PADA menjalankan kuasa yang diberikan oleh seksyen 18 Akta Umur Persaraan Minimum 2012 [Akta 753], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

Perintah ini bolehlah dinamakan Perintah Umur Persaraan Minimum

(Pengecualian) (No. 2) 2016.

(2)

Perintah ini disifatkan telah mula berkuat kuasa pada 1 Julai 2013.

Seksyen 2

Menteri mengecualikan PETCO Trading Labuan Company LTD dengan nombor pendaftaran LL06781 daripada semua peruntukan Akta berhubung dengan pekerja lelaki eksekutif dan bukan eksekutif yang sebelum permulaan kuat kuasa Perintah ini—

(a)

telah memilih untuk menukar umur persaraan yang dinyatakan dalam kontrak perkhidmatan daripada enam puluh tahun kepada lima puluh lima tahun; dan

(b)

telah dibayar pampasan oleh PETCO Trading Labuan Company LTD berkenaan dengan penukaran umur persaraan yang disebut dalam subsubperenggan (a).

MINIMUM RETIREMENT AGE (EXEMPTION) (NO. 2) ORDER 2016

Opening note

Preamble

IN exercise of the powers conferred by section 18 of the Minimum Retirement Age Act 2012 [Act 753], the Minister makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Minimum Retirement Age (Exemption)

(No. 2) Order 2016.

(2)

This Order is deemed to have come into operation on 1 July 2013.

Exemption 2.

The Minister exempts PETCO Trading Labuan Company LTD with the registration number LL06781 from all provisions of the Act in relation to the executive and non-executive male employees who before the coming into operation of this

Order—

(a)

have opted to change the retirement age as stated in the contract of service from sixty years to fifty-five years; and

(b)

have been paid compensation by PETCO Trading Labuan Company LTD in respect of the change of the retirement age referred to in subsubparagraph (a).
