Preamble

PADA menjalankan kuasa yang diberikan oleh subseksyen 80(1) Akta Setem 1949 [Akta 378], Menteri membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

Perintah ini bolehlah dinamakan Perintah Duti Setem (Pengecualian)

(No. 4) 2012.

(2)

Perintah ini disifatkan telah mula berkuat kuasa pada 1 Januari 2012 dan hendaklah terus berkuat kuasa hingga 31 Disember 2013.

Seksyen 2

Surat cara yang berikut bagi pembelian rumah pangsa di bawah Program

Perumahan Rakyat Majlis Tindakan Ekonomi Negara dan Perumahan Awam Dewan

Bandaraya Kuala Lumpur yang disempurnakan pada atau selepas 1 Januari 2012 tetapi tidak lewat dari 31 Disember 2013 adalah dikecualikan daripada duti setem:

(a)

Perjanjian Jual Beli rumah pangsa antara Dewan Bandaraya Kuala

Lumpur dengan pembeli;

(b)

surat cara yang menguatkuasakan pindah hakmilik rumah pangsa daripada Dewan Bandaraya Kuala Lumpur kepada pembeli yang dinamakan dalam Perjanjian Jual Beli dalam perenggan (a); dan

(c)

surat cara dalam bentuk cagaran yang disempurnakan antara pembeli yang dinamakan dalam Perjanjian Jual Beli dalam perenggan (a) dengan suatu bank atau institusi kewangan untuk membiayai pembelian rumah pangsa itu.

STAMP DUTY (EXEMPTION) (NO. 4) ORDER 2012

Opening note

Preamble

IN exercise of the powers conferred by subsection 80(1) of the Stamp Act 1949 [Act 378], the Minister makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Stamp Duty (Exemption) (No. 4) Order 2012.

(2)

This Order is deemed to have come into operation on 1 January 2012 and shall continue to be in operation until 31 December 2013.

Exemption 2.

The following instruments for the purchase of a flat under the Program

Perumahan Rakyat Majlis Tindakan Ekonomi Negara and Perumahan Awam Dewan

Bandaraya Kuala Lumpur executed on or after 1 January 2012 but not later than 31 December 2013 are exempted from stamp duty:

(a)

the Sale and Purchase Agreement of a flat between Dewan Bandaraya

Kuala Lumpur and the purchaser;

(b)

the instrument effecting the transfer of title of the flat from Dewan

Bandaraya Kuala Lumpur to the purchaser named in the Sale and

Purchase Agreement in paragraph (a); and

(c)

the instrument in the nature of security executed between the purchaser named in the Sale and Purchase Agreement in paragraph (a) and a bank or financial institution to finance the purchase of the flat.
