PADA menjalankan kuasa yang diberikan oleh seksyen 34 Akta Makanan 1983 [Akta 281], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Makanan (Pindaan) (No. 2) 2016.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 1 September 2016.

Seksyen 2

Peraturan-Peraturan Makanan 1985 [P.U. (A) 437/1985], yang disebut

“Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam peraturan 2

dengan memasukkan selepas takrif “bungkusan luar” takrif yang berikut:

‘ “Codex Alimentarius” ertinya standard makanan antarabangsa yang diterima pakai oleh Suruhanjaya Codex Alimentarius;’.

Pindaan peraturan 19

(a)

dalam subperaturan (2) dengan—

(i)

memotong perkataan “atau” dihujung perenggan (a);

(ii)

menggantikan perenggan (b) dengan perenggan yang berikut:

“(b) apa-apa aditif makanan yang dibenarkan yang tidak mematuhi—

(i)

standard yang ditetapkan dalam

Peraturan-Peraturan ini;

(ii)

Codex Alimentarius; atau”; dan

(iii)

memasukkan selepas perenggan (b) perenggan yang berikut:

“(c) apa-apa aditif makanan selain daripada aditif makanan yang telah diluluskan oleh Pengarah secara bertulis.”;

“dibenarkan selainnya oleh Peraturan-Peraturan ini” perkataan

FOOD REGULATIONS (AMENDMENT) (NO. 2) 2016

Opening note

Preamble

IN exercise of the powers conferred by section 34 of the Food Act 1983 [Act 281], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Food Regulations (Amendment)

(No. 2) 2016.

(2)

These Regulations come into operation on 1 September 2016.

Amendment of regulation 2

Seksyen 2

The Food Regulations 1985 [P.U. (A) 437/1985], which are referred to as the

“principal Regulations” in these Regulations, are amended in regulation 2 by inserting after the definition of “bulk container” the following definition:

‘ “Codex Alimentarius” means the international food standards adopted by the

Codex Alimentarius Commission;’.

Seksyen 3

Amendment of regulation 19

(a)

in subregulation (2) by—

(i)

deleting the word “or” at the end of paragraph (a);

(ii)

substituting for paragraph (b) the following paragraph:

“(b) any permitted food additive which does not comply with—

(i)

the standard prescribed in these Regulations;

(ii)

the Codex Alimentarius; or”; and

(iii)

inserting after paragraph (b) the following paragraph:

“(c) any food additive other than food additive which has been approved by the Director in writing.”; and

(b)

in subregulation (3), by inserting after the words “otherwise permitted by these Regulations” the words “, permitted under the Codex

Alimentarius or with prior written approval of the Director”.
