- PADA menjalankan kuasa yang diberikan oleh seksyen 151 Akta Pengurusan Strata 2013 [Akta 757], Menteri selepas berunding dengan Majlis Negara bagi Kerajaan Tempatan, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Pesuruhjaya
Bangunan daripada pemakaian subseksyen 92(5) Akta tertakluk kepada syarat yang berikut:
(a)
pemaju hendaklah mengemukakan permohonan bagi pembayaran balik deposit harta bersama kepada Pesuruhjaya Bangunan; dan
(b)
Pesuruhjaya Bangunan hendaklah berpuas hati dengan keadaan harta bersama sebelum deposit harta bersama itu dibayar balik kepada pemaju.

(1)
Perintah ini hendaklah tidak menjejaskan apa-apa prosiding undang-undang yang telah dimulakan atau apa-apa penghakiman atau award yang telah diperoleh dalam tempoh mulai 18 Mac 2020 hingga tarikh penyiaran Perintah ini dalam Warta.

Apa-apa tindakan yang diambil oleh Pesuruhajaya Bangunan di bawah
Akta sebelum atau pada permulaan kuat kuasa Perintah ini adalah sah dan hendaklah tidak menjejaskan apa-apa prosiding undang-undang yang dimulakan oleh atau terhadap
Pesuruhjaya Bangunan itu.

STRATA MANAGEMENT (EXEMPTION TO COMMISSIONER OF BUILDINGS)
ORDER 2021
Opening note
Preamble
- IN exercise of the powers conferred by section 151 of the Strata Management Act 2013 [Act 757], the Minister after consultation with the National Council for Local Government, makes the following order: Citation and commencement 1.
(1)
This order may be cited as the Strata Management (Exemption to
Commissioner of Buildings) Order 2021.
(2)
This Order is deemed to have come into operation from 18 March 2020
until 30 June 2021.
Exemption 2.
The Minister exempts the Commissioner of Buildings from the application of subsection 92(5) of the Act subject to the following conditions:
(a)
the developer shall submit an application for the repayment of the common property deposit to the Commissioner of Buildings; and
(b)
the Commissioner of Buildings shall be satisfied with the conditions of the common property before the deposit of the common property is refunded to the developer.
Savings 3.
(1)
This Order shall not affect any legal proceedings commenced or any judgment or award obtained within the period from 18 March 2020 until the date of publication of this Order in the Gazette.

(2)
Any action taken by the Commissioner of Buildings under the Act before or on the commencement of this Order shall be valid and shall not affect any legal proceedings commenced by or against the Commissioner of Buildings.
