Preamble

PADA menjalankan kuasa yang diberikan oleh seksyen 19 dan 45 Akta Tabung Haji 1995 [Akta 535], Lembaga, dengan kelulusan Menteri, membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan

Tabung Haji (Deposit dan Pengeluaran) (Pindaan) 2013.

(2)

Peraturan-Peraturan ini mula berkuat kuasa pada 10 Jun 2013.

Peraturan-Peraturan Lembaga Tabung Haji (Deposit dan Pengeluaran)

2002 [P.U. (A) 313/2002], yang dalam Peraturan-Peraturan ini disebut “Peraturan-Peraturan ibu”, dipinda dengan menggantikan perkataan “AKTA LEMBAGA TABUNG

HAJI” dan “Akta Lembaga Tabung Haji” masing-masingnya dengan perkataan “AKTA

TABUNG HAJI” dan “Akta Tabung Haji”.

Peraturan-Peraturan ibu dipinda dengan menggantikan perkataan

“PERATURAN-PERATURAN LEMBAGA TABUNG HAJI (DEPOSIT DAN PENGELUARAN)”

“cek, kiriman wang, kiriman pos atau waran dividen” dengan perkataan

“bentuk deposit bukan tunai”; dan

(b)

dengan memotong takrif “Lembaga”.

“(2) Pendeposit hendaklah, tidak lewat dari empat belas hari dari tarikh deposit atau pengeluaran atau tarikh penelitian akaun dibuat, memaklumkan kepada Lembaga mengenai apa-apa ketidakselarasan berhubung dengan akaun

pendeposit dan jika pendeposit itu gagal berbuat demikian, Lembaga tidaklah bertanggungan berkenaan dengan ketidakselarasan itu.”.

TABUNG HAJI (DEPOSITS AND WITHDRAWALS) (AMENDMENT) REGULATIONS 2013

Opening note

Preamble

IN exercise of the powers conferred by sections 19 and 45 of the Tabung Haji Act 1995 [Act 535], the Lembaga, with the approval of the Minister, makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Tabung Haji (Deposits and

Withdrawals) (Amendment) Regulations 2013.

(2)

These Regulations come into operation on 10 June 2013.

General amendment 2.

(1)

The Lembaga Tabung Haji (Deposits and Withdrawals) Regulations 2002

[P.U. (A) 313/2002], which in these Regulations are referred to as the “principal

Regulations”, are amended by substituting for the words “LEMBAGA TABUNG HAJI ACT”

and “Lembaga Tabung Haji Act” the words “TABUNG HAJI ACT” and “Tabung Haji Act”

respectively.

The principal Regulations are amended by substituting for the words

“LEMBAGA TABUNG HAJI (DEPOSITS AND WITHDRAWALS) REGULATIONS” and

“Lembaga Tabung Haji (Deposits and Withdrawals) Regulations” the words

“TABUNG HAJI (DEPOSITS AND WITHDRAWALS) REGULATIONS” and “Tabung Haji

(Deposits and Withdrawals) Regulations” respectively.

Amendment of regulation 2 3.

Regulation 2 of the principal Regulations is amended—

(a)

in the definition of “amount deposited”, by substituting for the words

“cheque, money order, postal order or dividend warrant” the words

“form of non-cash deposits”; and

(b)

by deleting the definition of “Lembaga”.

Amendment of regulation 3 4.

Regulation 3 of the principal Regulations is amended—

(a)

in paragraph (1)(e), by substituting for the words “.; or” a semi colon;

(b)

in paragraph (1)(f), by substituting for the full stop the words “; or”;

(c)

by inserting after paragraph (1)(f), the following paragraph:

“(g) by electronic facilities where deposits may be made via the transfer of money from a bank appointed by the Lembaga from time to time.”; and

(d)

in subregulation (2), by substituting for the words “by cheque, money order, postal order or dividend warrant” the words “any forms of non-cash prescribed by the Lembaga”.

Amendment of regulation 4 5.

Subregulation 4(3) of the principal Regulations is amended—

(a)

by substituting for the word “shall” the word “may”; and

(b)

by deleting the words “together with an acknowledgement receipt of the deposit made, containing the particulars mentioned in subregulation 5(2)”.

Deletion of regulation 5 6.

The principal Regulations are amended by deleting regulation 5.

Amendment of regulation 6 7.

Regulation 6 of the principal Regulations is amended—

(a)

in subregulation (2), by substituting for the words “The savings account book of the depositor shall be presented to the Lembaga” the words “The depositor or the person referred to in regulation 8 shall appear in person”;

(b)

in subregulation (5), by substituting for the words “with unlimited frequency” the words “or at such place as may be determined by the

Lembaga with unlimited frequency and amount”; and

(c)

by deleting subregulation (6).

Amendment of regulation 7 8.

Subregulation 7(3) of the principal Regulations is amended by deleting the words “or address of the nominee”.

Amendment of regulation 12 9.

Regulation 12 of the principal Regulations is amended by substituting for subregulation (2) the following subregulation:

“(2) Depositor shall, not later than fourteen days from the date of deposit or withdrawal or the date of the perusal of the account is made, inform the

Lembaga of any inconsistency in relation to the depositor account and if the depositor fails to do so, the Lembaga shall not be liable in respect of the inconsistency.”.
