FEDERAL ROADS (PRIVATE MANAGEMENT) (COLLECTION OF TOLLS)

(BUTTERWORTH-KULIM EXPRESSWAY) (AMENDMENT) ORDER 2016

IN exercise of the powers conferred by section 2

of the

Federal Roads (Private Management) Act 1984 [Act 306], the Minister makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Federal Roads (Private Management)

(Collection of Tolls) (Butterworth-Kulim Expressway) (Amendment) Order 2016.

(2)

This Order is deemed to have come into operation on 12 January 2012.

Amendment of paragraph 2 2.

(Butterworth-Kulim Expressway) Order 1996 [P.U. (A) 564/1996], which is referred to as the “principal Order” in this Order, is amended in paragraph 2—

(a)

In subparagraph (1)—

(i)

by substituting for the words “Konsortium Lebuh Raya

Butterworth-Kulim

(KLBK)

Sdn.

Bhd.”

the words

“Projek Lebuh Raya Usahasama Berhad”;

(ii)

by substituting for the words “1 June 2005 to 27 June 2026”

the words “12 January 2012 to 31 December 2038”; and

(iii)

by substituting for the words “column (2) of Part I and II”

the words “column (1)”.

(b)

in subsubparagraph (1)(a), by substituting for the words “column (2)

of Part I of the First Schedule according to the concession years as specified in column (1)” the words “column (2) of the First Schedule”; and

(c)

in subsubparagraph (1)(b), by substituting for the words “column (2)

of Part II of the First Schedule according to the concession years as specified in column (1)” the words “column (2) of the First Schedule”.

Substitution of First Schedule 3.

The principal Order is amended by substituting for the First Schedule the following Schedule:

For the purpose of calculating the number of axles and wheels of a vehicle, the axles and wheels of any trailer towed by the vehicle shall be calculated as part of the axles and wheels of the vehicle.”
