CUSTOMS (ANTI-DUMPING DUTIES) (NO. 3) 2020 (AMENDMENT) ORDER 2021

Opening note

Preamble

IN exercise of the powers conferred by section 25 of the Countervailing and Anti-Dumping Duties Act 1993 [Act 504] and subsection 11(1) of the Customs Act 1967 [Act 235], the Minister makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Customs (Anti-Dumping Duties)

(No. 3) 2020 (Amendment) Order 2021.

(2)

This Order is deemed to have effect for a period of five years from 12 December 2020 to 11 December 2025.

Amendment of paragraph 2 2.

The Customs (Anti–Dumping Duties) (No.3) Order 2020 [P.U. (A) 348/2020], which is referred to as the “principal Order” in this Order, is amended in paragraph 2—

(a)

by renumbering the existing provision as subparagraph (1); and

(b)

by inserting after subparagraph (1) as renumbered the following subparagraph:

“ (2)

Notwithstanding subparagraph 2(1), anti-dumping duties shall not be imposed on the goods specified in columns (1) and (2)

of the Schedule exported from The People’s Republic of China by producer or exporter Yieh Phui (China) Technomaterial Co., Ltd. and

The Socialist Republic of Viet Nam by producer or exporter Southern

Steel Sheet Co., Ltd.”.

Amendment of Schedule 3.

The Schedule to the principal Order is amended, in column (4)—

(a)

in relation to The People’s Republic of China by substituting for the word

“Others” the words “Others (except Yieh Phui (China) Technomaterial Co.,

Ltd.)”; and

(b)

in relation to The Socialist Republic of Viet Nam by substituting for the word “Others” the words “Others (except Southern Steel Sheet Co., Ltd.)”.
