PREVENTION AND CONTROL OF INFECTIOUS DISEASES (MEDICAL ATTENDANCE
AND MAINTENANCE OF PERSON REMOVED TO QUARANTINE STATION) (NO. 2)
REGULATIONS 2020
IN exercise of the powers conferred by paragraph 31(2)(q)
of the
Prevention and Control of Infectious Diseases Act 1988 [Act 342], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Prevention and Control of
Infectious Diseases (Medical Attendance and Maintenance of Person Removed to
Quarantine Station) (No. 2) Regulations 2020.
(2)
These Regulations are deemed to have come into operation on 24 July 2020.
Cost and expenses charged or incurred for medical attendance and maintenance at quarantine station 2.
(1)
Subject to regulation 3, any person who enters Malaysia from overseas and is directed by an authorized officer to undergo observation or surveillance under section 15 of the Act at any quarantine station shall pay any cost and expenses charged or incurred for his medical attendance and maintenance at the quarantine station.
(2)
The payment under subregulation (1) shall be made to the
Secretary General of the Ministry of Health Malaysia in such manner as determined by the Director General.
Persons not liable to pay cost and expenses 3.
(1)
Any person specified in the Schedule who enters Malaysia from overseas and is directed by an authorized officer to undergo observation or surveillance under section 15 of the Act at any quarantine station shall not be liable to pay any cost and

expenses charged or incurred for his medical attendance and maintenance at the quarantine station.
(2)
Any person other than the person specified in the Schedule may apply to the Minister for non-payment of the cost and expenses charged or incurred for his medical attendance and maintenance at a quarantine station.
(3)
In the case where the person mentioned in subregulation 2(1) is a
Malaysian citizen who is directed to undergo observation and surveillance has undergone the Coronavirus disease 2019 (COVID-19) detection test within fourteen days from the date the direction is issued but the results of the detection test is not available after the fourteenth day, the person shall not be liable to pay any cost and expenses charged or incurred for his medical attendance and maintenance at the quarantine station for the fifteenth day until the result of the detection test is available if the person is directed to undergo observation and surveillance for more than fourteen days.
Offence 4.
Any person who contravenes subregulation 2(1) commits an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.
Recovery of cost and expenses as civil debt 5.
(1)
Any cost and expenses due from and payable by any person under subregulation 2(1) may be recovered as a civil debt due to the Government.
(2)
Notwithstanding the conviction of any person under regulation 4, any cost and expenses due from and payable by that person under subregulation 2(1) may be recovered as a civil debt due to the Government.
Revocation 6.
The Prevention and Control of Infectious Diseases (Medical Attendance and
Maintenance of Person Removed to Quarantine Station) Regulations 2020
[P.U. (A) 211/2020] are revoked.
