Opening note

Preamble

  1. PADA menjalankan kuasa yang diberikan oleh seksyen 15 Akta Pilihan Raya 1958 [Akta 19], Suruhanjaya Pilihan Raya, dengan kelulusan Yang di-Pertuan Agong, membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

(1)

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Pilihan Raya (Pendaftaran Pemilih) (Pindaan) 2012.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 25 April 2012.

Pindaan peraturan 12

Peraturan-Peraturan Pilihan Raya (Pendaftaran Pemilih) 2002

[P.U. (A) 293/2002], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam peraturan 12 dengan memotong subperaturan (3).

Pindaan peraturan 14

Peraturan 14 Peraturan-Peraturan ibu dipinda

(a)

dalam subperaturan (2), dengan menggantikan perkataan “dalam masa tujuh hari dari tarikh” dengan perkataan “pada waktu pejabat pada mana-mana hari bekerja dalam tempoh”; dan

(b)

dalam subperaturan (3), dengan memasukkan selepas perkataan

“penuntut-penuntut” perkataan “bagi membolehkan nama dan alamat itu diperiksa pada waktu yang dinyatakan dalam notis itu”.

Pindaan peraturan 15

Peraturan 15 Peraturan-Peraturan ibu dipinda

(a)

dengan menggantikan subperaturan (2) dengan subperaturan yang berikut:

“

(2)

Tiap-tiap bantahan oleh orang yang disebut dalam subperaturan (1), kemudian daripada ini disebut “pembantah”, hendaklah dibuat dalam Borang C dalam Jadual dan hendaklah diserahkan kepada Pendaftar bagi kawasan pendaftarannya pada waktu pejabat pada mana-mana hari bekerja dalam tempoh yang daftar pemilih tambahan itu terbuka untuk diperiksa sebagaimana yang dinyatakan dalam notis yang disebut dalam subperaturan 13(5).”;

(b)

dengan memasukkan selepas subperaturan (2) subperaturan yang berikut:

“

(2A)

Dalam hal bantahan mengenai kemasukan nama seseorang penuntut ke dalam daftar pemilih tambahan, pembantah hendaklah menyerahkan

C kepada

Pendaftar bagi kawasan pendaftarannya pada waktu pejabat pada mana-mana hari bekerja dalam tempoh yang nama dan alamat penuntut itu dipamerkan untuk diperiksa seperti yang dinyatakan dalam notis yang disebut dalam subperaturan 14(3).”; dan

(c)

dalam subperaturan (3), dengan menggantikan perkataan “sepuluh”

dengan perkataan “dua puluh”.

Peraturan baru 21A

Peraturan-Peraturan ibu dipinda dengan memasukkan selepas peraturan 21 peraturan yang berikut:

“Pemerakuan daftar pemilih tambahan bagi mana-mana orang yang namanya tidak terlibat dengan apa-apa tuntutan atau bantahan

(1)

Pendaftar bagi setiap kawasan pendaftaran hendaklah, seberapa segera yang boleh selepas tamat tempoh untuk membuat tuntutan atau bantahan tamat, memperakui daftar pemilih tambahan bagi kawasan pendaftaran itu bagi mana-mana orang yang namanya tidak terlibat dengan apa-apa tuntutan atau bantahan bagi kawasan pendaftaran itu dalam Borang F dalam Jadual.

(2)

Pendaftar hendaklah, seberapa segera yang boleh selepas pemerakuan itu, memberikan notis dalam Warta bahawa daftar pemilih tambahan itu, atau suatu salinan daftar itu, terbuka untuk diperiksa pada bila-bila waktu yang munasabah yang dinyatakan dalam notis itu di pejabat Pendaftar atau di mana-mana tempat di dalam kawasan pendaftaran yang dinyatakan dalam notis itu.

(3)

Notis di bawah subperaturan (2) boleh diberikan oleh

(a)

Ketua

Pendaftar berkenaan dengan daftar pemilih tambahan bagi lebih daripada satu kawasan pendaftaran;

atau

(b)

Pendaftar berkenaan dengan satu kawasan pendaftaran atau satu unit pendaftaran.

(4)

Daftar pemilih tambahan yang diperakui itu hendaklah mula berkuat kuasa pada tarikh notis di bawah subperaturan (2) disiarkan dalam

Warta dan, tertakluk kepada apa-apa perubahan dalam daftar pemilih tambahan itu, jika ada, daftar pemilih tambahan itu hendaklah terus berkuat kuasa

sehingga daftar pemilih tambahan itu digabungkan dengan daftar pemilih induk dan kemudiannya diperakui semula.”.

Pindaan peraturan 22

Peraturan-Peraturan ibu dipinda dengan menggantikan peraturan 22 dengan peraturan yang berikut:

“Pemerakuan daftar pemilih tambahan bagi mana-mana orang yang terlibat dengan apa-apa tuntutan atau bantahan

(1)

Pendaftar bagi setiap kawasan pendaftaran hendaklah, seberapa segera yang boleh selepas tuntutan atau bantahan diputuskan bagi mana-mana orang yang terlibat dengan tuntutan atau bantahan itu, memperakui daftar pemilih tambahan bagi kawasan pendaftaran itu dalam Borang F dalam Jadual.

(2)

Pendaftar hendaklah, seberapa segera yang boleh selepas pemerakuan itu, memberikan notis dalam Warta bahawa daftar pemilih tambahan itu, atau suatu salinan daftar itu, terbuka untuk diperiksa pada bila-bila waktu yang munasabah yang dinyatakan dalam notis itu di pejabat Pendaftar atau di mana-mana tempat di dalam kawasan pendaftaran yang dinyatakan dalam notis itu.

(3)

Notis di bawah subperaturan (2) boleh diberikan oleh

(a)

Ketua

Pendaftar berkenaan dengan daftar pemilih tambahan bagi lebih daripada satu kawasan pendaftaran;

atau

(b)

Pendaftar berkenaan dengan satu kawasan pendaftaran atau satu unit pendaftaran.

Daftar pemilih tambahan yang diperakui itu hendaklah mula berkuat kuasa pada tarikh notis di bawah subperaturan (2) disiarkan dalam

Warta dan, tertakluk kepada apa-apa perubahan dalam daftar pemilih tambahan itu, jika ada, daftar pemilih tambahan itu hendaklah terus berkuat kuasa sehingga daftar pemilih tambahan itu digabungkan dengan daftar pemilih induk dan kemudiannya diperakui semula.”.

ELECTIONS ACT 1958

ELECTIONS (REGISTRATION OF ELECTORS) (AMENDMENT) REGULATIONS 2012

Opening note

Preamble

  1. IN exercise of the powers conferred by section 15 of the Elections Act 1958 [Act 19], the Election Commission, with the approval of the Yang di-Pertuan Agong, makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Elections (Registration of

Electors) (Amendment) Regulations 2012.

(2)

These Regulations come into operation on 25 April 2012.

Amendment of regulation 12 2.

The Elections (Registration of Electors) Regulations 2002 [P.U. (A) 293/2002], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 12 by deleting subregulation (3).

Amendment of regulation 14 3.

Regulation 14 of the principal Regulations is amended

(a)

in subregulation (2), by substituting for the words “within seven days from the date on” the words “during office hours on any working day within the period in”; and

(b)

in subregulation (3), by inserting after the word “claimants” the words “to enable the names and addresses to be inspected at such hours as stated in the notice”.

Amendment of regulation 15 4.

Regulation 15 of the principal Regulations is amended

(a)

by substituting for subregulation (2) the following subregulation:

“

(2)

Every objection by the person referred to in subregulation

(1)

, hereinafter referred to as the “objector”, shall be made in Form C in the Schedule and shall be delivered to the Registrar of his registration area during office hours on any working day within the period in which the supplementary electoral roll is open for inspection as stated in the notice referred to in subregulation 13(5).”;

(b)

by inserting after subregulation (2) the following subregulation:

“

(2A)

In the case of an objection to the insertion of the name of a claimant in the supplementary electoral roll, the objector shall deliver

Form C to the Registrar of his registration area during office hours on any working day within the period in which the notice containing the names of the claimants is exhibited for inspection as stated in the notice referred to in subregulation 14(3).”; and

(c)

in subregulation (3), by substituting for the word “ten” the word “twenty”.

New regulation 21A

Seksyen 5

The principal Regulations are amended by inserting after regulation 21 the following regulation:

“Certification of supplementary electoral roll for any person whose name is not involved in any claim or objection

Seksyen 21A

(1)

The Registrar of each registration area shall, as soon as possible after the time to make a claim or objection has expired, certify the supplementary electoral roll for the registration area for any person whose name is not involved in any claim or objection in Form F in the Schedule.

(2)

The Registrar shall, as soon as possible after the certification, give notice in the Gazette that the supplementary electoral roll, or a copy of the roll, is open for inspection during office hours on any working day as stated in the notice at the office of the Registrar or at such places in the registration area as may be specified in the notice.

(3)

A notice under subregulation (2) may be given by

(a)

the Chief Registrar in respect of the supplementary electoral roll of more than one registration area; or

(b)

the Registrar in respect of one registration area or one registration unit.

(4)

The certified supplementary electoral roll shall come into force upon the date of the publication in the Gazette of the notice under subregulation

(2)

and, subject to such alterations in the supplementary electoral roll, if any, the supplementary electoral roll shall continue in force until the supplementary electoral roll is merged with the principal electoral roll and then re-certified.”.

Amendment of regulation 22 6.

The principal Regulations are amended by substituting for regulation 22 the following regulation:

“Certification of supplementary electoral roll for any person involved in any claim or objection

Seksyen 22

(1)

The Registrar of each registration area shall, as soon as possible after claims or objections have been determined for any person involved in such claims or objections, certify the supplementary electoral roll for the registration area in Form F in the Schedule.

(2)

The Registrar shall, as soon as possible after the certification, give notice in the Gazette that the supplementary electoral roll, or a copy of the roll, is open for inspection during office hours on any working day as stated in the notice at the office of the Registrar or at such places in the registration area as may be specified in the notice.

(3)

A notice under subregulation (2) may be given by

(a)

the Chief Registrar in respect of the supplementary electoral roll of more than one registration area; or

(b)

the Registrar in respect of one registration area or one registration unit.

(4)

The certified supplementary electoral roll shall come into force upon the date of the publication in the Gazette of the notice under subregulation

(2)

and, subject to such alterations in the supplementary electoral roll, if any, the supplementary electoral roll shall continue in force until the supplementary electoral roll is merged with the principal electoral roll and then re-certified.”.
