Peraturan-Peraturan ini terpakai bagi semua majikan dan penyedia penginapan berpusat yang menyediakan penginapan atau penginapan berpusat, mengikut mana-mana yang berkenaan, di bawah Bahagian IIIA Akta.

Mana-mana majikan atau penyedia penginapan berpusat hendaklah menyediakan penginapan atau penginapan berpusat, mengikut mana-mana yang berkenaan, mengikut kehendak minimum untuk kelas bangunan sebagaimana yang dinyatakan dalam Jadual.

Mana-mana majikan atau penyedia penginapan berpusat hendaklah menyediakan penginapan atau penginapan berpusat, mengikut mana-mana yang berkenaan, dengan kemudahan asas yang tidak boleh dikongsi antara pekerja yang berikut—

(a)

katil bujang dengan ukuran tidak kurang daripada 1.7 meter persegi, dan sekiranya katil dua tingkat disediakan, ruang antara dua katil hendaklah tidak kurang daripada 0.7 meter;

tilam dengan ketebalan minimum yang tidak kurang daripada 4 inci, bantal dan selimut; dan

almari yang berkunci yang tidak kurang daripada 0.35 meter panjang, 0.35 meter lebar dan 0.9 meter tinggi, untuk penyimpanan selamat barangan berharga pekerja termasuk paspot yang boleh diakses oleh pekerja pada bila-bila masa.

Bagi maksud suatu penginapan atau penginapan berpusat yang bukan berbentuk dormitori, mana-mana majikan atau penyedia penginapan berpusat hendaklah menyediakan bilik tidur dengan keluasan lantai yang tidak kurang daripada 3.6 meter persegi bagi setiap pekerja.

Bagi maksud suatu penginapan atau penginapan berpusat yang berbentuk dormitori, mana-mana majikan atau penyedia penginapan berpusat hendaklah menyediakan ruang tidur dengan keluasan lantai yang tidak kurang daripada 3 meter persegi bagi setiap pekerja.

AND AMENITIES ACT 1990

EMPLOYEES’ MINIMUM STANDARDS OF HOUSING, ACCOMMODATIONS AND AMENITIES

(ACCOMODATION AND CENTRALIZED ACCOMMODATION) REGULATIONS 2020

IN exercise of the powers conferred by paragraph 25(2)(aa)

of the

Employees’ Minimum Standards of Housing, Accommodations and Amenities Act 1990

[Act 446], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Employees’ Minimum Standards of

Housing, Accommodations and Amenities (Accommodation and Centralized

Accommodation) Regulations 2020.

(2)

These Regulations come into operation on 1 September 2020.

Application 2.

These Regulations shall apply to all employers and centralized accommodation providers who provides accommodation or centralized accommodation, as the case may be, under Part IIIA of the Act.

Minimum requirements 3.

(1)

Any employer or centralized accommodation provider shall provide an accommodation or a centralized accommodation, as the case may be, in accordance with the minimum requirements for classes of buildings as specified in the Schedule.

(2)

Any employer who contravenes subregulation (1) commits an offence.

(3)

Any centralized accommodation provider who contravenes subregulation (1)

commits an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.

Basic amenities which shall not be shared 4.

(1)

Any employer or centralized accommodation provider shall provide an accommodation or a centralized accommodation, as the case may be, with the following basic amenities which shall not be shared among employees—

(a)

a single bed with a measurement of not less than 1.7 square metres, and if a double-decker bed is provided, the space between the two beds shall not be less than 0.7 metres;

(b)

a mattress with a minimum thickness of not less than 4 inches, a pillow and a blanket; and

(c)

a locked cupboard of not less than 0.35 metres length, 0.35 metres width and 0.9 metres height, for the safe custody of the employees’

valuables including passport which may be accessible by the employees at any time.

(2)

Any employer or centralized accommodation provider shall provide either single beds or double-decker beds, in an accommodation or a centralized accommodation, as the case may be.

(3)

Any employer who contravenes subregulation (1) or (2) commits an offence.

(4)

Any centralized accommodation provider who contravenes subregulation (1)

or (2) commits an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.

Size of floor area for bedroom and sleeping area 5.

(1)

For the purpose of an accommodation or a centralized accommodation not in a form of a dormitory, any employer or centralized accommodation provider shall provide bedroom with floor area of not less than 3.6 square metres for each employee.

(2)

For the purpose of an accommodation or a centralized accommodation in a form of a dormitory, any employer or centralized accommodation provider shall provide sleeping area with floor area of not less than 3 square metres for each employee.

(3)

Any employer who contravenes subregulation (1) or (2) commits an offence.

(4)

Any centralized accommodation provider who contravenes subregulation (1)

or (2) commits an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.

Water supply and electricity supply 6.

(1)

Any employer or centralized accommodation provider shall ensure that there is water supply and electricity supply in an accommodation or a centralized accommodation, as the case may be.

(2)

Any employer who contravenes subregulation (1) commits an offence.

(3)

Any centralized accommodation provider who contravenes subregulation (1)

commits an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.
