Opening note
Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan
Perkhidmatan Kuarantin dan Pemeriksaan Malaysia (Pengeluaran Permit, Lesen dan Perakuan) 2013.
Peraturan-Peraturan ini mula berkuat kuasa pada 1 April 2013.
Permohonan permit, lesen dan perakuan
Mana-mana orang yang ingin mengimport atau mengeksport apa-apa tumbuhan, binatang, karkas, ikan, keluaran pertanian, tanih, atau mikroorganisma hendaklah memohon suatu permit, lesen atau perakuan untuk mengimport, atau suatu permit atau lesen untuk mengeksport daripada Ketua Pengarah.
Suatu permohonan bagi permit, lesen dan perakuan yang disebut dalam subperaturan (1) hanya boleh dibuat selepas seseorang pemohon itu berdaftar sebagai seorang pengimport, pengeksport atau ejen dengan Ketua Pengarah.
Pengimport, pengeksport atau ejen itu hendaklah membuat permohonan secara bertulis bagi permit, lesen atau perakuan itu mengikut apa-apa cara yang ditentukan oleh Ketua Pengarah.

Permit, lesen dan perakuan tidak boleh dipindah milik
Mana-mana pemegang suatu permit, lesen atau perakuan yang dikeluarkan di bawah Peraturan-Peraturan ini tidak boleh memindah milik atau membenarkan permit, lesen atau perakuan itu digunakan oleh mana-mana orang selain pemegang permit, lesen atau perakuan itu sama ada secara sengaja atau tidak.
Pembaharuan lesen
Suatu permohonan bagi pembaharuan lesen hendaklah dibuat dalam cara yang ditentukan oleh Ketua Pengarah.
Mana-mana permohonan untuk membaharui lesen di bawah subperaturan (1) hendaklah dibuat dalam tempoh dua bulan sebelum tarikh akhir lesen.
Sekiranya sesuatu permohonan untuk membaharui lesen itu diterima oleh
Ketua Pengarah selepas tamat tempoh lesen berkenaan, permohonan itu hendaklah dikira sebagai suatu permohonan lesen yang baharu.
Walau apa pun subperaturan (1), suatu lesen import dan eksport bagi binatang hidup hendaklah dibuat bagi setiap aktiviti pengimportan atau pengeksportan.
Penggantungan dan pembatalan permit, lesen dan perakuan
Ketua Pengarah boleh menggantung atau membatalkan sesuatu permit, lesen atau perakuan yang dikeluarkan di bawah Peraturan-Peraturan ini di bawah mana-mana hal keadaan yang berikut:
pemegang permit, lesen atau perakuan melanggar mana-mana peruntukan Peraturan-Peraturan ini atau mana-mana syarat atau sekatan yang dikenakan ke atas permit, lesen atau perakuan itu;
pemegang permit, lesen atau perakuan telah mendapatkan permit, lesen atau perakuan itu secara tidak wajar atau dengan menyalahi undang-undang;

pemegang permit, lesen atau perakuan telah berhenti menjalankan atau mengendalikan apa-apa aktiviti yang baginya permit, lesen atau perakuan itu dikeluarkan;
telah berlaku apa-apa perbuatan atau peninggalan oleh pemegang permit, lesen atau perakuan atau telah wujud suatu perubahan dalam hal keadaan sehingga menyebabkan pemegang permit, lesen atau perakuan itu tidak lagi berhak untuk diberikan permit, lesen atau perakuan di bawah Peraturan-Peraturan ini; atau
sekiranya agensi atau jabatan yang berkaitan telah memberikan suatu notis mengenai sesuatu wabak penyakit atau perosak tertentu di suatu negara pengeksport atau hal-hal yang lain yang berisiko;
Pemegang permit, lesen atau perakuan yang permit, lesen atau perakuannya digantung atau dibatalkan—
tidak berhak ke atas apa-apa pampasan bagi apa-apa kerugian yang dialaminya; dan
tidak berhak ke atas apa-apa bayaran balik fi yang telah dibayar.
Kehilangan permit, lesen atau perakuan
Jika suatu permit, lesen atau perakuan hilang, pemegang permit, lesen atau perakuan itu hendaklah—
Pemegang permit, lesen atau perakuan itu hendaklah membuat suatu permohonan baru kepada Ketua Pengarah bagi menggantikan permit, lesen atau perakuan yang hilang itu berserta dengan laporan polis.
Kesahan permit, lesen atau perakuan
Suatu permit, lesen atau perakuan, melainkan jika terlebih dahulu digantung atau dibatalkan, hendaklah sah selama apa-apa tempoh yang dinyatakan dalam permit, lesen atau perakuan itu.
Penalti am
Mana-mana orang yang melanggar mana-mana peruntukan di bawah Peraturan-Peraturan ini melakukan suatu kesalahan dan boleh, apabila disabitkan, didenda tidak melebihi satu ribu ringgit atau dipenjarakan selama tempoh tidak melebihi enam bulan atau kedua-duanya.

MALAYSIAN QUARANTINE AND INSPECTION SERVICES
(ISSUANCE OF PERMIT, LICENCE AND CERTIFICATE) REGULATIONS 2013
Opening note
These regulations may be cited as the Malaysian Quarantine and
Inspection Services (Issuance of Permit, Licence and Certificate) Regulations 2013.
These Regulations come into operation on 1 April 2013.
Application for permit, licence and certificate 2.
Any person who intends to import or export any plant, animal, carcass, fish, agricultural produce, soil or microorganism shall apply for a permit, licence or certificate to import, or a permit or licence to export from the Director General.
An application for a permit, licence and certificate referred to in subparagraph (1) shall only be made after an applicant is registered as an importer, exporter or agent with the Director General.
The importer, exporter or agent shall make a written application for a permit, licence or certificate in any manner determined by the Director General.
Permit, licence and certificate are non-transferable 3.
Any holder of a permit, licence or certificate issued under these Regulations shall not transfer or allow the permit, licence or certificate to be used by any person other than the permit, licence or certificate holder whether it is intentionally or not.

Renewal of licence 4.
An application for renewal of licence shall be made in the manner as determined by the Director General.
Any application to renew the licence under subregulation (1) shall be made within two months before the expiry date of the licence.
If an application to renew the licence is received by the Director General after the expiry date of such licence, the application shall be regarded as a new application of licence.
Notwithstanding subregulation (1), an import and export licence for live animals shall be made for every importation or exportation activity.
Suspension and termination of permit, licence or certificate 5.
The Director General may suspend or terminate a permit, licence or certificate issued under these Regulations under any of the following circumstances:
the permit, licence or certificate holder contravenes any provision of these Regulations or any conditions or restrictions imposed on the permit, licence or certificate;
the permit, licence or certificate holder had improperly or illegally obtained the permit, licence or certificate;
the permit, licence or certificate holder has ceased to carry out or operate any activity for which the permit, licence or certificate is being issued;
there has been any act or omission by the permit, licence or certificate holder or there has been a change of circumstances such

that the permit, license or certificate holder would no longer be entitled to be granted a permit, licence or certificate under these
Regulations; or
if the relevant agency or department has given a notice in respect of a specific disease or pests outbreak in an exporting country or other risky matters;
The permit, license or certificate holder whose permit, licence and certificate is suspended or terminated
is not entitled to any refund of the fees paid.
Loss of permit, licence or certificate 6.
Where a permit, licence or certificate is lost, the permit, licence or certificate holder shall —
The permit, licence or certificate holder shall make a new application to the Director General to replace the lost permit, licence or certificate accompanied by the police report.
Validity of permit, licence or certificate 7.
A permit, licence or certificate, unless sooner suspended or revoked, shall be valid for such period as may be specified in the permit, licence or permit.

General Penalty 8.
Any person who contravenes any provision under these Regulations shall commit an offence and shall, upon conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.
