Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 59 Akta Racun Makhluk Perosak 1974 [Akta 149], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
Tertakluk kepada perenggan 3,
Menteri mengecualikan seseorang yang mengilang racun makhluk perosak semata-mata untuk kegunaan pasaran bukan tempatan daripada—
(a)
kehendak di bawah seksyen 7 Akta bagi maksud permohonan pendaftaran racun makhluk perosak itu;
(b)
larangan di bawah perenggan 13(1)(b) Akta bagi maksud pengilangan racun makhluk perosak itu; dan
(c)
kehendak di bawah perenggan 15(2)(a) Akta bagi maksud permohonan bagi lesen untuk mengilang racun makhluk perosak itu.
Syarat pengecualian
Seksyen 3
(1)
Pengecualian di bawah perenggan 2 adalah tertakluk kepada syarat yang berikut:
(a)
perawis aktif yang digunakan adalah sama dengan perawis aktif yang buat masa ini didaftarkan bagi tujuan import atau pengilangan; dan

(b)
pengilang hendaklah mengemukakan kepada Lembaga laporan tahunan pengilangan bagi setiap racun makhluk perosak itu sebelum 31 Januari tahun berikutnya.
(2)
Menteri boleh membatalkan pengecualian di bawah perenggan 2
jika mana-mana syarat pengecualian di bawah subperenggan (1) tidak dipatuhi.

PESTICIDES ACT 1974
PESTICIDES (EXEMPTION) ORDER 2023
Opening note
Preamble
- IN exercise of the powers conferred by section 59 of the Pesticides Act 1974 [Act 149], the Minister makes the following order: Citation and commencement 1.
(2)
This Order comes into operation on 1 March 2023.
Exemption 2.
Subject to paragraph 3, the Minister exempts a person to manufacture a pesticide for the purpose solely for non-local market usage from—
(a)
the requirement under section 7 of the Act for the purpose of application for registration of the pesticide;
(b)
the prohibition under paragraph 13(1)(b) of the Act for the purpose of manufacturing of the pesticide; and
(c)
the requirement under paragraph 15(2)(a) of the Act for the purpose of application for a licence to manufacture the pesticide.
Condition of exemption 3.
(1)
The exemption under paragraph 2 is subject to the following conditions:
(a)
the active ingredient used is the same with the active ingredient for the time being registered for the purpose of importation or manufacturing; and

(b)
the manufacturer shall submit to the Board the annual report of manufacture for each of the pesticide before 31 of January of the following year.
(2)
The Minister may revoke the exemption under paragraph 2 if any condition under subparagraph (1) is not complied with.
