PATENTS ACT 1983

PATENTS (WAIVER OF FEE) REGULATIONS 2020

IN exercise of the powers conferred by paragraph 87(2)(e)

of the

Patents Act 1983 [Act 291], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Patents (Waiver of Fee)

Regulations 2020.

(2)

These Regulations come into operation on 1 January 2021.

Interpretation 2.

For the purpose of these Regulations, “control or prevention measures”

means measures prescribed, made or taken under the Prevention and Control of

Infectious Diseases Act 1988 [Act 342] intended to control or prevent the spread of the Coronavirus Diseases 2019 (COVID-19).

Waiver of fee

3.

(1)

The fee prescribed in item 18 of the Part II, Schedule I to the

Patents

Regulations 1986

[P.U.

(A)

327/1986]

is waived in respect of an owner of a patent or a certificate for a utility innovation who is affected with the control or prevention measures.

(2)

The waiver under subregulation (1) shall apply if:

(a)

the term of a patent or certificate for a utility innovation expires between 1 January 2021 to 30 June 2021; and

(b)

an application for waiver of fee under subregulation (1) is filed with the Registrar accompanied with payment of the annual fee within the grace period of six months pursuant to subsection 35(2)

of the

Act for patent and

modification to subsection 35(4) under the Second Schedule of the Act for certificate for a utility innovation, as the case maybe.

Application for waiver of fee 4.

(1)

An application for the waiver of fee under regulation 3 shall be made by the owner of the patent or the certificate for a utility innovation in Form 1 of the

Schedule and shall be accompanied with the supporting documents to prove that:

(a)

if he is an individual:

(i)

he is from B40 group who receives Bantuan Sara Hidup or

Bantuan Prihatin Nasional; or

(ii)

he lose his job and income, or his income is affected with the control or prevention measures ; or

(b)

if it is a body corporate or unincorporated:

(i)

such body obtains the approval for the extension of moratorium or any flexibility for repayment from any financial institution;

(ii)

such body has cash flow problem due to the control or prevention measures; or

(iii)

such body has pecuniary indebtedness and has problem on repayment of debt due to the control or prevention measures.

(2)

In the case of a patent or certificate for a utility innovation which has more than one owner, the requirement under subregulation (1) is deemed to be complied with if one of the owners satisfy such requirement.

(3)

If the owner of the patent or certificate for a utility innovation fails to file an application for waiver of fee accompanied with payment of the annual fee under paragraph 3(2)(b), subsection 35(3)

of the

Act for patent or modification to subsection 35(5) under the Second Schedule of the Act for certificate for a utility innovation, as the case maybe, shall apply.
