PADA menjalankan kuasa yang diberikan oleh subseksyen 54(7) Akta Kumpulan Wang Simpanan Pekerja 1991 [Akta 452], Menteri, setelah berunding dengan Lembaga, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Perintah ini bolehlah dinamakan Perintah Kumpulan Wang Simpanan

Pekerja (Tambahan dan Ubah suaian Maksud Pengeluaran di bawah

Subseksyen 54(6)) 2016.

(2)

Perintah ini mula berkuat kuasa pada 1 Januari 2017.

Tambahan dan ubah suaian maksud pengeluaran di bawah subseksyen 54(6)

Seksyen 2

Subseksyen 54(6) Akta ditambah dan diubah suai—

(a)

dengan menggantikan perenggan (da) dengan perenggan yang berikut:

“(da) ahli Kumpulan Wang itu telah menjual rumah yang telah digadaikan sebagai cagaran bagi pinjaman di bawah perenggan (d)

dan dia kemudiannya—

(i)

telah membeli atau membina rumah yang lain dan telah mengambil pinjaman lain dan rumah baharu itu telah digadaikan sebagai cagaran bagi pinjaman lain itu; atau

(ii)

telah membeli rumah yang lain daripada Perbadanan

Perumahan Rakyat 1Malaysia dan telah mengambil pinjaman lain dan rumah baharu itu telah digadaikan sebagai cagaran bagi pinjaman lain itu;”; dan 3

(b)

dengan memasukkan selepas perenggan (da) perenggan yang berikut:

“(db)

ahli Kumpulan Wang itu telah membeli rumah daripada

Perbadanan Perumahan Rakyat 1Malaysia dan telah mengambil pinjaman dan rumah itu telah digadaikan sebagai cagaran untuk pinjaman itu;”.

EMPLOYEES PROVIDENT FUND (ADDITION AND MODIFICATION TO THE PURPOSES

FOR WITHDRAWAL UNDER SUBSECTION 54(6)) ORDER 2016

Opening note

Preamble

IN exercise of the powers conferred by subsection 54(7) of the Employees Provident Fund Act 1991 [Act 452], the Minister, after consulting the Board, makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Employees Provident Fund (Addition and Modification to the Purposes for Withdrawal under Subsection 54(6))

Order 2016.

(2)

This Order comes into operation on 1 January 2017.

Addition and modification to the purposes for withdrawal under subsection 54(6)

Seksyen 2

Subsection 54(6) of the Act is added to and modified—

(a)

by substituting for paragraph (da) the following paragraph:

“(da) the member of the Fund has sold the house charged as security for the loan under paragraph (d) and has subsequently—

(i)

purchased or built another house and has taken another loan and the new house has been charged as security for that other loan; or

(ii)

purchased another house from Perbadanan Perumahan

Rakyat 1Malaysia and has taken another loan and the new house has been charged as security for that other loan;”;

and

(b)

by inserting after paragraph (da) the following paragraph:

“(db)

the member of the Fund has purchased a house from Perbadanan

Perumahan Rakyat 1Malaysia and has taken a loan and the house has been charged as security for the loan;”.
