Perintah ini disifatkan telah mula berkuat kuasa pada 29 November 2022.
Pemakaian dan ketidakpakaian
Perintah Lembaga Getah Malaysia (Ses) 1999 [P.U. (A) 309/1999]
tidak terpakai bagi keluaran getah sebagaimana yang dinyatakan dalam ruang (2) Jadual yang dikeluarkan di dalam dan dieksport dari Semenanjung Malaysia ke Negara Pejanji.
Tafsiran
Dalam Perintah ini—
“Negara Pejanji” ertinya mana-mana negara yang merupakan pihak kepada
Perjanjian Komprehensif dan Progresif bagi Perkongsian Trans-Pasifik atau mana-mana wilayah kastam berasingan yang Perjanjian Komprehensif dan Progresif bagi
Perkongsian Trans-Pasifik berkuat kuasa;

“Perjanjan Komprehensif dan Progresif bagi Perkongsian Trans-Pasifik” ertinya suatu perjanjian berhubung dengan perdagangan bebas yang ditandatangani di Santiago, Chile pada 8 Mac 2018 yang mula berkuat kuasa pada 29 November 2022.
Pengenaan ses
Kadar ses sebagaimana yang dinyatakan dalam ruang (4) Jadual hendaklah dikenakan ke atas keluaran getah yang dinyatakan dalam ruang (2) dan (3) Jadual, sama ada keluaran getah itu dibuat secara keseluruhannya atau sebahagiannya daripada getah, yang dikeluarkan di dalam dan dieksport dari Semenanjung Malaysia ke
Negara Pejanji.

Penjenisan keluaran getah
Penjenisan keluaran getah yang dinyatakan dalam Jadual hendaklah mematuhi Rukun-Rukun Tafsiran dalam Perintah Duti Kastam yang berkuat kuasa.
Nombor kepala atau subkepala yang dinyatakan dalam ruang (3) Jadual diperuntukkan bagi kemudahan rujukan dan tidak mempunyai kesan mengikat bagi penjenisan keluaran getah yang diperihalkan dalam ruang (2) Jadual.
Tempat pemungutan
Ses yang dikenakan di bawah perenggan 4 hendaklah dipungut oleh pihak berkuasa yang berkenaan di tempat eksport sebagaimana yang ditetapkan di bawah

MALAYSIAN RUBBER BOARD (INCORPORATION) ACT 1996
MALAYSIAN RUBBER BOARD (INCORPORATION) (CESS) (RUBBER PRODUCTS
UNDER THE COMPREHENSIVE AND PROGRESSIVE AGREEMENT
FOR TRANS-PACIFIC PARTNERSHIP) ORDER 2024
IN exercise of powers confferred by section 37 of the Malaysian Rubber Board
(Incorporation) Act 1996 [Act 551], the Minister, after consultation with the Minister of Finance, makes the following order:
Citation and commencement 1.
(1)
This order may be cited as the Malaysian Rubber Board (Incorporation)
(Cess) (Rubber Products under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership) Order 2024.
(2)
This Order is deemed to have come into operation on 29 November 2022.
Application and non-application 2.
(1)
This Order shall apply to Peninsular Malaysia.
(2)
The Malaysian Rubber Board (Cess) Order 1999 [P.U. (A) 309/1999]
shall not apply to any rubber products as specified in column (2) Schedule which produced in and exported from Peninsular Malaysia to the Contracting States.
Interpretation 3.
In this Order—
“Contracting States” means any state which is a party to the Comprehensive and
Progressive Agreement for Trans-Pacific Partnership or any separate custom territory for which the Comprehensive and Progressive Agreement for Trans-Pacific Partnership is in force;

“Comprehensive and Progressive Agreement for Trans-Pacific Partnership”
means an agreement in relation to free trade signed at Santiago, Chile on 8 March 2018
which comes into operation on 29 November 2022.
Imposition of cess 4.
(1)
The rates of cess as specified in column (4) of the Schedule shall be imposed on the rubber products specified in columns (2) and (3) of the Schedule, whether the rubber products made wholly or partly from rubber, which produced in and exported from Peninsular Malaysia to the Contracting States.
(2)
Subparagraph (1) shall not apply to imported rubber products that are re-exported.
Classification of rubber products 5.
(1)
The classification of the rubber products specified in the Schedule shall be governed by the Rules of Interpretation in the Customs Duties Order in force.
(2)
The heading or subheading numbers specified in column (3) of the Schedule are provided for ease of reference and have no binding effect on the classification of the rubber products described in column (2) of the Schedule.
Point of collection 6.
The cess imposed under paragraph 4 shall be collected by the relevant authority at the point of export as prescribed under the Customs Act 1967 [Act 235] and the Customs Regulations 2019 [P.U. (A) 397/2019].
