PADA menjalankan kuasa yang diberikan oleh subseksyen 66(1) Akta Pengangkutan Jalan 1987 [Akta 333], Menteri membuat kaedah-kaedah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Kaedah-kaedah ini bolehlah dinamakan Kaedah-Kaedah Kenderaan

Motor (Pembinaan dan Penggunaan) (Pindaan) 2012.

(2)

Kaedah-Kaedah ini mula berkuat kuasa pada 1 September 2012.

Pindaan kaedah 15

Seksyen 2

Kaedah-Kaedah Kenderaan Motor (Pembinaan dan Penggunaan) 1959

[L.N. 170/1959], yang disebut “Kaedah-Kaedah ibu” dalam Kaedah-Kaedah ini, dipinda dalam kaedah 15 dengan memasukkan selepas subkaedah (10), subkaedah yang berikut:

“(11) Sistem brek yang dipasang pada tiap-tiap kenderaan motor hendaklah menepati spesifikasi berikut, mengikut kehendak keadaan:

(a)

United Nation Economic Commission for Europe (selepas ini disebut “UN ECE”) Regulation No. 13 Uniform Provisions

Concerning the Approval of Vehicles of Categories M, N, and O with

Regard to Braking;

(b)

UN ECE Regulation No. 13-H Uniform Provisions Concerning the

Approval of Passenger Cars with Regard to Braking; atau

(c)

UN ECE Regulation No. 78 Uniform Provisions Concerning the

Approval of Vehicles of Category L with Regard to Braking.

Jika penyambung brek dan stereng dikemaskan dengan bolt atau pin, bolt atau pin itu hendaklah dikunci dengan ketat dan jika berada dalam keadaan yang tidak mendatar, kepala bolt atau pin itu hendaklah berada di bahagian atas.

Brek gelendong tidak disifatkan sebagai sebahagian daripada sistem brek.

(14)

Tiap-tiap pertukaran peralatan brek servis hendaklah menepati spesifikasi berikut, mengikut kehendak keadaan:

(a)

UN ECE Regulation No. 90 Uniform Provisions Concerning the

Approval of Replacement Brake Lining Assemblies and Drum

Brake Lining for Power-Driven Vehicles and Their Trailers; atau

(b)

MS 1164 Specification for Road Vehicles – Replacement Brake

Lining Assemblies and Drum Brake Lining for Power-Driven

Vehicles.”.

Pindaan kaedah 30

Seksyen 3

Kaedah-Kaedah ibu dipinda dalam kaedah 30—

(a)

dalam subkaedah (2)—

(i)

dalam perenggan (c), dengan menggantikan noktah dengan perkataan “; atau”, dan

(ii)

dengan memasukkan selepas perenggan (c), perenggan yang berikut:

(d)

UN ECE Regulation No. 75 Uniform Provisions Concerning the Approval of Pneumatic Tyres for Motorcycles and

Mopeds”; dan

(b)

dengan memasukkan selepas subkaedah (2), subkaedah yang berikut:

“(3) Spesifikasi yang ditetapkan di bawah FMVSS Standard No. 119

dalam subkaedah (2) hendaklah terpakai bagi motosikal yang kapasiti silindernya melebihi 250 sentimeter padu atau had kelajuannya melebihi 180 kilometer sejam.”.

ROAD TRANSPORT ACT 1987

MOTOR VEHICLES (CONSTRUCTION AND USE) (AMENDMENT) RULES 2012

Opening note

Preamble

IN exercise of the powers conferred by subsection 66(1) of the Road Transport Act 1987 [Act 333], the Minister makes the following rules: Citation and commencement 1.

(1)

These rules may be cited as the Motor Vehicles (Construction and Use)

(Amendment) Rules 2012.

(2)

These Rules come into operation on 1 September 2012.

Amendment of rule 15 2.

The Motor Vehicles (Construction and Use) Rules 1959 [L.N. 170/1959], which is referred to as the “principal Rules” in these Rules, are amended in rule 15, by inserting after subrule 10 the following subrule:

“(11) A braking system equipped in every motor vehicle shall conform with the following specifications, as the case requires:

(a)

United Nation Economic Commission for Europe (hereinafter referred to as “UN ECE”) Regulation No. 13 Uniform Provisions

Concerning the Approval of Vehicles of Categories M, N, and O with

Regard to Braking;

(b)

UN ECE Regulation No. 13-H Uniform Provisions Concerning the

Approval of Passenger Cars with Regard to Braking; or

(c)

UN ECE Regulation No. 78 Uniform Provisions Concerning the

Approval of Vehicles of Category L with Regard to Braking.

Where brake and steering connections are secured with bolts or pins, the bolts or pins shall be threaded and effectively locked and when in any position other than horizontal, the head of the bolt or pin shall be uppermost.

(13)

Brake drum shall not be deemed to form part of the braking system.

(14)

Every replacement of service brake assembly shall conform with the following specifications, as the case requires:

(a)

UN ECE Regulation No. 90 Uniform Provisions Concerning the

Approval of Replacement Brake Lining Assemblies and Drum

Brake Lining for Power-Driven Vehicles and Their Trailers; or

(b)

MS 1164 Specification for Road Vehicles – Replacement Brake

Lining Assemblies and Drum Brake Lining for Power-Driven

Vehicles.”.

Amendment of rule 30 3.

The principle Rules are amended in rule 30—

(a)

in subrule (2)—

(i)

in paragraph (c), by substituting for the full stop the words “; or”;

and

(ii)

by inserting after paragraph (c), the following paragraph:

“(d) UN ECE Regulation No. 75 Uniform Provisions Concerning the Approval of Pneumatic Tyres for Motorcycles and

Mopeds”; and

(b)

by inserting after subrule (2) the following subrule:

“(3) The specification specified under FMVSS Standard No. 119 in subrule (2) shall apply to a motorcycle with cylinder capacity exceeding 250 cubic centimeters or speed rating above 180 kilometer per hour.”.
