INTERNATIONAL ORGANIZATIONS (PRIVILEGES AND IMMUNITIES) ACT 1992

CENTRE FOR INDONESIA-MALAYSIA-THAILAND GROWTH TRIANGLE SUBREGIONAL
COOPERATION (PRIVILEGES AND IMMUNITIES) REGULATIONS 2013

IN exercise of the powers conferred by subsections 3(1) and 4(1) and section 11 of the
International Organizations (Privileges and Immunities) Act 1992 [Act 485], the
Minister, with the concurrence of the Minister of Finance, makes the following regulations:

Citation 1.
These regulations may be cited as the
Centre
For
Indonesia-Malaysia-Thailand
Growth
Triangle
Subregional
Cooperation
(Privileges and Immunities) Regulations 2013.

Interpretation 2.
In these Regulations, unless the context otherwise requires—

“Staff” means all foreign and local staff members of the Centre who are recruited or seconded under the Centre’s regulations as specified in the Schedule and whose names are communicated from time to time to the relevant authorities in Malaysia;

“Director” means the Director of the Centre;

“Centre” means the Centre For Indonesia-Malaysia-Thailand Growth Triangle
Subregional Cooperation.

Declaration of the Centre to be an international organization 3.
The Centre For Indonesia-Malaysia-Thailand Growth Triangle Subregional
Cooperation is declared to be an international organization to which section 4 of the Act applies.

Juridical personality 4.
The Centre shall have juridical personality and shall have the capacity—
(a)
to contract;
(b)
to acquire, hold and dispose of movable and immovable property; and
(c)
to institute legal proceedings.

Privileges and immunities of the Centre 5.
The Centre shall have the privileges and immunities as specified in paragraphs 1,
2, 4, 5, 6, 7, 8, 9 and 10 of the First Schedule to the Act.

Privileges and immunities of the Director 6.
The Director—

(a)
who is not a Malaysian citizen, shall have the privileges and immunities as specified in Part I of the Second Schedule to the Act;

(b)
who is a Malaysian citizen, shall only be entitled to immunity from suit and from other legal process in respect of acts and things done in his official capacity.

Privileges and immunities of Staff 7.
A Staff—

(a)
who is not a Malaysian citizen, shall have the privileges and immunities as specified in Part I of the Fourth Schedule to the Act;

(b)
who is a Malaysian citizen, shall only be entitled to immunity from suit and from other legal process in respect of acts and things done in his official capacity.

Waiver 8.
(1)
The Indonesia-Malaysia-Thailand Growth Triangle (IMT-GT) shall have the right to waive the privileges and immunities conferred on the Centre.

(2)
The Director shall have the right and duty to waive the immunities conferred on the Staff where, in his opinion, the privileges and immunities would impede the course of justice and can be waived without prejudicing the interests of the
Centre.

(3)
The Government of Malaysia shall have the right and duty to waive the immunities conferred on the Director where, in its opinion, the privileges and immunities would impede the course of justice and can be waived without prejudicing the interests of the Centre.
