- PADA menjalankan kuasa yang diberikan oleh seksyen 263 Akta Perkhidmatan Kewangan 2013 [Akta 758], Menteri, atas syor Bank, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Menteri mengecualikan—
(a)
Hydor AS, suatu agensi insurans yang didaftarkan di Norway daripada pemakaian perenggan 8(1)(a) Akta bagi maksud menjalankan perniagaan insurans berkenaan dengan insurans perlindungan dan indemniti bagi suatu kapal dengan 5,000 berat tan kasar atau kurang bagi tempoh dua tahun; dan
(b)
Archipelago Insurance Limited (No. Lesen IS2013136), suatu pemegang lesen insurans di bawah Akta Perkhidmatan Kewangan dan Sekuriti Labuan 2010 [Akta 704] daripada pemakaian perenggan 8(1)(a) Akta bagi maksud menjalankan perniagaan insurans berkenaan dengan insurans perlindungan dan indemniti bagi suatu kapal Malaysia dengan 300 berat tan kasar atau kurang bagi tempoh satu tahun.

“insurans perlindungan dan indemniti”
ertinya insurans perlindungan dan indemniti yang ditawarkan oleh Hydor AS atau
Archipelago Insurance Limited, mengikut mana-mana yang berkenaan, secara usaha sama dengan Perlindungan dan Indemniti
Malaysia Sdn. Bhd.; dan
(b)
“kapal Malaysia” mempunyai erti yang diberikan kepadanya dalam subseksyen 11(1)

FINANCIAL SERVICES (EXEMPTION) ORDER 2020

Preamble
- IN exercise of the powers conferred by section 263 of the Financial Services Act 2013 [Act 758], the Minister, upon the recommendation of the Bank, makes the following order: Citation and commencement 1.
(1)
The Minister exempts—
(a)
Hydor AS, an insurance agency registered in Norway from the application of paragraph 8(1)(a) of the Act for the purpose of carrying on insurance business in respect of protection and indemnity insurance for a ship of 5,000 gross tonnage or less for a period of two years; and
(b)
Archipelago
Insurance
Limited
(Licence
No.
IS2013136), an insurance licensee under the Labuan Financial Services and
Securities Act 2010 [Act 704] from the application of paragraph 8(1)(a) of the Act for the purpose of carrying on insurance business in respect of protection and indemnity insurance for a Malaysian ship of 300 gross tonnage or less for a period of one year.

In this paragraph—
(a)
“protection and indemnity insurance” means the protection and indemnity insurance offered by Hydor AS or Archipelago Insurance
Limited, as the case may be, in collaboration with the
Perlindungan dan Indemniti Malaysia Sdn. Bhd.; and
(b)
“Malaysian ship” has the meaning assigned to it in subsection 11(1)
of the Merchant Shipping Ordinance 1952 [Ord. 70/1952].
