PADA menjalankan kuasa yang diberikan oleh seksyen 59 Akta Racun Makhluk Perosak 1974 [Akta 149], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

Perintah ini bolehlah dinamakan Perintah Racun Makhluk Perosak

(Pengecualian) (No. 2) 2020.

(2)

Perintah ini berkuat kuasa bagi tempoh mulai 15 Januari 2020

hingga 15 Januari 2025.

Pengecualian

Seksyen 2

(1)

Menteri mengecualikan mana-mana orang yang menggunakan racun makhluk perosak daripada kehendak untuk menggunakan mengikut penggunaan, sebagaimana yang diluluskan oleh Lembaga di bawah perenggan 53A(1)(b) Akta, yang dinyatakan pada label, tertakluk kepada syarat yang berikut:

(a)

penggunaan racun makhluk perosak hendaklah terhad kepada pengawalan Ulat Ratus (Spodoptera Frugiperda) yang merupakan perosak yang terdapat pada tanaman jagung; dan

(b)

penggunaan racun makhluk perosak hendaklah terhad kepada racun makhluk perosak yang mengandungi perawis aktif sebagaimana yang dinyatakan dalam Jadual.

PESTICIDES ACT 1974

PESTICIDES (EXEMPTION) (NO. 2) ORDER 2020

IN exercise of the powers conferred by section 59

of the

Pesticides Act 1974 [Act 149], the Minister makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Pesticides (Exemption) (No. 2)

Order 2020.

(2)

This Order has effect for the period from 15 January 2020

to 15 January 2025.

Exemption 2.

(1)

The Minister exempts any person who uses pesticides from the requirement to use in accordance with the uses, as approved by the Board under paragraph 53A(1)(b) of the Act, stipulated on the label, subject to the following conditions:

(a)

the use of pesticides shall be limited to the control of Fall

Armyworms (Spodoptera Frugiperda) which are pests found on corn crops; and

(b)

the use of pesticides shall be limited to pesticides which contain active ingredients as specified in the Schedule.
