Preamble

PADA menjalankan kuasa yang diberikan oleh subseksyen 24(1) dan 25(1) dan seksyen 34 Akta Kawalan Pertukaran Wang 1953 [Akta 17], Pengawal Pertukaran Wang Asing membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Perintah ini bolehlah dinamakan Perintah Kawalan Pertukaran Wang

(Import dan Eksport) (Am) 2012.

(2)

Perintah ini mula berkuat kuasa pada 31 Januari 2012.

Tafsiran

Seksyen 2

Dalam Perintah ini—

“Akta” ertinya Akta Kawalan Pertukaran Wang 1953;

“wang kertas ringgit” ertinya wang kertas ringgit yang dikeluarkan oleh Bank

Negara Malaysia di bawah seksyen 20 Akta Bank Negara Malaysia 1958 [Akta 519] yang telah pun menjadi wang sah laku di Malaysia.

Seksyen 3

Pemakaian

Perenggan 24(1)(a) Akta hendaklah terpakai bagi wang kertas ringgit.

Seksyen 4

Pengecualian

(a)

di bawah subseksyen 24(1) Akta bagi pengimportan—

(i)

wang kertas ringgit yang tidak melebihi jumlah agregat bersamaan dengan sepuluh ribu Dolar Amerika Syarikat oleh mana-mana

pengembara ke Malaysia, pada dirinya atau dalam bagasinya atau selainnya dalam milikannya dalam mana-mana kapal, pesawat atau kenderaan dari suatu tempat di luar Malaysia;

(ii)

apa-apa Bil Perbendaharaan; dan

(iii)

apa-apa sijil hak milik bagi apa-apa sekuriti; dan

(b)

di bawah subseksyen 25(1) Akta bagi pengeksportan—

(i)

wang kertas ringgit yang tidak melebihi jumlah agregat bersamaan dengan sepuluh ribu Dolar Amerika Syarikat oleh mana-mana pengembara apabila meninggalkan Malaysia, pada dirinya atau dalam bagasinya atau selainnya dalam milikannya dalam mana-mana kapal, pesawat atau kenderaan ke mana-mana destinasi di luar Malaysia;

(ii)

apa-apa wang kertas asing;

(iii)

apa-apa wang pos;

(iv)

apa-apa Bil Perbendaharaan;

(v)

apa-apa sijil hak milik bagi apa-apa sekuriti dan kupon;

(vi)

apa-apa polisi insurans;

(vii)

apa-apa bil pertukaran atau nota janji hutang yang dinyatakan dalam mata wang asing dan boleh dibayar di mana-mana wilayah di luar Malaysia;

(viii)

apa-apa dokumen di mana seksyen 7 Akta terpakai dan bukan dikeluarkan oleh seorang peniaga yang diberi kuasa atau menurut

suatu kebenaran yang diberikan oleh Pengawal; dan

(ix)

apa-apa dokumen yang memperakui kemusnahan, kehilangan atau pembatalan apa-apa dokumen yang ditentukan dalam subsubperenggan 4(b)(v) hingga (viii).

Pemilikan wang kertas ringgit

Seksyen 5

Seorang pengembara yang tertakluk kepada subsubperenggan 4(a)(i) atau 4(b)(i) hendaklah disifatkan mempunyai pemilikan wang kertas ringgit jika wang kertas ringgit itu dalam jagaan sebenarnya atau dipegang oleh mana-mana orang lain yang tertakluk kepada kawalannya atau bagi dirinya atau bagi pihaknya.

EXCHANGE CONTROL (IMPORT AND EXPORT) (GENERAL) ORDER 2012

Opening note

Preamble

IN exercise of the powers conferred by subsections 24(1) and 25(1) and section 34 of the Exchange Control Act 1953 [Act 17], the Controller of Foreign Exchange makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Exchange Control (Import and Export)

(General) Order 2012.

(2)

This Order comes into operation on 31 January 2012.

Interpretation 2.

In this Order—

“Act” means the Exchange Control Act 1953;

“ringgit notes” means ringgit notes issued by the Central Bank of Malaysia under section 20 of the Central Bank of Malaysia Act 1958 [Act 519] which have at any time been legal tender in Malaysia.

Application 3.

Paragraph 24(1)(a) of the Act shall apply to a ringgit note.

Exemption 4.

A person shall be exempted from the prohibition imposed—

(a)

under subsection 24(1) of the Act on the importation of—

(i)

ringgit notes not exceeding the aggregate amount of ten thousand

United States Dollars equivalent by any traveller to Malaysia, on

his person or in his baggage or otherwise in his possession in any ship, aircraft or vehicle from some place outside Malaysia;

(ii)

any Treasury Bills; and

(iii)

any certificate of title to any security; and

(b)

under subsection 25(1) of the Act on the exportation of—

(i)

ringgit notes not exceeding the aggregate amount of ten thousand

United States Dollars equivalent by any traveller who is leaving

Malaysia, on his person or in his baggage or otherwise in his possession in any ship, aircraft or vehicle to any destination outside Malaysia;

(ii)

any foreign currency notes;

(iii)

any postal orders;

(iv)

any Treasury Bills;

(v)

any certificate of title to a security and any coupon;

(vi)

any policy of assurances;

(vii)

any bill of exchange or promissory note expressed in foreign currency and payable in any territory outside Malaysia;

(viii)

any document to which section 7 of the Act applies not issued by an authorised dealer or in pursuance of a permission granted by the Controller; and

(ix)

any document certifying the destruction, loss or cancellation of any

of the documents specified in subsubparagraphs 4(b)(v) to (viii).

Possession of ringgit notes 5.

A traveller who is subject to subsubparagraphs 4(a)(i) or 4(b)(i) shall be deemed to be in possession of ringgit notes if the same is in his actual custody or is held by any other persons subject to his control or for him or on his behalf.
