PADA menjalankan kuasa yang diberikan oleh seksyen 5A Akta Kawalan Bekalan 1961 [Akta 122], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Tertakluk kepada perenggan 3,

Menteri mengecualikan mana-mana pemegang lesen bagi pengedaran dan pengimportan, atau peruncitan gas petroleum cecair di bawah Ordinan Pengagihan Gas, 2016 [Sarawak Bab 72] daripada kehendak di bawah peraturan 3 Peraturan-Peraturan Kawalan Bekalan 1974 [P.U. (A) 103/1974].

Seksyen 3

Syarat pengecualian

Pengecualian di bawah perenggan 2 adalah tertakluk kepada syarat yang berikut:

(a)

pemegang lesen itu hendaklah memastikan bahawa bekalan gas petroleum cecair di Sarawak mencukupi pada setiap masa;

(b)

pemegang lesen itu hendaklah memastikan bahawa bekalan gas petroleum cecair yang diedar, diimport atau diruncitkan olehnya adalah hanya untuk pemasaran di pasaran Sarawak melainkan dengan kebenaran bertulis terlebih dahulu daripada Menteri;

(c)

pemegang lesen itu hendaklah memastikan bahawa harga bersubsidi gas petroleum cecair mengikut harga yang ditentukan oleh Pengawal Harga di bawah Akta Kawalan Harga dan Antipencatutan 2011 [Akta 723];

(d)

pemegang lesen itu hendaklah memperoleh bekalan gas petroleum cecair bersubsidi daripada pembekal sebagaimana yang ditentukan oleh

Kementerian Kewangan; dan

(e)

apa-apa syarat lain sebagaimana yang dikenakan oleh Menteri melalui notis.

CONTROL OF SUPPLIES ACT 1961

CONTROL OF SUPPLIES (EXEMPTION) ORDER 2021

Preamble

IN exercise of the powers conferred by section 5A of the Control of Supplies Act 1961 [Act 122], the Minister makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Control of Supplies (Exemption)

Order 2021.

(2)

This Order comes into operation on 1 June 2021.

Exemption 2.

Subject to paragraph 3, the Minister exempts any licensee for the distribution and importation, or retail of liquefied petroleum gas under the

Distribution of Gas Ordinance, 2016 [Sarawak Cap. 72] from the requirement under regulation 3 of the Control of Supplies Regulations 1974 [P.U. (A) 103/1974].

Conditions of exemption 3.

The exemption under paragraph 2 is subject to the following conditions:

(a)

the licensee shall ensure that the supply of liquefied petroleum gas in Sarawak is sufficient at all times;

(b)

the licensee shall ensure that the supply of liquefied petroleum gas which is distributed, imported or retailed by the licensee is only for marketing in the market of Sarawak unless with prior written permission from the Minister;

(c)

the licensee shall ensure that the subsidized price of liquefied petroleum gas is acccording to the price determined by the Controller under the Price Control and Anti-Profiteering Act 2011 [Act 723];

(d)

the licensee shall obtain the supply of subsidized liquefied petroleum gas from a supplier as determined by the Ministry of Finance; and

(e)

any other condition as imposed by the Minister by notice.
