Preamble
- Pada menjalankan kuasa yang diberikan oleh seksyen 615 Akta Syarikat [Akta 777], Menteri, atas syor Suruhanjaya, membuat perintah yang berikut: Nama

Pemakaian
Perintah ini terpakai berhubung dengan mana-mana notis tuntutan di bawah perenggan 466(1)(a) Akta yang disampaikan dalam tempoh mulai 23 April 2020
hingga 31 Disember 2020.
Pengecualian
Seksyen 3
Menteri mengecualikan semua syarikat daripada perenggan 466(1)(a)
Akta yang memperuntukkan bahawa mana-mana syarikat hendaklah disifatkan tidak mampu membayar hutangnya jika syarikat itu mengabaikan apa-apa notis tuntutan oleh mana-mana pemiutang supaya membayar hutangnya atau supaya menjamin hutangnya atau mencapai persetujuan mengenai hutangnya sehingga memuaskan hati pemiutang itu dalam tempoh dua puluh satu hari selepas penyampaian notis tuntutan itu ke atasnya.

Syarat bagi pengecualian
Pengecualian di bawah perenggan 3 adalah tertakluk kepada syarat bahawa mana-mana syarikat hendaklah disifatkan tidak mampu untuk membayar hutangnya di bawah perenggan 466(1)(a) Akta jika syarikat itu mengabaikan apa-apa notis tuntutan oleh mana-mana pemiutang supaya membayar hutangnya atau supaya menjamin hutangnya atau mencapai persetujuan mengenai hutangnya sehingga memuaskan hati pemiutang itu dalam tempoh enam bulan selepas penyampaian notis tuntutan hutang itu ke atasnya.

Preamble
- In exercise of the powers conferred by section 615 of the Companies Act 2016 [Act 777], the Minister, upon the recommendation of the Commission, makes the following order: Citation
Seksyen 1
This order may be cited as the Companies (Exemption) (No. 2)
Order 2020.
Seksyen 2
Application
This Order applies in relation to any notice of demand under paragraph 466(1)(a) of the Act which is served within the period from 23 April 2020 to 31 December 2020.
Seksyen 3
Exemption
The Minister exempts all companies from paragraph 466(1)(a) of the Act which provides that any company shall be deemed to be unable to pay its debt if the company neglects any notice of demand by any creditor to pay its debt or to secure its debt or to compound its debt to the satisfaction of the creditor within a period of twenty-one days after the notice of demand is served on him.

Condition for exemption
The exemption under paragraph 3 is subject to the condition that any company shall be deemed to be unable to pay its debts under paragraph 466(1)(a)
of the Act if the company neglects any notice of demand by any creditor to pay its debt or to secure its debt or to compound its debt to the satisfaction of the creditor within a period of six months after the notice of demand is served on him.

The Companies (Exemption) Order 2020 [P.U. (A) 122/2020] is revoked.
