PERATURAN-PERATURAN PENGANGKUTAN AWAM DARAT (PELESENAN TERMINAL) (STESEN DAN PUSAT PENGANGKUTAN) 2024

Nama dan permulaan kuat kuasa

Peraturan-Peraturan ini hendaklah terpakai bagi pemilik terminal, pemegang lesen terminal dan pengguna terminal yang berhubungan dengan stesen tunggal atau pelbagai modal dan pusat pengangkutan yang dikhususkan bagi pengangkutan awam darat.

“caj terminal” ertinya fi yang boleh dikenakan oleh pemegang lesen terminal mengikut gred terminal sebagaimana yang ditetapkan dalam Jadual Kedua;

“fi lesen” ertinya fi tahunan yang dikenakan kepada pemegang lesen terminal mengikut kategori sebagaimana yang ditetapkan dalam Jadual Pertama;

“gred terminal” ertinya gred sebagaimana yang ditentukan oleh Ketua Pengarah

Pengangkutan Awam Darat dalam lesen berdasarkan kemudahan, fasiliti dan tahap perkhidmatan yang disediakan di stesen dan pusat pengangkutan bagi tujuan penentuan caj terminal;

“kategori terminal” ertinya kategori terminal sebagaimana yang ditentukan oleh

Ketua Pengarah Pengangkutan Awam Darat dalam lesen mengikut purata harian jumlah penumpang dalam setahun atau purata harian jumlah kemasukan kenderaan perkhidmatan awam dan kenderaan pelancongan ke terminal dalam setahun sebagaimana yang ditetapkan dalam Jadual Pertama;

“operasi terminal” ertinya aktiviti mengambil dan menurunkan penumpang, aktiviti perniagaan, aktiviti masuk dan keluar orang di terminal dan lain-lain aktiviti di dalam kawasan terminal termasuklah—

Jadual Pertama; dan

(c)

disertakan dengan apa-apa maklumat atau dokumen sebagaimana yang ditentukan oleh Ketua Pengarah Pengangkutan Awam Darat.

(3)

Selepas menimbangkan permohonan di bawah subperaturan (1),

Ketua Pengarah Pengangkutan Awam Darat boleh—

(a)

meluluskan permohonan itu dan mengeluarkan lesen terminal kepada pemohon tertakluk kepada apa-apa syarat yang difikirkannya patut; atau

(b)

menolak permohonan itu dengan menyatakan alasan bagi penolakan itu.

Pemeriksaan terminal 5.

(1)

Sebelum permohonan diluluskan di bawah peraturan 4, mana-mana pegawai pengangkutan awam darat yang dilantik dan diberi kuasa oleh Ketua Pengarah

Pengangkutan Awam Darat, hendaklah pada bila-bila masa, menjalankan pemeriksaan di terminal.

(2)

Pemegang lesen terminal hendaklah memberi akses penuh untuk memasuki terminal kepada mana-mana pegawai pengangkutan awam darat untuk menjalankan pemeriksaan.

(3)

Setelah pemeriksaan dibuat, Ketua Pengarah Pengangkutan Awam Darat hendaklah menentukan kategori terminal dan gred terminal.

(4)

Dalam hal keadaan Ketua Pengarah Pengangkutan Awam Darat mengelaskan semula gred terminal kepada gred yang lebih rendah, Ketua Pengarah

Pengangkutan Awam Darat hendaklah memberikan notis bertulis kepada pemegang lesen terminal mengarahkan pemegang lesen terminal itu menambah baik tahap perkhidmatan selaras dengan gred asalnya.

Bentuk lesen 6.

Suatu lesen terminal yang dikeluarkan oleh Ketua Pengarah Pengangkutan Awam

Darat di bawah subperaturan 4(4) hendaklah mengandungi—

(a)

sijil lesen terminal;

(b)

sijil penarafan gred terminal; dan

(c)

syarat lesen terminal.

Sijil lesen terminal dan sijil penarafan gred terminal 7.

(1)

Sijil lesen terminal dan sijil penarafan gred terminal hendaklah mengandungi maklumat sebagaimana yang ditetapkan dalam Jadual Ketiga.

(2)

Bagi maksud penentuan sesuatu gred terminal, Ketua Pengarah

Pengangkutan Awam Darat hendaklah mengambil kira tahap kemudahan seperti yang berikut:

(a)

sistem pentiketan dan informasi;

(b)

sistem pengurusan aliran trafik bagi kenderaan dan pengguna terminal;

(c)

sistem keselamatan; dan

(d)

keselesaan pengguna terminal.

Pembaharuan lesen 8.

(1)

Suatu permohonan bagi pembaharuan lesen terminal oleh pemegang lesen terminal hendaklah dibuat sekurang-kurangnya sembilan puluh hari sebelum tarikh habis tempoh lesen terminal itu dan hendaklah—

(a)

dibuat dalam borang sebagaimana yang ditentukan oleh

Ketua Pengarah Pengangkutan Awam Darat;

(b)

disertakan dengan fi sebagaimana yang ditetapkan dalam

Jadual Pertama; dan

(c)

disertakan dengan apa-apa maklumat dan dokumen sebagaimana yang ditentukan oleh Ketua Pengarah Pengangkutan Awam Darat.

(2)

Sekiranya suatu permohonan untuk membaharui lesen terminal diluluskan, Ketua Pengarah Pengangkutan Awam Darat hendaklah mengeluarkan lesen terminal baharu kepada pemohon.

Pengubahan lesen 9.

(1)

Sekiranya terdapat apa-apa perubahan seperti yang berikut, pemegang lesen terminal hendaklah membuat permohonan pengubahan lesen terminal:

(a)

nama terminal;

(b)

pegangan ekuiti syarikat;

(c)

keanggotaan ahli lembaga pengarah syarikat;

(d)

nama dan alamat syarikat;

(e)

waktu operasi terminal;

(f)

perubahan kepada pelan lantai; dan

(g)

perubahan kepada gred terminal.

(2)

Permohonan bagi pengubahan lesen terminal oleh pemegang lesen terminal hendaklah—

(a)

dibuat dalam borang sebagaimana yang ditentukan oleh

Ketua Pengarah Pengangkutan Awam Darat;

(b)

disertakan dengan fi sebagaimana yang ditetapkan dalam

Jadual Pertama; dan

(c)

disertakan dengan apa-apa maklumat dan dokumen seperti yang berikut:

(i)

justifikasi pengubahan; dan

(ii)

data dan maklumat sokongan bagi pengubahan.

(3)

Sekiranya permohonan bagi pengubahan lesen terminal diluluskan,

Ketua Pengarah Pengangkutan Awam Darat hendaklah mengeluarkan lesen terminal yang baharu kepada pemohon dan Ketua Pengarah Pengangkutan Awam Darat boleh mengenakan apa-apa syarat yang difikirkannya patut.

(4)

Sekiranya terdapat perubahan yang berhubungan dengan kategori dan gred terminal kepada kemudahan yang disediakan sebagaimana yang dinyatakan dalam peraturan 5, Ketua Pengarah Pengangkutan Awam Darat boleh, pada bila-bila masa, memeriksa semula terminal.

Salinan pendua lesen 10.

(1)

Jika lesen yang dikeluarkan oleh Ketua Pengarah Pengangkutan Awam

Darat di bawah Peraturan-Peraturan ini hilang, cacat, rosak atau musnah atau atas sebab munasabah yang lain, suatu permohonan untuk salinan pendua lesen oleh pemegang lesen terminal hendaklah—

(a)

dibuat dalam borang sebagaimana yang ditentukan oleh

Ketua Pengarah Pengangkutan Awam Darat;

(b)

disertakan dengan fi sebagaimana yang ditetapkan dalam

Jadual Pertama; dan

(c)

disertakan dengan apa-apa maklumat dan dokumen sebagaimana yang ditentukan oleh Ketua Pengarah Pengangkutan Awam Darat.

(2)

Selepas menimbangkan permohonan itu, Ketua Pengarah Pengangkutan

Awam Darat boleh—

(a)

meluluskan permohonan itu dan mengeluarkan kepada pemohon salinan pendua lesen dengan perkataan “PENDUA” diendorskan pada salinan lesen itu; atau

(b)

menolak permohonan itu dengan menyatakan alasan bagi penolakan itu.

Larangan pemindahan lesen terminal 11.

Suatu lesen terminal yang dikeluarkan di bawah peraturan 4 tidak boleh dipindahkan atau diserahhakkan kepada mana-mana orang lain.

BAHAGIAN III

Caj terminal 12.

(1)

Pemegang lesen terminal boleh mengenakan caj terminal sebagaimana yang ditetapkan dalam Jadual Kedua.

(2)

Caj terminal hendaklah ditetapkan berdasarkan penarafan gred terminal yang telah diberikan oleh

Ketua

Pengarah

Pengangkutan

Awam

Darat dalam lesen terminal.

(3)

Ketua Pengarah Pengangkutan Awam Darat boleh, atas sebab kepentingan awam, melalui notis bertulis, mengarahkan pemegang lesen terminal untuk mengubah caj terminal yang dinyatakan dalam syarat lesen terminal dalam masa tujuh hari dari tarikh notis bertulis itu.

BAHAGIAN IV

PEMATUHAN

Penggunaan selamat dan penyenggaraan 13.

Pemegang lesen terminal hendaklah memastikan—

(a)

terminal bersih dan semua kemudahan yang disediakan berfungsi dan selamat untuk digunakan dan memastikan kerja-kerja pembersihan dan penyenggaraan dijalankan mengikut jadual;

(b)

operasi terminal berjalan lancar dan selamat;

(c)

sistem teknologi terminal mampu mengawal selia aktiviti pengguna terminal dan kenderaan;

(d)

terma dan syarat lesen terminal berdasarkan gred yang telah ditentukan oleh Ketua Pengarah Pengangkutan Awam Darat dipatuhi; dan

(e)

semua dokumen, rekod dan laporan berkaitan dengan kemudahan, peralatan, penyenggaraan, bangunan dan operasi terminal disimpan dengan baik dan dikemukakan kepada Ketua Pengarah Pengangkutan

Awam Darat dalam apa-apa tempoh dan mengikut apa-apa cara sebagaimana yang ditentukan oleh Ketua Pengarah Pengangkutan Awam

Darat.

Penyimpanan rekod 14.

(1)

Pemegang lesen terminal hendaklah menyimpan rekod dan dokumen yang berikut:

(a)

pelan lantai terminal dan lukisan siap bina yang disahkan oleh arkitek profesional;

(b)

rekod penyengaraan terminal;

(c)

rekod operasi terminal termasuk data kenderaan, penumpang, trip, pentiketan, kesalahan dan lain-lain rekod operasi yang ditentukan oleh Ketua Pengarah Pengangkutan Awam Darat dari semasa ke semasa;

(d)

rekod dalam sistem pengurusan terminal; dan

(e)

rekod lain sebagaimana yang ditentukan oleh Ketua Pengarah

Pengangkutan Awam Darat.

(2)

Apabila diminta oleh Ketua Pengarah Pengangkutan Awam Darat, pemegang lesen terminal hendaklah mengemukakan dokumen yang disebut dalam subperaturan (1) dalam tempoh tujuh hari.

LAND PUBLIC TRANSPORT (TERMINAL LICENSING) (STATION AND TRANSPORT HUB)

REGULATIONS 2024

IN exercise of the powers conferred by paragraphs 252(1)(a), (b), (i), (r), (s), (ti), (tl), (tm),

(tn), (ty), (tak) and subparagraph (tb)(i) of the Land Public Transport Act 2010 [Act 715], the Minister makes the following regulations:

PART I

PRELIMINARY

Citation and commencement 1.

(1)

These regulations may be cited as the Land Public Transport

(Terminal Licensing) (Station and Transport Hub) Regulations 2024.

(2)

These Regulations come into operation on 6 February 2024.

Application 2.

These Regulations shall apply to terminal owner, terminal licensee and terminal user relating to a single or multi-modal station and transport hub dedicated to land public transport.

Interpretation 3.

In these Regulations, unless the context otherwise requires—

“terminal charge” means fees that may be imposed by a terminal licensee in accordance with the terminal grade as prescribed in the Second Schedule;

“licence fee” means the annual fee imposed to the terminal licensee in accordance with the category as prescribed in the First Schedule;

“terminal grade” means the grade as may be determined by the Director General of Land Public Transport in the licence based on the amenities, facilities and level of services provided at the station and transport hub for the purpose of determining terminal charge;

“terminal category” means the category of terminal as may be determined by the Director General of Land Public Transport in the licence according to the average daily number of passengers in a year or the average daily number of the entry of public service vehicles and tourism vehicles to the terminal in a year as prescribed in the First Schedule;

“terminal operation” means the activity of embarking and disembarking passengers, business activity, the entry and exit of people activity in the terminal and other activities in the terminal area including—

(i)

collection of terminal charge;

(ii)

management and regulation of terminal operation;

“terminal owner” means the owner of the building whose building is used in whole or in part for terminal operation;

“terminal user” means any person that is in the vicinity of the terminal area including passengers.

PART II

LICENSING

Application for licence 4.

(1)

An application for a terminal licence by any person who intends to carry on the terminal operation shall be made to the Director General of Land Public Transport in such manner as may be determined by the Director General of Land Public Transport.

(2)

The application under subregulation (1) shall be—

(a)

made in an application form as may be determined by the Director General of Land Public Transport;

(b)

accompanied by a fee as prescribed in the First Schedule; and

(c)

accompanied by any information or document as may be determined by the Director General of Land Public Transport.

(3)

After considering the application under subregulation

(a)

approve the application and issue the terminal licence to the applicant subject to any condition as he thinks fit; or

(b)

refuse the application by stating the grounds for refusal.

Inspection of terminal 5.

(1)

Before the application is approved under regulation 4, any land public transport officer appointed and duly authorized by the Director General of Land Public

Transport, shall at any time, conduct an inspection at the terminal.

(2)

The terminal licensee shall provide full access to enter the terminal to any land public transport officer to carry out the inspection.

(3)

After the inspection has been made, the

Director

General of Land Public Transport shall determine the category and grade of the terminal.

(4)

In circumstances where the Director General of Land Public Transport reclassifies the terminal grade to a lower grade, the Director General of Land Public

Transport shall give written notice to the terminal licensee instructing the terminal licensee to improve the service level to be consistent with the original grade.

Form of licence 6.

A terminal licence issued by the Director General of Land Public Transport under subregulation 4(4) shall consist of—

(a)

a terminal licence certificate;

(b)

a terminal grade rating certificate; and

(c)

terminal licence condition.

Terminal licence certificate and terminal grade rating certificate 7.

(1)

The terminal licence certificate and the terminal grade rating certificate shall contain the information as prescribed in the Third Schedule.

(2)

For the purpose of determining a terminal grade, the Director General of Land Public Transport shall take into account the level of facilities as follows:

(a)

ticketing and information system;

(b)

traffic flow management system for vehicle and terminal user;

(c)

security system; and

(d)

terminal user comfort.

Renewal of licence 8.

(1)

An application for a renewal of the terminal licence by a terminal licensee shall be made at least ninety days before the date of expiry of the terminal licence and shall be—

(a)

made in the form as may be determined by the Director General of

Land Public Transport;

(b)

accompanied by a fee as prescribed in the First Schedule; and

(c)

accompanied by any information and document as may be determined by the Director General of Land Public Transport.

(2)

If the application for renewal of the terminal licence is approved, the Director General of Land Public Transport shall issue a new terminal licence to the applicant.

Variation of licence 9.

(1)

If changes occur in any of the following, a terminal licensee shall apply for variation of the terminal licence:

(a)

name of the terminal;

(b)

the company's equity holding;

(c)

membership of the company's board of director;

(d)

name and address of the company;

(e)

terminal operating hours;

(f)

changes to floor plan; and

(g)

changes to terminal grade.

(2)

An application for the variation of terminal licence by a terminal licensee shall be—

(a)

made in the form as may be determined by the Director General of Land Public Transport;

(b)

accompanied by a fee as prescribed in the First Schedule; and

(c)

accompanied by any information and document as follows:

(i)

justification of the variation; and

(ii)

supporting data and information for the variation.

(3)

If the application for variation of the terminal licence is approved, the Director General of Land Public Transport shall issue a new terminal licence to the applicant and the Director General of Land Public Transport may impose such conditions as he thinks fit.

(4)

If there is any change to the facilities relating to the category and grade of the terminal provided as specified in regulation 5, the Director General of Land Public

Transport may, at any time, re-inspect the terminal.

Duplicate copy of licence 10.

(1)

If the licence issued by the Director General of Land Public Transport under these Regulations is lost, mutilated, defaced or destroyed or for other reasonable reasons, an application for the duplicate copy of a licence by the terminal licensee shall be—

(a)

made in the form as may be determined by the Director General of Land Public Transport;

accompanied by a fee as prescribed in the First Schedule; and

(c)

accompanied by any information and document as may be determined by the Director General of Land Public Transport.

(2)

After considering the application, the Director General of Land Public

Transport may—

(a)

approve the application and issue to the applicant a duplicate copy of licence with the word “DUPLICATE” endorsed on the copy of the licence; or

(b)

refuse the application by stating the grounds for refusal.

Prohibition of transfer of terminal licence 11.

A terminal licence issued under regulation 4 shall not be transferred or assigned to any other person.

PART III

Terminal charge 12.

(1)

A terminal licensee may impose terminal charge as prescribed in the Second Schedule.

(2)

The terminal charge shall be prescribed based on the terminal grade rating given by the Director General of Land Public Transport in the terminal licence.

(3)

The Director General of Land Public Transport may, for reason of public interest, by a written notice, instruct the terminal licensee to vary the terminal charge specified in the terminal licence conditions within seven days from the date of the written notice.

PART IV

COMPLIANCE

Safety of use and maintenance 13.

A terminal licensee shall ensure that—

(a)

the terminal is clean and all facilities provided are functional and safe to use and ensure cleaning and maintenance work is carried out according to the schedule;

(b)

the terminal operation is carry out smoothly and safe;

(c)

the technology system of the terminal is capable of regulating the activities of terminal users and vehicles;

(d)

the terms and conditions of the terminal licence based on the grade determined by the Director General of Land Public Transport are complied with; and

(e)

all documents, records and reports in respect of facility, equipment, maintenance, building and terminal operation are properly kept and submitted to the Director General of Land Public Transport within any period and in any manner as may be determined by the Director General of Land Public Transport.

Record keeping 14.

(1)

A terminal licensee shall keep the following records and documents:

(a)

terminal floor plan and completed drawings certified by a professional architect;

(b)

terminal maintenance records;

terminal operation records including data on vehicles, passengers, trip, ticketing, offences and other operational records specified by the Director General of Land Public Transport from time to time;

(d)

records in the terminal management system; and

(e)

other records as may be determined by the Director General of

Land Public Transport.

(2)

Upon request by the Director General of Land Public Transport, the terminal licensee shall provide the documents referred to in subregulation (1)

within seven days.

TERMINAL LICENCE CERTIFICATE AND TERMINAL GRADE RATING CERTIFICATE

Terminal licence certificate 1.

The terminal licence certificate shall contain the following information:

(a)

category of the terminal;

(b)

name of the terminal licensee;

(c)

name of the terminal;

(d)

address of the terminal;

(e)

grade of the terminal; and

(f)

terminal licence period.

Terminal grade rating certificate 2.

The terminal grade rating certificate shall contain the following information:

(a)

name of the terminal;

(b)

terminal grade rating; and

(c)

terminal licence period.
