a single or more wrapper of paper, and which is capable of being immediately used for smoking” the words “rolled up in any wrapper, and which is used for smoking”.
Amendment of regulation 8A
Seksyen 3
Regulation 8A of the principal Regulations is amended—
(a)
in subregulation (5A), by inserting after the words “subregulation 8C(2)”
the words “and 8F(2)”; and
(b)
in subregulation (5B), by substituting for the words “of cigarette and carton” the words “or carton of tobacco product”.
Amendment of regulation 8C
Seksyen 4
Regulation 8C of the principal Regulations is amended by substituting subregulation (1) with the following subregulation:
“(1) No person shall sell or offer for sale any packet of twenty sticks of cigarettes below the minimum price of twelve ringgit.”.
Seksyen 5
New regulation 8F
The principal Regulations are amended by inserting after regulation 8E the following regulation:
“Minimum cigar price
Seksyen 8F
(1)
No person shall sell or offer for sale any cigar below the minimum price of twelve ringgit for each packet.
(2)
For the purposes of subregulation (1)—
(a)
any cigar with an approved retail selling price less than the minimum price specified in subregulation (1), shall be sold at the retail selling price of the minimum price; and

(b)
any cigar at an approved retail selling price equivalent to or more than the minimum price specified in subregulation (1), shall be sold at the approved retail selling price.
(3)
Any person who contravenes this regulation commits an offence and shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding two years or to both.”.
