Menteri mengecualikan perbadanan pengurusan daripada pemakaian peruntukan Akta yang dinyatakan dalam ruang (1) Jadual tertakluk kepada syarat yang dinyatakan dalam ruang (2).

Tempoh pengurusan permulaan hendaklah habis dalam tempoh mulai 18 Mac 2020 hingga 30 Jun 2021; dan

Tempoh apa-apa kontrak yang berhubungan dengan pengambilan kerja ejen dan pekhidmat mana-mana bangunan atau tanah yang dicadangkan untuk dipecah bahagi kepada petak-petak dan harta bersama di dalam kawasan pemajuan itu yang dibuat dalam tempoh mulai 18 Mac 2020 hingga 30 Jun 2021 hendaklah tidak melebihi satu bulan selepas mesyuarat agung tahunan diadakan.

STRATA MANAGEMENT ACT 2013

STRATA MANAGEMENT (EXEMPTION TO MANAGEMENT CORPORATION) ORDER 2021

IN exercise of the powers conferred by section 151 of the Strata Management Act 2013

[Act 757], the Minister after consultation with the National Council for Local Government, makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Strata Management (Exemption to

Management Corporation) Order 2021.

(2)

This Order is deemed to have come into operation from 18 March 2020

until 30 June 2021.

Exemption 2.

The Minister exempts a management corporation from the application of the provisions of the Act specified in column (1) of the Schedule subject to the conditions specified in column (2).

Savings 3.

(1)

This Order shall not affect any legal proceedings commenced or any judgment or award obtained within the period from 18 March 2020 until the date of publication of this Order in the Gazette.

(2)

Any action taken by a management corporation under the Act before or on the commencement of this Order shall be valid and shall not affect any legal proceedings commenced by or against the management corporation.

A certified true copy of the audited accounts together with the auditor’s report which need to be filed with the

Commissioner within the period from 18 March 2020

until 30 June 2021 shall be filed latest by 1 July 2021.

Paragraph 6 of the Second

(a)

The preliminary management period shall expire within the period from 18 March 2020 until 30 June 2021; and

(b)

The period of any contract relating to the employment of agents or servants of any building or land intended for subdivision into parcels and the common property in the development area entered into within the period from 18 March 2020 until 30 June 2021 shall not exceed one month after the annual general meeting is convened.

The annual general meeting which need to be convened within the period from 18

March 2020

until 30 June 2021 shall be convened latest by 1 July 2021.
