PADA menjalankan kuasa yang diberikan oleh seksyen 16 Akta Komunikasi dan Multimedia 1998 [Akta 588], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

(1)

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Komunikasi dan Multimedia (Pelesenan) (Pindaan) (No. 2) 2024.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 1 Januari 2025.

[P.U. (A) 129/2000], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam peraturan 2—

(a)

dengan memasukkan selepas takrif “perkhidmatan lebar jalur”

takrif yang berikut:

‘ “perkhidmatan media sosial” ertinya suatu perkhidmatan aplikasi yang menggunakan perkhidmatan capaian Internet yang membolehkan dua atau lebih pengguna untuk mereka, memuat naik, berkongsi, menyebarkan atau mengubah suai kandungan;’; dan

(b)

dengan memasukkan selepas takrif “perkhidmatan pesanan” takrif yang berikut:

‘ “perkhidmatan pesanan Internet” ertinya suatu perkhidmatan aplikasi yang menggunakan perkhidmatan capaian Internet

yang membolehkan seorang pengguna untuk menyampaikan apa-apa bentuk pesanan dengan seorang pengguna yang lain;’.

Seksyen 3

Subperaturan 30 (1) Peraturan-Peraturan ibu dipinda—

(a)

dalam perenggan (i), dengan memotong perkataan “atau”; dan

(b)

dengan memasukkan selepas perenggan (i) perenggan yang berikut:

“(ia)

perkhidmatan pesanan Internet;

(ib)

perkhidmatan media sosial; atau”.

COMMUNICATIONS AND MULTIMEDIA

(LICENSING) (AMENDMENT) (NO. 2) REGULATIONS 2024

Opening note

Preamble

IN exercise of the powers conferred by section 16 of the Communications and Multimedia Act 1998 [Act 588], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Communications and Multimedia

(Licensing) (Amendment) (No. 2) Regulations 2024.

(2)

These Regulations come into operation on 1 January 2025.

Amendment of regulation 2 2.

The

Communications and

Multimedia

(Licensing)

Regulations 2000

[P.U. (A) 129/2000], which are referred to as the “principal Regulations” in these

Regulations, are amended in regulation 2—

(a)

by inserting after the definition of “SMI” the following definition:

‘ “social media service” means an applications service which utilizes Internet access service that enables two or more users to create, upload, share, disseminate or modify content;’; and

(b)

by inserting after the definition of “Internet access service”

the following definition:

‘ “Internet messaging service” means an applications service which utilizes Internet access service that enables a user to communicate any form of messages with another user;’.

Amendment of regulation 30 3.

Subregulation 30(1) of the principal Regulations is amended—

(a)

in paragraph (i), by deleting the word “or”; and

(b)

by inserting after paragraph (i) the following paragraphs:

“(ia)

Internet messaging services;

(ib)

social media services; or”.
