PADA menjalankan kuasa yang diberikan oleh seksyen 86 Akta Koperasi 1993 [Akta 502], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Koperasi (Pindaan) 2021.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 1 April 2021.

Peraturan-Peraturan Koperasi 2010 [P.U. (A) 422/2010], yang disebut

“Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam peraturan 2

dengan menggantikan takrif “institusi perbankan” dengan takrif yang berikut:

“institusi kewangan yang berlesen” ertinya—

(a)

suatu bank yang dilesenkan di bawah Akta Perkhidmatan Kewangan 2013

[Akta 758];

(b)

suatu bank Islam yang dilesenkan di bawah Akta Perkhidmatan

Kewangan Islam 2013 [Akta 759]; dan

(c)

suatu institusi yang ditetapkan di bawah

Akta

CO-OPERATIVE SOCIETIES (AMENDMENT) REGULATIONS 2021

Opening note

Preamble

IN exercise of the powers conferred by section 86 of the Co-operative Societies Act 1993 [Act 502], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Co-operative Societies

(Amendment) Regulations 2021.

(2)

These Regulations come into operation on 1 April 2021.

Amendment of regulation 2 2.

The Co-operative Societies Regulations 2010 [P.U. (A) 422/2010], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 2 by substituting for the definition of “banking institution”

the following definition:

“licensed financial institution” means—

(a)

a licensed bank under the Financial Services Act 2013 [Act 758];

(b)

a licensed Islamic bank under the Islamic Financial Services Act 2013

[Act 759]; and

(c)

a prescribed institution under the

Development

Financial

Institutions Act 2002 [Act 618];”.

Amendment of regulation 8 3.

Subregulation 8(3) of the principal Regulations is amended by deleting the word “non-Muslim”.

Amendment of regulation 13 4.

Paragraph 13(2)(a) of the principal Regulations is amended by substituting for the word “fifty” the word “twenty”.

Amendment of regulation 23 5.

Paragraph 23(d) of the principal Regulations is amended by substituting for the words “banking institution” the words “licensed financial institution”.

Amendment of regulation 35 6.

Paragraph 35(1)(a) of the principal Regulations is amended by substituting for the words “banking institution” the words “licensed financial institution”.

Amendment of regulation 36 7.

Paragraph 36(1)(a) of the principal Regulations is amended by substituting for the words “banking institution” the words “licensed financial institution”.
