Opening note
Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan
Kawalan Produk Merokok Demi Kesihatan Awam (Pendaftaran Produk Tembakau,
Bahan Merokok dan Produk Pengganti Tembakau) 2024.
Peraturan-Peraturan ini hendaklah mula berkuat kuasa pada 1 Oktober 2024.
Permohonan bagi pendaftaran
Permohonan bagi pendaftaran produk tembakau, bahan merokok atau produk pengganti tembakau di bawah seksyen 4 Akta hendaklah dibuat dalam borang sebagaimana yang ditentukan oleh Ketua Pengarah.
Permohonan yang disebut dalam subperaturan (1) hendaklah disertakan dengan—
laporan analisis makmal yang dijalankan oleh makmal yang diluluskan terhadap produk tembakau, bahan merokok atau produk pengganti tembakau;
ringkasan laporan analisis makmal yang dirujuk dalam perenggan (b) dalam borang sebagaimana yang dinyatakan dalam
Jadual;

cara gaya produk tembakau, bahan merokok atau produk pengganti tembakau itu; dan
apa-apa dokumen lain yang dikehendaki Ketua Pengarah untuk mengesahkan identiti pemohon dan mengenal pasti tujuan pendaftaran.
Semasa mempertimbangkan permohonan yang disebut dalam subperaturan (1), Ketua Pengarah boleh menghendaki pemohon itu untuk mengemukakan sampel produk tembakau, bahan merokok atau produk pengganti tembakau yang hendak didaftarkan dalam apa-apa tempoh sebagaimana yang dinyatakan oleh Ketua Pengarah.
Permohonan hendaklah dianggap telah ditarik balik jika pemohon tidak mematuhi kehendak di bawah subperaturan (1), (2) dan (3).
Ketua Pengarah boleh, selepas mempertimbangkan permohonan bagi pendaftaran—
meluluskan permohonan itu, dengan atau tanpa syarat, secara bertulis dan mengeluarkan dokumen pendaftaran kepada pemohon;
atau
Jika produk tembakau, bahan merokok atau produk pengganti tembakau boleh dibezakan oleh sebab bau, perisa, saiz, bentuk, sebatian, bahan, proses pengilangan atau lokasi pengilang, permohonan berasingan bagi pendaftaran produk tembakau, bahan merokok atau produk pengganti tembakau, mengikut mana-mana yang berkenaan, hendaklah dibuat mengikut peraturan 2.

Fi pendaftaran
Fi bagi setiap permohonan bagi pendaftaran produk tembakau, bahan merokok atau produk pengganti tembakau ialah lima ribu ringgit.
Pemberitahuan oleh pengimport atau pengilang berikutnya selepas pendaftaran
Mana-mana orang yang berniat untuk mengimport atau mengilang produk tembakau, bahan merokok atau produk pengganti tembakau yang telah didaftarkan oleh orang lain hendaklah, sebelum mengimport atau mengilang produk tembakau, bahan merokok atau produk pengganti tembakau itu, memberitahu Ketua Pengarah mengenai niatnya untuk mengimport atau mengilang produk tembakau, bahan merokok atau produk pengganti tembakau tersebut dalam bentuk yang ditentukan oleh
Ketua Pengarah.

Ketua Pengarah boleh menghendaki orang yang memberi pemberitahuan dan orang yang di bawahnya produk tembakau, bahan merokok atau produk pengganti tembakau itu didaftarkan untuk mengemukakan maklumat dan dokumen yang difikirkan perlu oleh
Ketua Pengarah untuk menentukan kebenaran pemberitahuan itu.
Jika Ketua Pengarah berpuas hati dengan kebenaran pemberitahuan itu,
Ketua Pengarah boleh menyebabkan maklumat orang yang memberi pemberitahuan dan tujuan pemberitahuan untuk direkodkan dalam daftar produk tembakau, bahan merokok atau produk pengganti tembakau dan memaklumkan orang itu mengenai rekod tersebut secara bertulis.
Pemberitahuan perubahan dalam butir-butir perhubungan
Mana-mana orang yang pendaftarannya diluluskan hendaklah memberitahu Ketua Pengarah mengenai apa-apa perubahan dalam nama, alamat atau butir-butir perhubungan lain orang itu dalam masa empat belas hari dari tarikh perubahan itu.

Ketua Pengarah boleh menghendaki orang itu untuk mengemukakan maklumat lanjut

yang difikirkan perlu oleh Ketua Pengarah untuk memastikan ketepatan maklumat yang disimpan dalam daftar.
Ketua Pengarah boleh mengeluarkan dokumen pendaftaran baharu yang menunjukkan perubahan dalam nama, alamat atau butir-butir perhubungan lain orang itu jika Ketua Pengarah berpuas hati bahawa pengeluaran itu adalah perlu untuk mengelakkan salah nyata atau kekeliruan.
Pendaftaran tidak boleh dipindahkan
Pendaftaran atau dokumen pendaftaran yang dikeluarkan bukan suatu harta dan tidak boleh dipindahkan atau diserahhakkan.

CONTROL OF SMOKING PRODUCTS FOR PUBLIC HEALTH ACT 2024
CONTROL OF SMOKING PRODUCTS FOR PUBLIC HEALTH (REGISTRATION OF
TOBACCO PRODUCT, SMOKING SUBSTANCE AND SUBSTITUTE TOBACCO PRODUCT)
REGULATIONS 2024
IN exercise of the powers conferred by subsection 53(2)
of the
Control of Smoking Products For Public Health Act 2024 [Act 852], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Control of Smoking Products For
Public Health (Registration of Tobacco Product, Smoking Substance and Substitute
Tobacco Product) Regulations 2024.
(2)
These Regulations shall come into operation on 1 October 2024.
Application for registration 2.
(1)
An application for the registration of a tobacco product, smoking substance or substitute tobacco product under section 4 of the Act shall be made in the form as determined by the Director General.
(2)
The application referred to in subregulation (1) shall be accompanied by—
(a)
payment of the fee as specified in regulation 4;
(b)
a report of laboratory analysis carried out by an approved laboratory on the tobacco product, smoking substance or substitute tobacco product;
(c)
a summary of the laboratory analysis report referred to in paragraph (b) in the form as specified in the Schedule;

(d)
the get-up of the tobacco product, smoking substance or substitute tobacco product; and
(e)
any other document as the Director General may require to verify the identity of the applicant and identify the purposes of registration.
(3)
In considering an application referred to in subregulation (1), the
Director General may require the applicant to furnish a sample of the tobacco product, smoking substance or substitute tobacco product sought to be registered within any period as specified by the Director General.
(4)
An application shall be deemed to have been withdrawn if the applicant fails to comply with the requirements under subregulations (1), (2) and (3).
(5)
The Director General may, after considering the application for registration—
(a)
approve the application, with or without condition, in writing and issue a registration document to the applicant; or
(b)
reject the application in writing.
Separate application 3.
Where a tobacco product, smoking substance or substitute tobacco product is distinguishable by reason of its smell, flavour, size, form, blend, ingredients, manufacturing process or location of manufacture, a separate application for the registration of the tobacco product, smoking substance or substitute tobacco product, as the case may be, shall be made in accordance with regulation 2.
Registration fee 4.
The fee for each application for the registration of tobacco product, smoking substance or substitute tobacco product is five thousand ringgit.

Notification by subsequent importer or manufacturer after registration 5.
(1)
Any person who intends to import or manufacture a tobacco product, smoking substance or substitute tobacco product which has been registered by another person shall, prior to importing or manufacturing the tobacco product, smoking substance or substitute tobacco product, notify the Director General of his intention to import or manufacture the tobacco product, smoking substance or substitute tobacco product in the form as determined by the Director General.
(2)
Upon receiving a notification under subregulation (1), the Director General may require the person who gives the notification and the person under whom the tobacco product, smoking substance or substitute tobacco product is registered to furnish information and documents as the Director General deems necessary to determine the veracity of the notification.
(3)
If the Director General is satisfied with the veracity of the notification, the
Director General may cause the information of the person giving the notification and the purpose of notification to be recorded in the register of tobacco product, smoking substance or substitute tobacco product and inform the person in writing of the record.
Notification of change in contact details 6.
(1)
Any person whose registration is approved shall notify the Director
General of any change in the name, address or other contact details of the person within fourteen days from the date of the change.
(2)
Upon receiving the notification under subregulation (1), the Director
General may require the person to furnish further information as the Director General deems necessary to ensure the accuracy of information kept in the register.
(3)
The Director General may issue to the person a new registration document which reflects the change in the name, address or other contact details of the person if the Director General is satisfied that such issuance is necessary to avoid misrepresentation and confusion.

Registration is not transferrable 7.
A registration or registration document issued is not a property and shall not be transferable or assignable.
