PADA menjalankan kuasa yang diberikan oleh seksyen 59 Akta Racun Makhluk Perosak 1974 [Akta 149], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Perintah ini bolehlah dinamakan Perintah Racun Makhluk Perosak

(Pengecualian) (No. 2) 2023.

(2)

Perintah ini mula berkuat kuasa pada 1 Mac 2023.

Pengecualian

Seksyen 2

Tertakluk kepada perenggan 3, Menteri mengecualikan Behn Meyer Agricare (M)

Sdn. Bhd. (Nombor Pendaftaran Syarikat: 3636-V) berhubung dengan perawis aktif calcium cyanamide daripada—

(a)

kehendak untuk mendaftarkan racun makhluk perosak itu di bawah seksyen 7 Akta;

(b)

kehendak untuk mendapatkan lesen untuk mengilang racun makhluk perosak itu di bawah seksyen 15 Akta;

(c)

kehendak untuk mendapatkan lesen menjual atau menyimpan untuk jualan racun makhluk perosak itu di bawah seksyen 17 Akta; dan

(d)

larangan di bawah subperenggan 53A(1)(a) Akta bagi maksud untuk memiliki atau menggunakan racun makhluk perosak itu.

Syarat pengecualian

Seksyen 3

(1)

Pengecualian di bawah perenggan 2 adalah tertakluk kepada syarat yang berikut:

(a)

syarikat hendaklah memohon pendaftaran Perlka sebagai racun makhluk perosak; dan

(b)

syarikat tidak boleh menggunakan cap dagangan Perlka untuk baja sehingga pendaftaran di bawah subsubperenggan (a) selesai.

(2)

Menteri boleh membatalkan pengecualian di bawah perenggan 2 jika mana-mana syarat di bawah subperenggan (1) tidak dipatuhi.

PESTICIDES (EXEMPTION) (NO. 2) ORDER 2023

Preamble

IN exercise of the powers conferred by section 59 of the Pesticides Act 1974 [Act 149], the Minister makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Pesticides (Exemption) (No. 2) Order 2023.

(2)

This Order comes into operation on 1 March 2023.

Exemption 2.

Subject to paragraph 3, the Minister exempts Behn Meyer Agricare (M) Sdn. Bhd.

(Company Registration Number : 3636-V) in relation to the active ingredient calcium cyanamide from—

(a)

the requirement to register the pesticide under the section 7 of the Act;

(b)

the requirement to obtain a licence to manufacture the pesticide under section 15 of the Act;

(c)

the requirement to obtain a licence to sell or store for sale the pesticide under section 17 of the Act; and

(d)

the prohibition under subparagraph 53A(1)(a) of the Act for the purposes of possession or use of the pesticide.

Condition of exemption 3.

(1)

The exemption under paragraph 2 is subject to the following conditions:

(a)

the company shall apply to registering Perlka as a pesticide; and

(b)

the company shall not use the trade name Perlka for fertilizer until the registration under subsubparagraph (a) is completed.

(2)

The Minister may revoke the exemption under paragraph 2 if any condition under subparagraph (1) is not complied with.
