Preamble

PADA menjalankan kuasa yang diberikan oleh seksyen 127 Akta Pengangkutan Jalan 1987 [Akta 333], Menteri membuat kaedah-kaedah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Kaedah-kaedah ini bolehlah dinamakan Kaedah-Kaedah Kenderaan

Barangan (Pelesenan Pemandu) (Pindaan) 2013.

(2)

Kaedah-Kaedah ini mula berkuat kuasa pada 15 Mac 2013.

Seksyen 2

1965

[L.N. 158/1965], yang disebut “Kaedah-Kaedah ibu” dalam Kaedah-Kaedah ini, dipinda dalam kaedah 4—

(a)

dalam subkaedah (2), dengan menggantikan perkataan “prescribed fee”

dengan perkataan “payment of fee as prescribed in item 1 of Table A of the Second Schedule”;

(b)

dalam subkaedah (4), dengan menggantikan perkataan “in the Schedule”

dengan perkataan “in the First Schedule”; dan

(c)

dengan memasukkan selepas subkaedah (4) subkaedah yang berikut:

“(5)

Where the applicant of a licence is the holder of a licence issued under the Public Service Vehicles (Licensing and Conduct of

Drivers, Conductors and Passengers) Rules 1959 [L.N. 177/1959], the fee referred to in subrule (2) shall not apply.

“Renewal of a licence.

(6)

The applicant of a licence referred to in subrule (5) shall be subject to the fee as prescribed in item 2 of Table A of the

Second Schedule.

(7)

Upon receipt of the application for a licence, the date of expiry of the licence shall be in accordance with the date of birth of the holder of a licence.”.

Seksyen 3

Kaedah baru 4A dan 4B

Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 4 kaedah yang berikut:

Seksyen 4A

(1)

A holder of a licence may apply for renewal of a licence before the date of expiry of such licence.

(2)

Where the holder of a licence whose date of birth falls on 29 February, the date of expiry of his licence is either—

(a)

February, if the following application for renewal of the licence is made in a year which is not a leap year; or

(b)

February, if the following application for renewal of the licence is made in a year which is a leap year, as the case may be.

(3)

Upon receipt of the application for renewal of the licence—

(a)

the date of expiry of the licence shall be in accordance with the date of birth of the holder of a licence; and

(b)

the existing licence together with proof of payment and renewal of such licence shall be sufficient evidence that the holder of a licence is the holder of a valid licence.

(4)

The fee for renewal of the licence shall be as prescribed in item 1 of Table A of the Second Schedule.

(5)

Where the holder of a licence is the holder of a licence issued under the Public Service Vehicles

(Licensing and Conduct of Drivers, Conductors and

Passengers) Rules 1959, the fee referred to in subrule (4)

shall not apply.

(6)

If the application for renewal of the licence is made after the date of expiry of the licence, the fee to be charged shall be as prescribed in items 1 and 3 of Table A of the Second Schedule.

Seksyen 4B

(1)

An adjustment for the date of expiry of a licence shall be made once only in accordance with the date of birth of the holder of a licence.

(2)

The adjustment for the date of expiry of a licence referred to in subrule (1) shall apply to—

Adjustment for the date of expiry of a licence.

(a)

an applicant who applies for a licence;

and

(b)

a holder of a licence who applies for renewal of a licence upon the expiry of such licence.

(3)

Where the applicant or the holder of a licence referred to in subrule (2) whose date of birth falls on 29 February, the date of expiry of his licence is either—

(a)

February, if the following application for renewal of the licence is made in a year which is not a leap year; or

(b)

February, if the following application for renewal of the licence is made in a year which is a leap year, as the case may be.

(4)

The fees to be charged for the purpose of the adjustment of the date of expiry of a licence shall be as prescribed in Table B of the Second Schedule.

(5)

Where the applicant or the holder of a licence referred to in subrule (2) is the applicant or the holder of a licence issued under the Public Service Vehicles

(Licensing and Conduct of Drivers, Conductors and

Seksyen 3

Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 6 dengan kaedah yang berikut:

The fees for the application or renewal of a licence and other fees as may be relevant shall be as prescribed in Table A of the Second Schedule.

(2)

The fees for the adjustment of the date of expiry of a licence in accordance with the date of birth of the holder of a licence shall be as prescribed in Table B of the Second Schedule.”.

GOODS VEHICLES (LICENSING OF DRIVERS) (AMENDMENT) RULES 2013

Opening note

Preamble

IN exercise of the powers conferred by section 127 of the Road Transport Act 1987 [Act 333], the Minister makes the following rules: Citation and commencement 1.

(1)

These rules may be cited as the Goods Vehicles (Licensing of Drivers)

(Amendment) Rules 2013.

(2)

These Rules come into operation on 15 March 2013.

Amendment of rule 4 2.

The Goods Vehicles (Licensing of Drivers) Rules 1965 [L.N. 158/1965], which are referred to as the “principal Rules” in these Rules, are amended in rule 4—

(a)

in subrule (2), by substituting for the words “prescribed fee” the words

“payment of fee as prescribed in item 1 of Table A of the Second

Schedule”;

(b)

in subrule (4), by substituting for the words “in the Schedule” the words

“in the First Schedule”; and

(c)

by inserting after subrule (4) the following subrules:

“(5)

Where the applicant of a licence is the holder of a licence issued under the Public Service Vehicles (Licensing and Conduct of

Drivers, Conductors and Passengers) Rules 1959 [L.N. 177/1959], the fee referred to in subrule (2) shall not apply.

(6)

The applicant of a licence referred to in subrule (5) shall be subject to the fee as prescribed in item 2 of Table A of the

Second Schedule.

(7)

Upon receipt of the application for a licence, the date of expiry of the licence shall be in accordance with the date of birth of the holder of a licence.”.

New rules 4A and 4B

Seksyen 3

The principal Rules are amended by inserting after rule 4 the following rules:

Seksyen 4A

(1)

A holder of a licence may apply for renewal of a licence before the date of expiry of such licence.

(2)

Where the holder of a licence whose date of birth falls on 29 February, the date of expiry of his licence is either—

(a)

February, if the following application for renewal of the licence is made in a year which is not a leap year; or

(b)

February, if the following application for renewal of the licence is made in a year which is a leap year, as the case may be.

(3)

Upon receipt of the application for renewal of the licence—

“Renewal of a licence.

(a)

the date of expiry of the licence shall be in accordance with the date of birth of the holder of a licence; and

(b)

the existing licence together with proof of payment and renewal of such licence shall be sufficient evidence that the holder of a licence is the holder of a valid licence.

(4)

The fee for renewal of the licence shall be as prescribed in item 1 of Table A of the Second Schedule.

(5)

Where the holder of a licence is the holder of a licence issued under the Public Service Vehicles

(Licensing and Conduct of Drivers, Conductors and

Passengers) Rules 1959, the fee referred to in subrule (4)

shall not apply.

(6)

If the application for renewal of the licence is made after the date of expiry of the licence, the fee to be charged shall be as prescribed in items 1 and 3 of Table A of the Second Schedule.

Seksyen 4B

(1)

An adjustment for the date of expiry of a licence shall be made once only in accordance with the date of birth of the holder of a licence.

(2)

The adjustment for the date of expiry of a licence referred to in subrule (1) shall apply to—

Adjustment for the date of expiry of a licence.

(a)

an applicant who applies for a licence;

and

(b)

a holder of a licence who applies for renewal of a licence upon the expiry of such licence.

(3)

Where the applicant or the holder of a licence referred to in subrule (2) whose date of birth falls on 29

February, the date of expiry of his licence is either—

(a)

February, if the following application for renewal of the licence is made in a year which is not a leap year; or

(b)

February, if the following application for renewal of the licence is made in a year which is a leap year, as the case may be.

(4)

The fees to be charged for the purpose of the adjustment of the date of expiry of a licence shall be as prescribed in Table B of the Second Schedule.

(5)

Where the applicant or the holder of a licence referred to in subrule (2) is the applicant or the holder of a licence issued under the Public Service Vehicles

(Licensing and Conduct of Drivers, Conductors and

Passengers) Rules 1959, the fee referred to in subrule (4)

shall not apply.”.

Amendment of rule 6 4.

The principal Rules are amended by substituting for rule 6 the following rule:

Seksyen 6

(1)

The fees for the application or renewal of a licence and other fees as may be relevant shall be as prescribed in Table

A of the Second Schedule.

(2)

The fees for the adjustment of the date of expiry of a licence in accordance with the date of birth of the holder of a licence shall be as prescribed in Table B of the Second Schedule.”.

Amendment of rule 6A

Seksyen 5

Rule 6A of the principal Rules is amended by substituting for the marginal note the following marginal note:

“Requirement for renewal of a licence.”.

Deletion of rule 7 6.

The principal Rules are amended by deleting rule 7.

New Second Schedule 7.

The principal Rules are amended—

(a)

by renaming the existing Schedule as the “FIRST SCHEDULE”; and

(b)

by inserting after the First Schedule the following schedule:
