Opening note
Preamble
- PADA menjalankan kuasa yang diberikan oleh seksyen 142 Akta Kastam 1967 [Akta 235], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa
Seksyen 2
Peraturan baharu 15A
Peraturan-Peraturan Kastam 1977 [P.U. (A) 162/1977] dipinda dengan memasukkan selepas peraturan 15 peraturan yang berikut:
“Pengeksportan rokok atau liquor yang memabukkan yang belum dibayar duti dari Labuan, Langkawi atau Tioman 15A. (1) Tiada rokok atau liquor yang memabukkan yang belum dibayar duti boleh dieksport melalui laut dari Labuan, Langkawi atau Tioman ke suatu tempat lain di luar Malaysia melainkan jika—
(a)
pemunya rokok atau liquor yang memabukkan itu atau agennya telah mengemukakan kepada pegawai kastam yang hak di tempat eksport borang Kastam No. 2 dalam Jadual Kedua;
(c)
rokok atau liquor yang memabukkan itu dimuatkan atau diangkut melalui air untuk dikapalkan untuk diangkut di bawah penyeliaan atau arahan pegawai kastam yang hak.

Utama Kastam ke suatu tempat lain di luar Malaysia melainkan jika—
(b)
pemunya rokok atau liquor yang memabukkan itu atau agennya telah memberi cagaran terhadap pematuhan yang sewajarnya terhadap peruntukan-peruntukan
Akta dan semua peraturan-peraturan, perintah-perintah atau kaedah-kaedah yang dibuat di bawahnya sebagaimana yang dikehendaki oleh pegawai kastam yang hak;
(c)
rokok atau liquor yang memabukkan itu dipindahkan dalam kontena ISO atau oleh pengangkut berlesen; dan
(d)
rokok atau liquor yang memabukkan itu dimuatkan untuk diangkut melalui jalan di bawah penyeliaan atau arahan pegawai kastam yang hak.

CUSTOMS (AMENDMENT) (NO. 5) REGULATIONS 2016
Opening note
Preamble
- IN exercise of the powers conferred by section 142 of the Customs Act 1967 [Act 235], the Minister makes the following order: Citation and commencement 1.
Seksyen 2
The Customs Regulations 1977 [P.U. (A) 162/1977] are amended by inserting after regulation 15 the following regulation:
“Exportation of cigarette or intoxicating liquor on which duty has not been paid from Labuan, Langkawi or Tioman 15A. (1)
No cigarette or intoxicating liquor on which duty has not been paid shall be exported by sea from Labuan, Langkawi or Tioman to another place outside
Malaysia unless—
(a)
the owner of the cigarette or intoxicating liquor or his agent has submitted to the proper officer of customs at the place of export form Customs No. 2 in the Second Schedule;
(c)
the cigarette or intoxicating liquor be loaded or water-borne to be shipped for transportation under the supervision of or under directions of a proper officer of customs.

(2)
No cigarette or intoxicating liquor on which duty has not been paid shall be exported by road from Labuan, Langkawi or Tioman through the Principal
Customs Area to another place outside Malaysia unless—
(a)
the owner of the cigarette or intoxicating liquor or his agent has submitted to the proper officer of customs at the place of export form Customs No. 8 in the Second Schedule;
(b)
the owner of the cigarette or intoxicating liquor or his agent has furnished such security for the due observance of the provisions of the Act and all regulations, orders or rules made thereunder as the proper officer of customs may require;
(c)
the cigarette or intoxicating liquor be moved in ISO containers or by a licensed carrier; and
(d)
the cigarette or intoxicating liquor be loaded for transportation by road under the supervision of or under directions of a proper officer of customs.
