PERINTAH PENCEGAHAN PENGUBAHAN WANG HARAM, PENCEGAHAN PEMBIAYAAN KEGANASAN DAN HASIL DARIPADA AKTIVITI HARAM (PENGGUNAAN BAHAGIAN IV) (PINDAAN) 2021

Haram, Pencegahan Pembiayaan Keganasan dan Hasil daripada Aktiviti Haram

(Penggunaan Bahagian IV) (Pindaan) 2021.

Jadual Pertama kepada Akta apabila institusi pelapor itu menyediakan atau menjalankan aktiviti yang berikut bagi kliennya:”; dan

(b)

dalam subperenggan (2)—

(i)

dengan menggantikan subsubperenggan

(a)

dengan subsubperenggan yang berikut:

“(a)

mana-mana institusi pelapor yang menjalankan apa-apa aktiviti yang dinyatakan dalam perenggan 9 Jadual

Pertama kepada Akta;”;

(ii)

dengan menggantikan subsubperenggan

dengan subsubperenggan yang berikut:

“(b)

mana-mana institusi pelapor yang menjalankan apa-apa aktiviti yang dinyatakan dalam perenggan 10

Jadual Pertama kepada Akta;”;

(iii)

dengan menggantikan subsubperenggan

(c)

dengan subsubperenggan yang berikut:

“(c)

mana-mana institusi pelapor yang menjalankan apa-apa aktiviti yang dinyatakan dalam perenggan 11

ANTI-MONEY LAUNDERING, ANTI-TERRORISM FINANCING AND PROCEEDS OF

UNLAWFUL ACTIVITIES (INVOCATION OF PART IV) (AMENDMENT) ORDER 2021

IN exercise of the powers conferred by subsection 8(1)

of the

Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful

Activities Act 2001 [Act 613], the Minister of Finance, upon the recommendation of the competent authority, makes the following order:

Citation 1.

This order may be cited as the Anti-Money Laundering, Anti-Terrorism

Financing and Proceeds of Unlawful Activities (Invocation of Part IV) (Amendment)

Order 2021.

Amendment of paragraph 2 2.

The

Anti-Money

Order 2006

[P.U. (A) 293/2006], which is referred to as the “principal Order” in this Order, is amended in paragraph 2 by substituting for subsubparagraph (c) the following subsubparagraph:

“(c)

any reporting institution carrying out any activity specified in paragraph 23 of the First Schedule to the Act.”.

Amendment of paragraph 4 3.

Paragraph 4 of the principal Order is amended—

(a)

in subsubparagraph (1)(f), by substituting for the words “persons prescribed by the Minister or licensed by the Registrar of Companies to act as a company secretary of a company pursuant to section 139A of the Companies Act 1965 [Act 125], when they, whether in person or through a firm or company, prepare or carry out the following activities for their clients:” the words “any reporting institution carrying out any

activity specified in paragraph 13 of the First Schedule to the Act when the reporting institution prepares or carries out the following activities for its clients:”; and

(b)

in subparagraph (2)—

(i)

by substituting for subsubparagraph

(a)

the following subsubparagraph:

“(a)

any reporting institution carrying out any activity specified in paragraph 9 of the First Schedule to the Act;”;

(ii)

by substituting for subsubparagraph

(b)

the following subsubparagraph:

“(b)

any reporting institution carrying out any activity specified in paragraph 10 of the First Schedule to the Act;”;

(iii)

by substituting for subsubparagraph

(c)

the following subsubparagraph:

“(c)

any reporting institution carrying out any activity specified in paragraph 11 of the First Schedule to the Act;

and”;

(iv)

by substituting for subsubparagraph

(d)

the following subsubparagraph:

“(d)

any reporting institution carrying out any activity specified in paragraph 12 of the First Schedule to the Act,”; and

by substituting for the words “when they prepare or carry out the following activities for their clients:” the words “when the reporting institution prepares or carries out the following activities for its clients:”.
