TRADE UNIONS (AMENDMENT) REGULATIONS 2024

IN exercise of the powers conferred by section 58 of the Trade Unions Act 1959 [Act 262], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Trade Unions (Amendment)

Regulations 2024.

(2)

These Regulations come into operation on 15 September 2024.

Amendment of regulation 3 2.

The Trade Unions Regulations 1959 [P.U. (A) 390/1982], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 3 by deleting the word “substantially”.

Substitution of regulation 4 3.

The principal Regulations are amended by substituting for regulation 4

the following regulation:

“Application for registration.

4.

Every application made under subsection 10(1)

of the Act for the registration of a trade union shall clearly indicates the scope of membership intended to be represented by such union and shall be in the Form B set out in the First Schedule hereto and shall be submitted to the Director General.”.

Amendment of regulation 5 4.

Regulation 5 of the principal Regulations is amended—

(a)

in subregulation (1), by substituting for the words “subscribed by the signature of” the words “certified by”;

(b)

in subregulation (2), by substituting for the word “initialled” the word

“certified”; and

(c)

in subregulation (3), by substituting for the word “initialled” the word

“certified”.

Amendment of regulation 7 5.

Regulation 7 of the principal Regulations is amended—

(a)

by inserting after the word “section 13” the words “of the Act”; and

(b)

by deleting the word “substantially”.

Deletion of regulation 8 6.

The principal Regulations are amended by deleting regulation 8.

Amendment of regulation 10 7.

Regulation 10 of the principal Regulations is amended—

(a)

in the marginal note, by inserting after the words “to cancel” the words

“or withdraw”;

(b)

by inserting after the words “to cancel” the words “or withdraw”; and

(c)

by substituting for the words “section 15 (1) (b) or 15 (2) (a) cause a notice to be served on the trade union substantially”

Amendment of regulation 11 8.

Regulation 11 of the principal Regulations is amended by inserting after the word

“cancelling” the words “or withdrawing”.

Amendment of regulation 12 9.

Subregulation 12(1) of the principal Regulations is amended by substituting for the words “section 31 shall be given in duplicate substantially” the words “section 31 of the Act shall be given”.

Amendment of regulation 13 10.

Regulation 13 of the principal Regulations is amended—

(a)

in the marginal note, by substituting for the words “Notice of amalgamation.” the words “Notice and registration of amalgamated unions.”;

(b)

by substituting for subregulation (1) the following subregulation:

“(1)

Notice of every amalgamation of trade unions under section 32 of the Act shall be given in the Form H set out in the

First Schedule together with the following:

(a)

return of the ballot result on the resolution to amalgamate in Form U set out in the First Schedule;

(b)

a printed copy of the rules of the amalgamated trade union in the national language;

(c)

a copy of minutes of the meeting approving the intended rules to be adopted; and

(d)

certificate of registration of each trade union intended to be amalgamated.”; and

(c)

in subregulation (2)—

(i)

by deleting the marginal note to the subregulation; and

(ii)

by substituting for the words “section 34 (4)” the words

“subsection 34(4) of the Act”.

Amendment of regulation 14 11.

Regulation 14 of the principal Regulations is amended—

(a)

in subregulation (1)—

(i)

in paragraph (a), by substituting for the words “section 42 in triplicate substantially” the words “section 42 of the Act”;

(ii)

in paragraph (b), by inserting after the words “section 13”

the words “of the Act”;

(iii)

in paragraph (c), by substituting for the words “two copies”

(iv)

in paragraph (d), by deleting the words “in duplicate”; and

(b)

in subregulation (2), by substituting for the words “immediately before”

Amendment of regulation 15 12.

Regulation 15 of the principal Regulations is amended by deleting the words

“section 37 (2) shall be given in duplicate substantially” the words “subsection 37(2)

of the Act shall be given”.

Regulation 16 of the principal Regulations is amended—

(a)

in the marginal note to subregulation (1), by substituting for the words

“Notice of alteration of rules.” the words “Notice and registration of alteration or amendment of rules.”;

by substituting for the words “section 38 (3) shall be made to the Director General in triplicate substantially” the words

Amendment of regulation 17 14.

Regulation 17 of the principal Regulations is amended—

(a)

in subregulation (1), by substituting for the words “section 41 shall be given in quadruplicate to the Director General substantially” the words

“section 41 of the Act shall be given to the Director General”;

(b)

in subregulation (2), by substituting for the words “in quadruplicate to the

Director General substantially” the words “to the Director General”; dan

The Director General may, if he thinks necessary, require further information in regards to such changes.”.

Amendment of regulation 18 15.

Regulation 18 of the principal Regulations is amended by substituting for the words “section 72 shall be given in substantially” the words “section 72 of the Act shall be given”.

Amendment of regulation 19 16.

Regulation 19 of the principal Regulations is amended by substituting for the words “section 73 substantially” the words “section 73 of the Act”.

Amendment of regulation 20 17.

Regulation 20 of the principal Regulations is amended by deleting the word “substantially”.

Deletion of regulation 21 18.

The principal Regulations are amended by deleting regulation 21.

Amendment of regulation 22 19.

Regulation 22 of the principal Regulations is amended by substituting for the words “section 74 (2) shall be given substantially” the words “subsection 74(2)

of the Act shall be given”.

Amendment of regulation 23 20.

Regulation 23 of the principal Regulations is amended by substituting for the words “shall be given substantially” the words “under subsection 74(1) of the Act shall be given”.

37A. (1) Every application or notice required to be submitted under these Regulations may be submitted by way of electronic transmission or in person.

(2)

Where an application or notice is submitted in person to the Director General, it shall be given in duplicate.”.
