Dalam hal orang berinsurans yang mendapat bencana diri selain bencana diri yang bersifat ringan yang disebabkan oleh kemalangan yang disebut di bawah seksyen 24 Akta, majikan hendaklah mengisi notis kemalangan oleh majikan dalam Borang 34 dan memberikan notis itu bersama-sama dengan laporan polis mengenai kemalangan itu dan apa-apa dokumen lain yang ditentukan oleh Pertubuhan.

Notis kemalangan oleh majikan dalam Borang 34

hendaklah diberikan—

(a)

dengan segera atau, jika tidak, dengan seberapa segera yang dapat dilaksanakan mengikut hal keadaan, jika bencana itu mengakibatkan kematian atau jika bencana itu berat, bahawa, bencana itu mungkin menyebabkan kematian atau hilang upaya kekal atau kehilangan anggota badan; atau

dalam apa-apa hal lain, dalam masa empat puluh lapan jam selepas penerimaan notis kemalangan di bawah peraturan 68 atau pada masa kemalangan itu sampai kepada pengetahuan majikan atau mana-mana pegawai lain yang di bawah pengawasannya orang berinsurans itu bekerja pada masa kemalangan itu berlaku atau mana-mana orang lain yang dilantik bagi maksud itu oleh majikan, mengikut mana-mana yang berkenaan.

Satu salinan notis kemalangan oleh majikan dalam Borang 34 hendaklah secara biasanya dihantar oleh majikan kepada Doktor Insurans melalui orang berinsurans pada masa pemeriksaan atau rawatan perubatan pertama orang berinsurans itu.

Jika, atas apa-apa sebab, menjadi tidak praktik bagi majikan untuk menghantar salinan notis kemalangan oleh majikan itu kepada Doktor Insurans melalui orang berinsurans sebagaimana yang dikehendaki di bawah subperaturan (5),

majikan hendaklah, sebagai langkah interim, memberi suatu surat pengenalan dalam apa-apa borang yang ditentukan oleh

Pertubuhan.

Doktor Insurans hendaklah menerima secara sementara surat pengenalan yang disebut dalam subperaturan (6), sebagai ganti salinan notis kemalangan oleh majikan.

Majikan hendaklah, dengan seberapa segera yang dapat dilaksanakan, selepas memberikan surat pengenalan yang disebut dalam subperaturan (6) kepada Doktor Insurans, menghantar secara terus salinan notis kemalangan oleh majikan itu kepada Doktor Insurans.”.

Notis penyakit khidmat oleh majikan di bawah subperaturan (1) hendaklah diberikan oleh majikan kepada

Pertubuhan dalam masa empat puluh lapan jam selepas penerimaan notis penyakit khidmat di bawah peraturan 68A.

Satu salinan notis penyakit khidmat oleh majikan dalam Borang 34 hendaklah secara biasanya dihantar oleh majikan kepada Doktor Insurans melalui orang berinsurans pada masa pemeriksaan atau rawatan perubatan pertama orang berinsurans itu.

Jika, atas apa-apa sebab, menjadi tidak praktik bagi majikan untuk menghantar sesalinan notis penyakit khidmat oleh majikan itu melalui orang berinsurans sebagaimana yang dikehendaki di bawah subperaturan (4), majikan hendaklah, sebagai langkah interim, memberikan suatu surat pengenalan dalam apa-apa borang sebagaimana yang ditentukan oleh Pertubuhan.

Doktor Insurans hendaklah menerima secara sementara surat pengenalan yang disebut dalam subperaturan (5), sebagai ganti salinan notis penyakit khidmat oleh majikan.

Majikan hendaklah, dengan seberapa segera yang dapat dilaksanakan, selepas memberikan surat pengenalan yang disebut dalam subperaturan (5) kepada Doktor Insurans, menghantar secara terus salinan notis penyakit khidmat oleh majikan itu kepada Doktor Insurans.

EMPLOYEES’ SOCIAL SECURITY ACT 1969

EMPLOYEES’ SOCIAL SECURITY (GENERAL) (AMENDMENT) REGULATIONS 2013

IN exercise of the powers conferred by section 105 of the Employees’ Social Security Act 1969 [Act 4], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Employees’ Social Security

(General)(Amendment) Regulations 2013.

(2)

These Regulations come into operation on 1 January 2014.

General amendment 2.

The Employees’ Social Security (General) Regulations, 1971 [P.U. (A) 99/1971]

which are referred to as the “principal Regulations” in these Regulations, are amended by substituting for the words “appropriate office” wherever appearing except paragraph 2(1)(d), regulations 4, 10, 11, 44D, 45, 46, 48, 48A, 56B, 56D, 66, 73, 74, 75,

76, 88, 90, 98, 106C and 119 the word “Organisation”.

Amendment of regulation 2 3.

Regulation 2 of the principal

Regulations is amended by deleting paragraph (1)(d).

Amendment of regulation 4 4.

Regulation 4 of the principal Regulations is amended by substituting for the words “appropriate office” the words “office of the Organisation”.

Amendment of regulation 10 5.

Regulation 10 of the principal Regulations is amended—

(a)

in subregulation (1), by substituting for the words “appropriate office” the word “Organisation”;

(b)

by substituting for subregulation (3) the following subregulation:

“(3)

The employer of every industry shall furnish to the

Organisation not later than thirty days from the date the Act becomes applicable to the industry, the Employer’s Registration

Form and the Employees’ Registration Form duly completed in respect of such industry by any means as determined by the

Organisation.”; and

(c)

by inserting after subregulation (3) the following subregulations:

“(3A)

The employer may authorize in writing any person to complete and furnish the Employer’s Registration Form and

Employees’ Registration Form on his behalf.

(3B)

If the Organisation is satisfied that the employer is unable to complete and furnish the Employer’s Registration Form and Employees’ Registration Form due to any reason, the

Organisation may complete the forms on behalf of the employer.

(3C)

The Employer’s Registration Form and Employees’

Registration Form completed by the Organisation pursuant to subregulation (3B) shall be deemed to be duly completed and furnished by the employer.”.

Amendment of regulation 11 6.

Regulation 11 of the principal Regulations is amended—

(a)

in subregulation (1), by substituting for the words “appropriate office” the word “Organisation”;

(b)

by inserting after subregulation (1) the following subregulations:

If an employer has been issued against him a compound pursuant to the

Employees’

Social

Security

(Compounding of Offences) Regulations 2006 [P.U. (A) 59/2006], the Organisation may allot the Employer’s Code Number to the industry in respect of the employer within thirty days from the expiry date of the payment of the compound.

If an Employer’s Registration Form has not been duly completed and furnished by the employer to the Organisation, the Organisation may still allot an Employer’s Code Number to an industry.

The allotment of the Employer’s Code Number under subregulations (1A) and (1B) by the Organisation shall not exempt the employer from completing and furnishing Employer’s

Registration Form and Employees’ Registration Form as required under regulation 10.”; and

(c)

in subregulation (2), by substituting for the words “appropriate office” the word “Organisation”.

Substitution of regulation 12 7.

The principal Regulations are amended by substituting for regulation 12 the following regulation:

Every employer shall complete the

Registration Form containing a list of new employees and shall forward the form to the Organisation within the period of one month from the month of employment of the employees.”.

Amendment of regulation 41 8.

Regulation 41 of the principal Regulations is amended—

by renumbering the existing paragraph as subregulation (1);

(b)

in subregulation (1), by substituting for the word “Where” the words

“Subject to subregulations (2) and (3), where”; and

(c)

by inserting after subregulation (1) the following subregulations:

“(2)

The Organisation shall refund the contributions erroneously paid under subregulation (1), if the refund is claimed within the period of seven years from the date the contribution is paid in error.

(3)

If an employee was employed by more than one employer and the amount of contributions from the employers for the employee have exceeded the maximum assumed monthly wage of the employee for any particular month, the excess of the contribution shall be refunded to the employer and the employee respectively on a pro-rata basis based on each of the employer's and the employee’s share of the contribution.”.

Amendment of regulation 44D

9.

Regulation 44D of the principal Regulations is amended—

(a)

by inserting after the word “submit” the words “to the Organisation”; and

(b)

by deleting the words “to the appropriate office”.

Substitution of regulation 45 10.

The principal Regulations are amended by substituting for regulation 45 the following regulation:

“Claim for benefit

45.

(1)

Every claimant shall submit his claim for a benefit payable under the Act in writing, in accordance with these

Regulations, to the Organisation in Form 34 for the purpose of the benefit for which the claim is made or in such other manner as the Organisation may, subject to it being in writing, accept as sufficient in the circumstances of any particular case or class of cases.

(2)

The Organisation shall provide assistance for filling in the form of claim in case of insured persons who cannot do so themselves.”.

Substitution of regulation 46 11.

The principal Regulations are amended by substituting for regulation 46 the following regulation:

“Notice of invalidity 46.

(1)

An insured person intending to claim invalidity pension or invalidity grant shall give notice of invalidity to the

Organisation by any means determined by the Organisation.

(2)

An insured person shall, after giving the notice of invalidity under subregulation (1), complete and furnish

Form 34 to the Organisation.

(3)

Form 34 referred to in subregulation (2) shall be accompanied by a medical report from any Registered Medical

Practitioner showing the precise location, nature, extent and diagnosis of the morbid condition giving rise to invalidity.

(4)

The medical report referred to in subregulation (2) shall be in a form approved by the

Organisation.

(5)

A person who has attained sixty years of age may give a notice of invalidity if he can prove that—

(a)

he is suffering from a specific morbid condition of permanent nature;

(b)

he is incapable of engaging in any substantially gainful activities that the morbid conditions has set in before he attains the age of sixty; and

(c)

he has not been gainfully employed since then.

(6)

For the purpose of this regulation, “Registered

Medical Practitioner” means a medical practitioner who is registered under the Medical Act 1971 [Act 50].”.

Amendment of regulation 48 12.

Regulation 48 of the principal Regulations is amended—

(a)

by substituting for the words “invalidity pension (or grant)” wherever appearing the words “invalidity pension or invalidity grant”;

(b)

by inserting after the words “its decision” the words “to the

Organisation”;

(c)

by deleting the words “to the appropriate office”; and

(d)

by substituting for the words “by the appropriate office” the words “by the Organisation”.

Amendment of regulation 48A

13.

Subregulation 48A(3) of the principal Regulations is amended—

by substituting for the words

Amendment of regulation 53 14.

Regulation 56B of the principal Regulations is amended—

(a)

Amendment of regulation 58 18.

Subregulation 58(3) of the principal Regulations is amended—

(a)

by substituting for the words “his National Registration Identity Card” the words “his document of identification”; and

(b)

by substituting for the words “Form 21” the words “Form 34”.

Amendment of regulation 59 19.

Regulation 59 of the principal Regulations is amended—

(a)

by substituting for subregulation (1) the following subregulation:

“(1)

The medical certificate shall be in Form 13 and duly completed by the Insurance Medical Practitioner.”; and

(b)

by inserting after subregulation (1) the following subregulations:

“(1A) If it is not practicable for the Insurance Medical

Practitioner to complete the medical certificate in Form 13 as required under subregulation (1), the Insurance Medical

Practitioner may complete the medical certificate in any other form as may be determined by the Organisation.

The medical certificate under subregulation (1) shall contain a concise statement of the disablement which, in the opinion of the Insurance Medical Practitioner, renders a person temporarily incapable of work.

The statement of the disablement under subregulation (1B) shall specify the nature of the disablement as precisely as the knowledge of the Insurance Medical Practitioner on the condition of the insured person at the time of the examination in accordance with any written law on it.”.

Amendment of regulation 66 20.

Subregulation 66(1) of the principal Regulations is amended by substituting for the words “the appropriate office by post or otherwise, a claim for benefit in Form 10”

the words “the Organisation, a claim for benefit in Form 34”.

Amendment of regulation 68 21.

Regulation 68 of the principal Regulations is amended—

(a)

in subregulation (1), by inserting after the words “in writing or orally” the words “to the employer or the Organisation by any means as may be determined by the Organisation,”; and

(b)

in subregulation (2), by inserting after the words “by the employer” the words “or the Organisation”.

Amendment of regulation 68A

22.

Regulation 68A of the principal Regulations is amended—

(a)

in subregulation (1), by inserting after the words “in writing or orally” the words “to the employer or the Organisation by any means as may be determined by the Organisation,”; and

(b)

in subregulation (2), by substituting for the words “in such form as may be provided by the Organisation” the words “in Form 34”.

Substitution of regulation 71 23.

The principal Regulations are amended by substituting for regulation 71 the following regulation:

“Notice of accident by an employer

71. (1)

If a notice of accident is sent to an employer under regulation 68, the employer shall, immediately after the receipt of the notice, complete the notice of accident by an employer in Form 34 and furnish the notice of accident by an employer to the Organisation and a copy of the notice to an

Insurance Medical Practitioner.

(2)

If no notice of accident by an employer in

Form 34 is furnished by the employer, the Organisation may, in its discretion, accept any other evidence relating to the accident.

(3)

In the case of an insured person who sustains personal injury other than personal injury of a minor nature caused by an accident referred to under section 24 of the Act, the employer shall complete the notice of accident by an employer in Form 34 and furnish the notice together with the police report on the accident and such other documents as may be determined by the Organisation.

(4)

The notice of accident by an employer in Form 34

shall be furnished—

(a)

immediately or, otherwise, as soon as practicable under the circumstances, if the injury has resulted in death or if the injury is serious, that, it is likely to cause death or permanent disablement or loss of a body part; or

(b)

in any other case, within forty-eight hours after the receipt of the notice of accident under regulation 68 or at the time the accident comes to the notice of the employer or any official under whose supervision the insured person was employed at the time of occurrence of the accident or any other person designated for the purpose by the employer, as the case may be.

(5)

A copy of the notice of accident by an employer in Form 34 shall ordinarily be sent by the employer to the

Insurance Medical Practitioner through the insured person at the time of the first medical examination or treatment of the insured person.

(6)

If, due to any reason, it is not practicable for the employer to send a copy of the notice of accident by an employer to the Insurance Medical Practitioner through the insured person as required under subregulation (5), the employer shall, as an interim measure, give a letter of

identity in such form as may be determined by the

Organisation.

(7)

The Insurance Medical Practitioner shall accept provisionally such letter of identity referred to in subregulation (6), in place of the copy of the notice of accident by an employer.

(8)

The employer shall, as soon as practicable, after giving the letter of identity referred to in subregulation (6) to the Insurance Medical Practitioner, send directly the copy of the notice of accident by an employer to the Insurance Medical

Practitioner.”.

Substitution of regulation 71A

24.

The principal Regulations are amended by substituting for regulation 71A the following regulation:

“Notice of occupational disease by an employer

71A. (1)

If a notice of occupational disease is sent to an employer under regulation 68A, the employer shall, immediately after the receipt of the notice, complete the notice of occupational disease by an employer in Form 34 and furnish the notice of occupational disease to the Organisation and a copy of the notice to an Insurance Medical Practitioner.

(2)

If no notice of occupational disease by an employer in Form 34 is sent by the employer, the Organisation may, in its discretion, accept any other evidence relating to an employment injury caused by an occupational disease.

(3)

The notice of occupational disease by an employer under subregulation (1) shall be furnished by the

employer to the Organisation within forty-eight hours after the receipt of the notice of occupational disease under regulation 68A.

(4)

A copy of the notice of occupational disease by an employer in Form 34 shall ordinarily be sent by the employer to the Insurance Medical Practitioner through the insured person at the time of the first medical examination or treatment of the insured person.

(5)

If, due to any reason, it is not practicable for the employer to send a copy of the notice of occupational disease by an employer through the insured person as required under subregulation (4), the employer shall, as an interim measure, give a letter of identity in such form as may be determined by the Organisation.

(6)

The Insurance Medical Practitioner shall accept provisionally such letter of identity referred to in subregulation (5), in place of the copy of the notice of occupational disease by an employer.

(7)

The employer shall, as soon as practicable, after giving the letter of identity referred to in subregulation (5) to the Insurance Medical Practitioner, send directly the copy of the notice of occupational disease by an employer to the

Insurance Medical Practitioner.

(8)

If an employer has not been given a notice of occupational disease under regulation 68A but has knowledge that an insured person is suffering from an occupational disease specified in the Fifth Schedule to the Act, the employer

shall complete the notice of occupational disease by an employer in Form 34 as if he has been duly notified under regulation 68A.”.

Regulation 73 of the principal Regulations is amended—

(a)

by substituting for the words

Medical Board 75.

Subject to subregulation (2), a reference to the

Medical Board for the determination of the disablement question of an insured person may be made by—

(a)

the disabled person, his employer or a recognized trade union;

(b)

the Organisation; or

an appropriate officer.

(2)

A reference for the determination of the disablement question under subregulation (1) may be made—

(a)

by the disabled person, his employer or a recognized trade union, if a request for the reference is made by the disabled person, his employer or the recognized trade union, to the Medical Board;

(b)

by the Organisation, if the period of disablement specified in the medical certificate of the insured person exceeds one hundred and eighty days in total; and

(c)

by an appropriate officer—

(i)

at any time, but not more than once in six consecutive months; and

(ii)

if in the opinion of the Director

General or any other officer authorized by him, the circumstances of any particular case so justify.”.

Substitution of regulation 76 28.

The principal Regulations are amended by substituting for regulation 76 the following regulation:

“Report of Medical

Board 76.

(1)

The Medical Board shall, after examining the disabled person, give its decision to the Organisation in a form and by any means, as may be determined by the Organisation.

(2)

The Organisation shall inform the disabled person of the decision of the Medical Board and the benefit, if any, to which the disabled person is entitled to, in writing or by any other means as may be determined by the Organisation.”.

Substitution of regulation 83 29.

The principal Regulations are amended by substituting for regulation 83 the following regulation:

“Claim for permanent disablement benefit 83.

(1)

An insured person is entitled to a claim of permanent disablement benefit if he is certified to be permanently disabled by—

(a)

a Medical Board;

(b)

a Special Medical Board; or

(c)

an Appellate Medical Board, as the case may be.

(2)

The Organisation may process the claim under subregulation (1) based on the information obtained in

Form 34 which has been completed and furnished by an insured person pursuant to regulation 66.

(3)

If an insured person is unable to make a claim under subregulation (1) due to death, coma or insanity, the

Organisation may decide that such claim has been duly made.”.
