AKTA KERAJAAN TEMPATAN 1976
Opening note
Undang-undang kecil ini bolehlah dinamakan Undang-Undang Kecil
Krematorium (Wilayah Persekutuan Putrajaya) 2012.
Undang-Undang Kecil ini hendaklah mula berkuat kuasa pada 1 Ogos 2012.
Pemakaian 2.
Undang-Undang Kecil ini hendaklah terpakai hanya bagi Wilayah Persekutuan
Putrajaya.
Tafsiran 3.
Dalam Undang-Undang Kecil ini, melainkan jika konteksnya menghendaki makna yang lain—
“krematorium” ertinya krematorium yang disediakan oleh Perbadanan di bawah subseksyen 94(1) Akta Kerajaan Tempatan 1976;
“penjaga krematorium” ertinya mana-mana orang yang telah dilantik oleh
Perbadanan untuk menguruskan urusan krematorium; dan

“Perbadanan” ertinya Perbadanan Putrajaya yang ditubuhkan di bawah seksyen 3 Akta Perbadanan Putrajaya 1995 [Akta 536].
Permohonan dan fi 4.
Tiada pembakaran mayat di krematorium boleh dibenarkan melainkan jika permohonan dibuat dalam borang sebagaimana yang disediakan oleh Perbadanan bagi maksud itu.
Permohonan hendaklah dibuat oleh mana-mana orang yang berikut:
seseorang yang diberi kuasa secara bertulis untuk membuat permohonan itu oleh waris kadim si mati;
mana-mana orang yang memperoleh permit menguburkan daripada polis atau pihak berkuasa hospital;
mana-mana orang lain yang memenuhi kehendak Perbadanan berkenaan dengan sebab-sebab mengapa permohonan itu tidak dibuat oleh mana-mana orang yang disebut dalam perenggan (a)
dan (b).
Perbadanan boleh meluluskan permohonan yang dibuat di bawah perenggan (2) tertakluk kepada—
pembayaran sejumlah fi sebagaimana yang ditetapkan dalam
Jadual; dan

apa-apa syarat dan sekatan sebagaimana yang ditentukan oleh
Perbadanan.
Larangan terhadap pembakaran mayat 5.
Tiada pembakaran mayat mana-mana si mati boleh dibenarkan di krematorium—
jika diketahui bahawa si mati telah memberi apa-apa arahan atau petunjuk, sama ada secara lisan atau bertulis, supaya mayatnya tidak dibakar atau dikuburkan; atau
Tiada pembakaran mayat mana-mana si mati boleh dibenarkan di krematorium sehingga diserahkan kepada penjaga krematorium suatu permit menguburkan yang dikeluarkan dengan sah oleh polis atau pihak berkuasa hospital berkenaan dengan si mati.
Masa pembakaran mayat 6.
Krematorium hendaklah dibuka untuk pembakaran mayat pada hari dan masa sebagaimana yang ditetapkan dalam Jadual.
Walau apa pun perenggan (1), Perbadanan boleh dalam keadaan tertentu membenarkan pembakaran mayat dijalankan di krematorium pada bila-bila masa selain masa yang ditetapkan dalam Jadual.

Spesifikasi keranda 7.
Sesuatu keranda yang digunakan untuk mengisi mana-mana mayat yang akan dibakar di krematorium hendaklah diperbuat daripada kayu menurut spesifikasi yang ditentukan oleh Perbadanan.
Pelupusan abu 8.
Selepas tiap-tiap pembakaran mayat, abu si mati hendaklah diserahkan kepada orang yang telah memohon pembakaran mayat itu, jika dia menuntutnya.
Jika, dalam masa empat belas hari selepas notis diberikan kepada orang yang telah memohon pembakaran mayat supaya mengambil abu itu, dia telah tidak berbuat demikian atau jika dia menunjukkan bahawa dia tidak berhajat untuk menuntutnya, abu itu hendaklah ditanam atau ditaburkan di suatu tempat sebagaimana yang ditentukan oleh Perbadanan.
Selagi abu si mati berada di dalam krematorium, abu si mati itu hendaklah disimpan dan ditanda atau ditempatkan dengan sewajarnya supaya boleh dikenal pasti dengan jelas.
Daftar pembakaran mayat 9.
Penjaga krematorium hendaklah menyimpan atau menyebabkan disimpan suatu daftar pembakaran mayat dalam bentuk yang ditetapkan oleh
Perbadanan dan hendaklah mengandungi butiran yang berikut yang berhubungan dengan setiap pembakaran mayat:
nama, nombor kad pengenalan, alamat tempat tinggal, pekerjaan, umur, jantina, agama dan taraf perkahwinan si mati;

pertalian hubungan antara orang yang memohon pembakaran mayat dengan si mati;
Butiran yang disebut dalam subperenggan 1(a) hingga (i), hendaklah dicatatkan dalam daftar pembakaran mayat selepas sahaja pembakaran mayat dijalankan dan butiran yang disebut dalam subperenggan 1(j) hendaklah dicatatkan dengan seberapa segera selepas abu itu dilupuskan di bawah Undang-Undang Kecil ini.
Penyimpanan rekod 10.
Penjaga krematorium hendaklah memastikan semua permohonan, permit dan dokumen lain yang berhubungan dengan setiap pembakaran mayat dinomborkan, difailkan dengan teratur dan dijaga dengan sebaiknya selama tempoh tujuh tahun dari tarikh pembakaran mayat.
Daftar pembakaran mayat atau mana-mana bahagian daftar pembakaran mayat tidak boleh dimusnahkan.

Pengecualian 11.
Perbadanan boleh mengecualikan mana-mana orang secara bersyarat atau tanpa syarat daripada mana-mana peruntukan Undang-Undang Kecil ini.

Apa-apa permohonan, permit, daftar atau dokumen yang dibuat, dikeluarkan atau disimpan di bawah Undang-Undang Kecil yang dibatalkan hendaklah disifatkan telah dibuat, dikeluarkan atau disimpan di bawah Undang-Undang Kecil ini, dan hendaklah terus berkuat kuasa sehingga ia dibatalkan atau digantikan di bawah
Undang-Undang Kecil ini.

LOCAL GOVERNMENT ACT 1976
IN exercise of the powers conferred by section 98 of the Local Government Act 1976
[Act 171], as modified by the Federal Territory of Putrajaya (Modification of Local
Government Act 1976) Order 2002 [P.U. (A) 142/2002], the Perbadanan Putrajaya makes and pursuant to section 103 of the said Act, the Minister confirms the following by-laws:
Citation and commencement 1.
(1)
These by-laws may be cited as the Crematorium (Federal Territory of
Putrajaya) By-Laws 2012.
(2)
These By-Laws shall come into operation on 1 August 2012.
Application 2.
These By-Laws shall apply only to the Federal Territory of Putrajaya.
Interpretation 3.
In these By-Laws, unless the context otherwise requires—
“crematorium” means the crematorium provided by the Perbadanan under subsection 94(1) of the Local Government Act 1976;
“person in charge of the crematorium” means any person who has been appointed by the Perbadanan to manage the affairs of the crematorium; and
"Perbadanan" means the Perbadanan Putrajaya established under section 3 of the Perbadanan Putrajaya Act 1995 [Act 536].

Application and fee 4.
(1)
No cremation at the crematorium shall be permitted unless an application is made in such form as the Perbadanan may provide for the purpose.
(2)
The application shall be made by any of the following persons:
(a)
next-of-kin of the deceased person;
(b)
a person who is authorized in writing to make the application by the next-of-kin of the deceased person;
(c)
the lawful personal representative of the deceased person;
(d)
any close relative of the deceased person;
(e)
any person who has obtained a permit to bury from the police or hospital authority;
(f)
any other persons who satisfy the Perbadanan as to the reason why the application is not made by the persons referred to in paragraphs (a) and (b).
(3)
The Perbadanan may approve the application made under paragraph 2
subject to—
(a)
payment of a fee as prescribed in the Schedule; and
(b)
any condition and restriction as the Perbadanan may specify.

Prohibition against cremation 5.
(1)
No cremation of any deceased person shall be permitted at the crematorium—
(a)
if it is known, believed, or suspected that the deceased person was a Muslim;
(b)
if there is doubt as to whether the deceased person was a Muslim;
(c)
if it is known that the deceased person had given any direction or indication, whether verbally or in writing, that his body should not be cremated or buried; or
(d)
if the identity of the deceased person has not been ascertained.
(2)
No cremation of any deceased person shall be permitted at the crematorium until it is produced to the person in charge of the crematorium a permit to bury lawfully issued by the police or hospital authority in respect of the deceased person.
Time for cremation 6.
(1)
The crematorium shall be available for the cremation of corpse on the day and at the time as prescribed in the Schedule.
(2)
Notwithstanding paragraph (1), the Perbadanan may in any particular case permit cremation to be carried out at the crematorium at any time other than the time prescribed in the Schedule.
Specification of coffin 7.
A coffin used for containing any corpse to be cremated at the crematorium shall be made of wood according to the specification as the Perbadanan may determine.

Disposal of ashes 8.
(1)
After every cremation, the ashes of the deceased person shall be surrendered to the person who applied for the cremation, if he claims them.
(2)
If, within fourteen days after notice has been given to the person who applied for the cremation to collect the ashes, he has not done so or if he has indicated that he does not wish to claim them, the ashes shall be interred or scattered at such place as the Perbadanan may determine.
(3)
While the ashes of the deceased person remain at the crematorium, they shall be properly stored and so marked or placed as to be clearly identified.
Register of cremation 9.
(1)
The person in charge of the crematorium shall keep or cause to be kept a register of cremation which shall be in such form as the Perbadanan may prescribe and in which shall be entered the following particulars relating to each cremation:
(a)
the serial number of the cremation;
(b)
the date of the cremation;
(c)
the name, identity card number, residential address, occupation, age, sex, religion and marital status of the deceased person;
(d)
the date, place and time of death of the deceased person;
(e)
the name, identity card number and address of the person who applied for the cremation;
(f)
relationship between the person who applied for the cremation with the deceased person;

(g)
the cause of death of the deceased person, if known;
(h)
the reference number of the permit to bury;
(i)
the name, designation and address of the person who issued the permit to bury;
(j)
the manner in which the ashes of the deceased person were disposed of.
(2)
The particulars referred to in subparagraphs 1(a) to (i), shall be entered in the register of cremation immediately after the cremation has taken place and the particulars referred to in subparagraph 1(j) shall be entered as soon as the ashes have been disposed of under these By-Laws.
Keeping of records 10.
(1)
The person in charge of the crematorium shall ensure that all applications, permits and other documents relating to each cremation are numbered, properly filed and carefully kept for a period of seven years from the date of the cremation.
(2)
The register of cremation or any part of the register of cremation shall not be destroyed.
Exemption 11.
The Perbadanan may conditionally or unconditionally exempt any person from any provision of these By-Laws.
Revocation 12.
The Crematorium (Perbadanan Putrajaya) By-Laws 1999 [Sel. P.U. 47/1999] is revoked.

Savings 14.
Any application, permit, register or document made, issued or kept under the revoked By-Laws shall be deemed to have been made, issued or kept under these By-Laws, and shall continue in force until revoked or replaced under these By-Laws.
