(LABUAN FINANCIAL INSTITUTIONS) ORDER 2012

IN exercise of the powers conferred by section 32A of the Labuan Financial Services

Authority Act 1996 [Act 545], the Authority, with the approval of the Minister makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Labuan Financial Services Authority

(Processing and Approval Fees) (Labuan Financial Institutions) Order 2012.

(2)

This Order comes into operation on 1 January 2013.

Fee for matters under the Labuan Financial Services and Securities Act 2010 2.

The fees prescribed in the First Schedule shall be charged for the services provided by the Authority under the Labuan Financial Services and Securities Act 2010

[Act 704].

Fee for matters under the Labuan Islamic Financial Services and Securities

Act 2010 3.

The fees prescribed in the Second Schedule shall be charged for the services provided by the Authority under the Labuan Islamic Financial Services and Securities

Act 2010 [Act 705].

Fee for matters under the Labuan Trusts Act 1996 4.

The fees prescribed in the Third Schedule shall be charged for the services provided by the Authority under the Labuan Trusts Act 1996 [Act 554].

Fee for matters under the Labuan Companies Act 1990 5.

The fees prescribed in the Fourth Schedule shall be charged for the services provided by the Authority under the Labuan Companies Act 1990 [Act 441].

The fees prescribed in the Fifth Schedule shall be charged for the services provided by the Authority under the Labuan Foundations Act 2010 [Act 706].

The fees prescribed in the Sixth Schedule shall be charged for the services provided by the Authority under the Labuan Limited Partnerships and Limited Liability

Partnerships Act 2010 [Act 707].

Payment of fees 8.

(1)

The fees payable to the Authority in relation to the lodgement or filing of a document shall be paid at the time the document is lodged or filed.

(2)

Where a fee is payable for or in relation to the lodgement or filing of a document and the document is lodged or filed without payment of the fee, the document is deemed not to have been lodged or filed until the fee has been paid.

(3)

Where a fee is payable for or in relation to any matter involving the doing of any act or thing by the Authority, the Authority has the power to refuse to do that act or thing until the fee has been paid.

Revocation 9.

The Labuan Financial Services Authority (Processing and Approval Fees)
