PADA menjalankan kuasa yang diberikan oleh seksyen 2 Akta Jalan-Jalan Persekutuan (Pengurusan Persendirian)1984
[Akta 306], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Pemberikuasaan untuk memungut tol

Seksyen 2

(1)

Lebuhraya Pantai Timur 2 Sdn Bhd atau ejennya diberi kuasa—

(a)

bagi tempoh dari 15 Julai 2016 sehingga 2 Mei 2034, untuk meminta, memungut dan menyimpan tol yang berkenaan yang dinyatakan dalam ruang (2) Jadual Pertama di plaza tol yang dinyatakan dalam ruang (1) Jadual Pertama, bagi penggunaan ke mana-mana arah mana-mana bahagian jalan yang dikenali sebagai

Lebuh Raya Pantai Timur-Fasa 2 bermula dari kilometer 250.60 di koordinat U+435884.921, T+589311.032 Grid Rectified Skew

Orthomorphic (RSO) Geosentrik (GDM 2000) dan berakhir di kilometer 433.98 di koordinat U+590369.182, T+557480.317

Grid RSO Geosentrik (GDM 2000) termasuk Persimpangan

Bertingkat Cheneh, Plaza Tol Cheneh, Persimpangan Bertingkat

Cukai, Plaza Tol Cukai, Persimpangan Bertingkat Kijal, Plaza Tol

Kijal, Persimpangan Bertingkat Kerteh, Plaza Tol Kerteh,

Persimpangan Bertingkat Paka, Plaza Tol Paka, Persimpangan

Bertingkat Kuala Dungun, Plaza Tol Kuala Dungun, Persimpangan

Bertingkat Bukit Besi, Plaza Tol Bukit Besi, Persimpangan

bagi tempoh dari 15 Julai 2016 sehingga 31 Disember 2032, untuk meminta, memungut dan menyimpan tol yang berkenaan yang dinyatakan dalam ruang (2) Jadual Kedua di plaza tol yang dinyatakan dalam ruang (1) Jadual Kedua, bagi penggunaan ke mana-mana arah mana-mana bahagian jalan yang dikenali sebagai

Lebuh Raya Pantai Timur-Fasa 1 bermula dari kilometer 76.10 di koordinat U-29660.52, T-47978.07 Grid Cassini Negeri Pahang dan berakhir di kilometer 250.60 di koordinat U-111006.35,

T+45032.71 Grid Cassini Negeri Terengganu, oleh kelas kenderaan yang dinyatakan dalam ruang (2) Jadual Kedua.

Jalan yang dinyatakan dalam subsubperenggan (1)(a) dan (b) yang bagi penggunaannya tol dibenarkan diminta, dipungut dan disimpan ditunjukkan dalam peta dalam Jadual Ketiga dan Keempat.

Pengambilan tiket transit dan pembayaran tol

Seksyen 3

(1)

Seseorang pemandu kenderaan hendaklah, sebelum melalui mana-mana plaza tol masuk yang ditunjukkan dalam peta dalam Jadual Ketiga dan Keempat, mengambil satu tiket transit di plaza tol masuk itu dan hendaklah, sebelum melalui mana-mana plaza tol keluar yang ditunjukkan dalam Jadual Ketiga dan Keempat, mengemukakan tiket transit itu di plaza tol keluar itu dan membayar tol yang kena dibayar di bawah subsubperenggan 2(1)(a) dan (b).

Seseorang pemandu kenderaan yang menggunakan kad atau peranti elektronik hendaklah melalui lorong tol yang mempunyai suatu mesin pembaca kad atau peranti elektronik, menghampiri mesin pembaca itu dan menyentuhkan kad atau

peranti elektronik ke mesin pembaca itu, dan tol yang kena dibayar hendaklah ditolak daripada kad atau peranti elektronik itu.

Seseorang pemandu kenderaan yang menggunakan tag elektronik hendaklah, sebelum melalui lorong tag elektronik yang dikhaskan, mempamerkan tag elektronik atau tag elektronik dengan kad atau peranti elektronik di cermin hadapan kenderaan, dan tol yang kena dibayar hendaklah ditolak daripada tag elektronik atau kad atau peranti elektronik itu.

“Kad atau peranti elektronik” dan “tag elektronik” yang disebut dalam perenggan ini ertinya—

(a)

sesuatu kad atau peranti elektronik dan tag elektronik yang dibenarkan oleh Menteri, yang dikeluarkan bagi maksud pembayaran tol;

(b)

berhubung dengan sesuatu kad atau peranti elektronik, suatu kad atau peranti elektronik yang boleh dibaca oleh mesin pembaca yang dipasang di lorong tol; dan

(c)

berhubung dengan sesuatu tag elektronik, suatu tag elektronik yang boleh menyebabkan palang di lorong tag elektronik yang dikhaskan dinaikkan secara elektronik.

Pengecualian daripada pembayaran tol

Seksyen 4

Walau apa pun peruntukan Perintah ini, kenderaan yang dinyatakan dalam

Jadual

Jadual Kelima dikecualikan daripada pembayaran tol.

(EAST COAST EXPRESSWAY-PHASE 2) ORDER 2016

IN exercise of the powers conferred by section 2

of the

Federal Roads (Private Management) Act 1984 [Act 306], the Minister makes the following order:

Citation and commencement 1.

This order may be cited as the

Federal

Roads

(Private Management) (Collection of Tolls) (East Coast Expressway-Phase 2)

Order 2016.

(2)

This Order comes into operation on 15 July 2016.

Authorization to collect tolls 2.

(1)

The East Coast Expressway 2 Sdn Bhd or its agent is authorized—

(a)

for the period from 15 July 2016 to 2 May 2034, to demand, collect and retain the appropriate tolls specified in column (2) of the First Schedule at the toll plaza specified in column (1) of the

First Schedule, for the use in either direction of any part of the road known as the East Coast Expressway-Phase 2 commencing from kilometre 250.60

for the period from 15 July 2016 to 31 December 2032, to demand, collect and retain the appropriate tolls specified in column (2) of the Second Schedule at the toll plaza specified in column (1) of the

Second Schedule, for the use in either direction of any part of the road known as the East Coast Expressway-Phase 1 commencing from kilometre 76.10 at coordinates N-29660.52, E-47978.07 of the Pahang State Cassini Grid and ending at kilometre 250.60 at coordinates N-111006.35, E+45032.71 of the Terengganu State

Cassini Grid, by any classes of vehicles specified in column (2) of the Second Schedule.

The roads specified in subsubparagraphs (1)(a) and (b) for the use of which tolls are authorized to be demanded, collected and retained are shown on the map in the Third and Fourth Schedules.

Collection of transit ticket and payment of toll 3.

(1)

A driver of a vehicle shall, before passing through any of entry toll plazas shown on the map in the Third and Fourth Schedules, collect a transit ticket at the entry toll plaza and shall, before passing through any of the exit toll plazas shown in the

Third and Fourth Schedules, produce the transit ticket at the exit toll plaza and pay the toll payable under subsubparagraphs 2(1)(a) and (b).

(2)

A driver of a vehicle who uses an electronic card or device shall pass through a toll lane having an electronic card or device reader, approach the reader and touch the electronic card or device on the reader, and the toll payable shall be deducted from the electronic card or device.

(3)

A driver of a vehicle who uses an electronic tag shall, before passing through the dedicated electronic tag lane, display the electronic tag or the electronic tag

with an electronic card or device at the windscreen of the vehicle, and the toll payable shall be deducted from the electronic tag or the electronic card or device.

(4)

“Electronic card or device” and “electronic tag” referred to in this paragraph means—

(a)

an electronic card or device and electronic tag as approved by the

Minister, issued for the purpose of payment of tolls;

(b)

in relation to an electronic card or device, an electronic card or device which is capable of being read by the reader installed at the toll lane; and

(c)

in relation to an electronic tag, an electronic tag which is capable of causing the pole at the dedicated electronic tag lane to be raised electronically.

Exemption from payment of toll 4.

Notwithstanding the provisions of this Order, the vehicles specified in the

Fifth Schedule are exempted from payment of toll.

Any vehicles carrying the Yang di-Pertuan Agong or the Raja Permaisuri Agong, the Rulers or their consorts, the Yang di-Pertua Negeri of the States of Malacca,

Penang, Sabah and Sarawak or their wives, the Dato'-Dato' Undang Negeri

Sembilan or the Tengku Besar Tampin or their wives, the Tengku Mahkota or the

Raja Muda of any State or their wives, the Raja Di-Hilir of Perak or his wife, or any visiting foreign dignitary.

Any Government vehicle carrying the Prime Minister or the Deputy Prime

Minister.

All military vehicles belonging to the Government or to any visiting force as defined in the Visiting Forces Act 1960 [Act 432].

All Government vehicles solely engaged in ambulance duties, firefighting duties, police duties or rescue duties inclusive of rescue team vehicles of the Civil Defence

Department and vehicles of the Prison Department whilst on prisoner escort duties.

All vehicles not being Government vehicles solely engaged in ambulance duties, firefighting duties and rescue duties.

All three-wheeled or four-wheeled motorcycles used by any handicapped person.
