(No. 2) 2020 [P.U. (A) 233/2020], yang disebut “Peraturan-Peraturan ibu” dalam
subperaturan yang berikut:
“(1A)
Jika seseorang pegawai diberi kuasa menyebabkan supaya mana-mana pekerja asing dipindahkan ke suatu stesen kuarantin bagi rawatan di bawah seksyen 14 Akta atau jika seseorang pegawai diberi kuasa mengarahkan supaya mana-mana pekerja asing menjalani pemerhatian atau pengawasan di mana-mana tempat di bawah seksyen 15 Akta, majikan yang mengambil kerja pekerja asing itu hendaklah membayar apa-apa kos dan perbelanjaan

yang dikenakan atau ditanggung bagi layanan perubatan dan penyaraan pekerja asing itu di stesen kuarantin atau tempat itu.
Bagi maksud subperaturan (1A), “pekerja asing”
ertinya pemegang

yang dikeluarkan di bawah peraturan 11 Peraturan-Peraturan
Imigresen 1963 [F.L.N. 228/1963].”; dan
dalam subperaturan (2), dengan memasukkan selepas perkataan
“subperaturan (1)” perkataan “atau (1A)”.

Peraturan-Peraturan ini, dipinda dalam peraturan 2—
Peraturan-Peraturan ibu dipinda dengan menggantikan subperaturan (3) dengan subperaturan yang berikut:
“(3) Dalam hal orang yang disebut dalam subperaturan 2(1) ialah seorang warganegara Malaysia yang diarahkan untuk menjalani pemerhatian atau pengawasan telah menjalani ujian pengesanan Penyakit Koronavirus
(COVID-19) dalam tempoh pemerhatian atau pengawasan yang dinyatakan dalam arahan yang dikeluarkan oleh pegawai diberi kuasa itu tetapi keputusan ujian pengesanan itu tidak diperoleh selepas tamat tempoh pemerhatian atau pengawasan itu dan jika orang itu diarahkan untuk menjalani tempoh pemerhatian atau pengawasan lanjut di stesen kuarantin, orang itu tidak bertanggungan untuk membayar apa-apa kos dan perbelanjaan yang dikenakan atau ditanggung bagi layanan perubatan dan penyaraan orang itu di stesen kuarantin itu bagi tempoh pemerhatian atau pengawasan yang dilanjutkan itu sehingga keputusan ujian pengesanan itu diperoleh.”.

PREVENTION AND CONTROL OF INFECTIOUS DISEASES
(MEDICAL ATTENDANCE AND MAINTENANCE OF PERSON REMOVED TO
QUARANTINE STATION) (NO. 2) (AMENDMENT) REGULATIONS 2020
Opening note
These regulations may be cited as the Prevention and Control of Infectious
Diseases (Medical Attendance and Maintenance of Person Removed to Quarantine
Station) (No. 2) (Amendment) Regulations 2020.
These Regulations come into operation on 1 January 2021.
Amendment of regulation 2 2.
The Prevention and Control of Infectious Diseases (Medical Attendance and
Maintenance of Person Removed to Quarantine Station) (No. 2) Regulations 2020
[P.U. (A) 233/2020], which are referred to as the “principal Regulations” in these
Regulations, are amended in regulation 2—
by inserting after subregulation (1) the following subregulations:
“(1A) If an authorized officer causes any foreign employee to be removed to a quarantine station for treatment under section 14 of the
Act or if an authorized officer directs any foreign employee to undergo observation or surveillance in any place under section 15 of the Act, the employer who employs such foreign employee shall pay any cost and expenses charged or incurred for the medical attendance and maintenance of such foreign employee at the quarantine station or place.

For the purpose of subregulation (1A), “foreign employee”
means a holder of a Visit Pass (Temporary Employment) issued under regulation 11
of the
Immigration
Regulations 1963
[F.L.N. 228/1963].”; and
in subregulation 2, by inserting after the words “subregulation (1)”
the words “or (1A)”.
Amendment of regulation 3 3.
Regulation 3 of the principal Regulations is amended by substituting for subregulation (3) the following subregulation:
“(3) In the case the person mentioned in subregulation 2(1) is a Malaysian citizen who is directed to undergo observation or surveillance has undergone the Coronavirus Disease 2019 (COVID-19) detection test within the period of observation or surveillance as specified in the direction issued by the authorized officer but the result of the detection test is not available after the expiry of the period of observation or surveillance and if the person is directed to undergo further period of observation or surveillance at the quarantine station, the person shall not be liable to pay any cost and expenses charged or incurred for his medical attendance and maintenance at the quarantine station for the extended period of the observation or surveillance period until the result of the detection test is available.”.
Amendment of regulation 4 4.
Regulation 4 of the principal Regulations is amended by inserting after the words
“subregulation 2(1)” the words “or (1A)”.
Amendment of regulation 5 5.
Regulation 5 of the principal Regulations is amended by inserting after the words
“subregulation 2(1)” wherever appearing the words “or (1A)”.
