Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 5 Akta Perwakilan Kuasa 1956 [Akta 358], Menteri mewakilkan kuasanya di bawah subseksyen 3(1) Akta Pendanaan Kerajaan 1983 [Akta 275] seperti yang berikut:
(i)
untuk melaksanakan apa-apa obligasi berkenaan dengan penerimaan pelaburan bagi pihak Kerajaan Malaysia di bawah semua perjanjian pinjaman dan kemudahan antara Kerajaan
Malaysia sebagai peminjam dan mana-mana pemberi pinjam; dan
(ii)
untuk membuat dan menerbitkan semua surat cara yang membuktikan pelaburan yang dinyatakan dalam subperenggan (a)(i) yang perlu diterbitkan oleh Kerajaan Malaysia di bawah perjanjian pinjaman dan kemudahan itu; dan
(b)
kepada pegawai yang dinyatakan dalam Jadual B, untuk membuat dan menerbitkan semua surat cara yang membuktikan pelaburan yang dinyatakan dalam subperenggan (a)(i) yang perlu diterbitkan oleh
Kerajaan Malaysia di bawah perjanjian pinjaman dan kemudahan itu.

DELEGATION OF POWERS UNDER SECTION 5
Opening note
Preamble
- IN exercise of the powers conferred by section 5 of the Delegation of Powers Act 1956 [Act 358], the Minister delegates his powers under subsection 3(1) of the Government Funding Act 1983 [Act 275] as follows:
(i)
to give effect to any obligation in respect of the receipt of an investment on behalf of the Government of Malaysia under all loan and facility agreements between the Government of Malaysia as the borrower and any lender; and
(ii)
to create and issue all instruments evidencing the investment specified in subparagraph (a)(i) that need to be issued by the
Government of Malaysia under the loan and facility agreement;
and
(b)
to the officers specified in Schedule B, to create and issue all instruments evidencing the investment specified in subparagraph (a)(i) that need to be issued by the Government of Malaysia under the loan and facility agreement.
