Keperibadian juridikal
Pertubuhan Bangsa-Bangsa Bersatu hendaklah mempunyai keperibadian juridikal dan apa-apa keupayaan di sisi undang-undang sebagaimana yang perlu bagi penjalanan kuasanya dan pelaksanaan fungsinya.
Keistimewaan dan kekebalan
Pertubuhan Bangsa-Bangsa Bersatu dan wakil anggota, pegawai dan pakar dalam misinya hendaklah mempunyai semua atau mana-mana keistimewaan dan kekebalan yang dinyatakan dalam Jadual Ketujuh kepada Akta.
Penepian
Perhimpunan Agung Pertubuhan Bangsa-Bangsa Bersatu hendaklah mempunyai hak untuk mengetepikan kekebalan yang diberikan kepada Pertubuhan

Bersatu daripada apa-apa proses undang-undang selain pelaksanaannya.
Sesuatu Negara Anggota Pertubuhan Bangsa-Bangsa Bersatu atau ketua suatu organisasi antarabangsa atau seberang laut masing-masing hendaklah mempunyai kuasa dan kewajipan untuk mengetepikan kekebalan yang diberikan kepada mana-mana orang yang hadir di persidangan yang diadakan oleh Pertubuhan
Bangsa-Bangsa Bersatu sebagai wakilnya jika, pada pandangan Negara Anggota atau ketua itu, kekebalan itu akan menghalang perjalanan keadilan dan boleh diketepikan tanpa menjejaskan maksud yang baginya kekebalan itu diberikan.
Setiausaha Agung Pertubuhan Bangsa-Bangsa Bersatu hendaklah mempunyai kuasa dan kewajipan untuk mengetepikan kekebalan yang diberikan kepada mana-mana Timbalan Setiausaha Agung atau Setiausaha Pertubuhan Bangsa-Bangsa Bersatu atau pegawai atau mana-mana orang yang sedang melaksanakan apa-apa misi bagi pihak Pertubuhan Bangsa-Bangsa Bersatu jika, pada pendapatnya, kekebalan itu akan menghalang perjalanan keadilan dan boleh diketepikan tanpa menjejaskan kepentingan
Pertubuhan Bangsa-Bangsa Bersatu.
Majlis Keselamatan Pertubuhan Bangsa-Bangsa Bersatu hendaklah mempunyai hak untuk mengetepikan kekebalan yang diberikan kepada Setiausaha
Agung Pertubuhan Bangsa-Bangsa Bersatu jika, pada pendapatnya, kekebalan itu akan menghalang perjalanan keadilan dan boleh diketepikan tanpa menjejaskan maksud yang baginya kekebalan itu diberikan.

INTERNATIONAL ORGANIZATIONS (PRIVILEGES AND IMMUNITIES) ACT 1992
UNITED NATIONS (PRIVILEGES AND IMMUNITIES) REGULATIONS 2012

IN exercise of the powers conferred by subsections 3(1) and 4(1), and sections 6A and 11 of the International Organizations (Privileges and Immunities) Act 1992 [Act 485], the Minister, with the concurrence of the Minister of Finance, makes the following regulations:
Citation 1.
These regulations may be cited as the United Nations (Privileges and
Immunities) Regulations 2012.
Interpretation 2.
In these Regulations, unless the context otherwise requires—
“subsidiary organs” means the organs established under the principal organs of the United Nations which includes—
an organ of or office within, the United Nations;
a commission, council or other body established by the United Nations or its organ; and
a committee or sub-committee of a committee, of the United Nations or its organ, commission, council or body, as specified in the Schedule;
“principal organs” means the organs established by the United Nations, namely the—
General Assembly;
Security Council;
Economic and Social Council;

Trusteeship Council;
International Court of Justice; and
Secretariat; and
“official” means an officer of the United Nations, other than an officer who is engaged locally.
Declaration of the United Nations to be an international organization 3.
The United Nations is declared to be an international organization.
Juridical personality 4.
The United Nations shall have juridical personality and such legal capacities as may be necessary for the exercise of its powers and the performance of its functions.
Privileges and immunities 5.
The United Nations and its representatives of members, officials and experts on missions shall have all or any of the privileges and immunities specified in the Seventh
Schedule to the Act.
Waiver 6.
The United Nations General Assembly shall have the right to waive the immunities conferred on the United Nations from any legal process other than its execution.
A Member State of the United Nations or the head of an international or overseas organization respectively shall have the power and duty to waive the immunities conferred on any person who is in attendance at conference convened by the United Nations as its representatives where, in the opinion of such Member State or such head, the immunities would impede the course of justice and can be waived without prejudicing the purposes for which they were conferred.
The Secretary-General of the United Nations shall have the power and duty to waive the immunities conferred on any Deputy Secretary-General or Undersecretary of

the United Nations or official or any person who is performing any mission on behalf of the United Nations where, in his opinion, the immunities would impede the course of justice and can be waived without prejudicing the interests of the United Nations.
The Security Council of the United Nations shall have the right to waive the immunities conferred on the Secretary-General of the United Nations where, in its opinion, the immunities would impede the course of justice and can be waived without prejudicing the purposes for which they were conferred.
Revocation 7.
The United Nations (Privileges and Immunities) Regulations 2009
