- PADA menjalankan kuasa yang diberikan oleh subseksyen 380(1) Akta Pasaran Modal dan Perkhidmatan 2007 [Akta 671], Menteri, atas syor Suruhanjaya, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Bahagian 2 Jadual 2 Akta ibu dipinda dengan menggantikan perenggan 3 dengan perenggan yang berikut:
“3.
“Pengurusan kumpulan wang” ertinya mengaku janji bagi pihak mana-mana orang lain untuk menguruskan—
(a)
suatu portfolio sekuriti atau derivatif atau gabungan kedua-duanya, oleh pengurus kumpulan wang portfolio, sama ada atas kuasa budi bicara atau selainnya; atau
(b)
suatu aset atau kelas aset dalam suatu skim unit amanah oleh pengurus kumpulan wang aset.”.

CAPITAL MARKETS AND SERVICES (AMENDMENT OF SCHEDULE 2) ORDER 2012
Opening note
Preamble
- IN exercise of the powers conferred by subsection 380(1) of the Capital Markets and Services Act 2007 [Act 671], the Minister, on the recommendation of the Commission, makes the following order: Citation and commencement 1.
(1)
This order may be cited as the Capital Markets and Services
(Amendment of Schedule 2) Order 2012.
(2)
This Order comes into operation on 28 December 2012.
Amendment of Schedule 2 2.
Part 2 of Schedule 2 to the principal Act is amended by substituting for paragraph 3 the following paragraph:
“3.
“Fund management” means undertaking on behalf of any other person the management of—
(a)
a portfolio of securities or derivatives or a combination of both, by a portfolio fund manager, whether on a discretionary authority or otherwise; or
(b)
an asset or a class of asset in a unit trust scheme by an asset fund manager.”.
